Thereafter agenda for individual case was taken up for discussion. Decision taken in each case is enumerated below. Adhoc norms fixed in this meeting are valid for a period of 12 months as per Public Notice 37 dated 23.08.2007.

Committee perused the comments of MPEDA vide their letter No. 11(7)/200607 dated 18.03.2009 and since the yield applied is higher than that recommended by MPEDA, committee ratified the Advance Licence as applied for as under: Export Items Qty. The case was considered by the committee as per the agenda. Committee noted that RLA New Delhi has requested for prior approval, as perfume is one of the indigenous input. In this regard, Committee noted that under Para 4.7 of HBP Vol.I for export of perfumes, perfumery compounds and various feed ingredients containing vitamins, no Authorisation shall be issued by RA and applicants may apply under 4.4.2 of HBP vol. I. In this case, however, export product is not perfume/perfumery compound or feed ingredient containing vitamins. Therefore, this para is not applicable in the instant case. Committee in consultation with technical representative present in the meeting decided to ratify input output norms with 5% wastage as under, subject to composition of gumbase in import and export product should remain same. The committee noted that the issue of climatic condition in th export market in North America, has been already factored in while fixing norms under SION A3346. Committee decided to maintain statusquo and therefore rejected the request as no enhancement in inputs is permitted.

The committee noted that the export item i.e. Ethyl Vincaminate, may not be covered under Chapter 20 of ITC(HS), which is regarding preparations of vegetable, Fruit, Nut or other parts of Plants. Committee observed that the ITC(HS) Code of export product may be incorrect. It was decided that RA may call for Shipping Bill and ascertain the correct ITC code of the export product and refer the case to the concerned NC. Accordingly, case may be deemed to be rejected at this moment.
