MINUTES OF THE POLICY RELAXATION COMMITTEE MEETING NO.10/AM06 HELD ON 14th November, 2005 The meeting was held under the Chairmanship of DG and the list of officers present in the meeting is given in Annexure-I. The decision taken in each individual case taken up for discussion by PRC is detailed below: Case No. 1. Firm’s Name Principal Chief Conservator of Forests, Bangalore File No. 01/53/162/1002/AM03/K-32/ILS Subject: Revalidation of import licence No.0532518 dt. 28.1.2003. The Committee agreed to allow revalidation upto 31.3.2006 in respect of import licence No.0532518 dated 28.1.2003 issued to Principal Conservator of Forests, Karnataka Govt. Bangalore. This will however be the last revalidation against instant licence and no further requests on this score will be entertained. Case No. 2. Firm’s Name M/s. Manaksia Ltd, Kolkata File No. 01/81/162/493/AM06/DES-II/DES-I Subject: Revalidation of advance licence No.0210034838 dt. 23.5.2002. The Export Obligation is stated to have been fulfilled and the goods against the said licence having already arrived in the bonded area, it was decided to allow revalidation for a period of three months in respect of advance licence No.0210034838 dated 23.5.2002. This period of three months will commence from the date such endorsement is made on the licence and will

2 be applicable only for clearance of goods already arrived into the country and lying in the bonded area. Case No. 3. Firm’s Name M/s. Cepham Milk Specialities Ltd., New Delhi File No. 01/83/218/14/AM00/DES-VI/DES-III Subject: Extension of EOP for the licences issued to various group companies of M/s. Cepham Milk Specialities Ltd. The Committee observed that the licence in respect of which EO has been sought to be extended were issued between AM 93 to 98. One of the licences related to EPCG scheme whereas others were issued under advance licensing scheme, as per the statement annexed to the agenda. The procedure laid down for consideration of such case is that they have to come through respective ALC/EPCG Committee before PRC can take a view. Accordingly, a suitable action in this regard may be taken by respective ALC/EPCG Committee who will examine in detail the merits of the case and make a suitable recommendation before the case is decided by PRC. It was observed that this case had come up before GRC and, since considerable delay has come to notice in disposing of these cases as recommended by GRC, a suitable communication may also be sent to Grievance Redressal Cell seeking extension of time for a final disposal. Case No. 4. Firm’s Name M/s. E. Infochips Ltd., Ahmedabad File No. 01/92/180/234/AM06/PC-II Subject: Condonation of DTA sale lapse. The Committee agreeing with the recommendation of Department of Information Technology decided to relax the policy provision for DTA sale lapse by the STPI unit as it had been reported that

3 DTA sale amounting to Rs.38.68 lakhs made by the applicant during 1998 to 2001-02 without seeking advance permission from STPI was much less than entitled DTA sale value for the same period. Case No. 5. Firm’s Name M/s. Zazman Exports, Kanpur File No. 01/84/50/341/AM04/DES-V Subject: Retrospective application of PN-62 dated 11.5.2004 for allowing certain chemicals for dual density soles under advance licences issued prior to PN 62. The Committee agreed to allow extension in EO period for a period of six months to fulfill the balance Export Obligation period by exporting Gents Half Boots/Shoes with Dual Density soles, proportionate to the imports already made. However, no further revalidation will be allowed and the Export Obligation may be worked out by the RLA concerned proportionate to the imports already made. This extension will further be subject to the condition that a suitable exempt material declaration is available in shipping bills and the inputs already imported are accounted for in the export product as also subject to payment of applicable composition fee for exports made beyond the prescribed time limit of 18 months as per FTP. Case No. 6. Firm’s Name M/s. Tarbez Impex, Surat File No. 01/84/162/435/AM06/DES-V Subject: Revalidation of DEPB licence No.3710000065 dt. 19.1.2004, 371000049 dt.13.11.2003 and 3710000050 dt. 13.11.2003.

4 The Committee agreeing with the recommendation of ALC agreed to revalidate three DEPB licences bearing Nos. 3710000065 dated 19.01.2004, 371000049 dated 13.11.2003 and 3710000050 dated 13.11.2003 for a period of three months and this period will commence from the date of endorsement of revalidation on these DEPB licences. Case No. 7. Firm’s Name M/s. HEG Ltd. File No. 01/94/180/HEG/GRC/AM06/PC-IV Subject: Request for waiver of requirement of the endorsement of date of realization in the BRC submitted. The applicant having already produced the copy of letter issued by RBI where that agency has intimated their inability to make available the date of realization of export proceeds and the applicant having submitted a CA certificate and affidavit in support of claim of having realized the payment in free foreign exchange, it was decided to waive the requirement of endorsement with date of the realization in BRC in respect of DEPB No. 0031698 dated 27.10.1997. The meeting ended with vote of thanks to the Chair.
