DGFT. At the outset the minutes of Norms Committee Meeting 18/08 held on 16.8.2007 were ratified by the committee. List of Members Present in the Meeting is at Annexure I. Total Number of Cases 33. No.502 1/20/85-ALC3/2007 M/s. Dinesh Saraogi, Kolkatta. NC 20/08 Dt.23.8.2007 F.No. 01/85/50/045/AM08/DES-VI Export of Shellac against import of Sticklac Adv. Auth No. 0210102188 dt. 6.7.2007 (Para 4.7 of HBP 2004-09) RLA, Kolkatta Ref.No. 02/24/40/106/AM08 The Committee considered the case as per agenda. It was observed that a large number of cases have been ratified for the export product “Shellac” against import of “Sticklac”. No justified data of production and consumption has been furnished by exporters of this product. The committee decided that a visit may be made by the officers of DIPP and DGFT to furnish a report on the production and consumption of 3/ 4 manufacturing units of this products. Consideration of the cases was deferred for relisting on 29.9.2007.

As per O&MI No.12/2007 dated 20.8.2007 this product falls with jurisdiction of NC No.2. It was accordingly decided to transfer the case to NC No.2 for necessary action. It was observed that the Export Product “Finished Wooden Parts & Components of Musical Instruments” falls under Chapter 92. As per O&MI No.12/2007 dated 20.8.2007 this product falls with jurisdiction of NC No.2. It was accordingly decided to transfer the case to NC No.2 for necessary action. Export of Black Pepper Oil against Import of Light Black Pepper (L.B). Advance Authorization No. 1010026806 dt. 25.6.2007 under Para 4.7 of HBP(Vol.I) 2004-07. RLA , Cochin . Ref.No.02/24/040/00051/AM08 The Committee considered the case as per agenda. It was observed that in this case SAR report about the yield of import consignment(s) from Spices Board is awaited. Applicant has applied for ratification of Advance Authorisation based on 15.50% yield in this case. Accordingly the committee decided to ratify the Advance Authorisation in this case as under:- (A) RA shall work out the EO as per yield percentage certified in the SAR of Spices Board against specified quantity of imports against each import consignment. WHICHEVER IS HIGHER YIELD (AMONG (B) AND (C) ABOVE). Spices Board may be advised to send a copy of SAR to the Joint DGFT, Cochin under intimation to DGFT alongwith a set of SAR Report. Accordingly RA may be advised to re-fix the EO based on the above decision upon receipt of SAR report from Spices Board and take necessary action subject to other usual terms and conditions of the Foreign Trade Policy/Procedure. It was observed that the Spices Board has given written comments vide letter No.MD/AL/03(1)/2007 dated 26.7.2007 for Analytical Report in respect of 10 Bill of Entries of Imports made against the advance authorization in question. As per O&MI No.12/2007 dated 20.8.2007 this product falls with jurisdiction of NC No.3. It was accordingly decided to transfer the case to NC No.3 for necessary action. No.529 M/s. YKK India Pvt. Ranjan Upreti, Head Import and Export of the firm appeared for PH before the committee and explained the details of various manufacturing steps and wastage arising therefrom. The representative of the Technical Authority present in the meeting sought time to furnish their comments based on inputs given in PH. Advance Licence No.0210101306 dt. 5.6.2007 under para 4.7 of HBP RLA , Kolkata. Ref.No.02/24/040/069/AM08. The Committee considered the case as per agenda. It was observed that the applicant is meeting the requirement of minimum 100% value addition prescribed for export of Tea products against import of Tea. The committee in consultation with the representative of the technical authority present in the meeting decided that imports may be permitted subject to accountability clause as per details below:- S. (ii) Type of relevant Flavouring Essence in import and exports both shall match. (iii) Type of relevant Flavouring Essence in imports shall be declared in the Shipping Bills for export of Tea in Tin Cans. (iv) The total Quantity of relevant Flavouring Essence in imports shall be limited upto 1% of the total weight of Flavoured Tea in exports. RA may be advised to ratify the Advance Authorisation under para 4.7 of the HBP accordingly and take necessary action subject to other usual terms and conditions of the Foreign Trade Policy/Procedure.

Advance Authorization No.1010026759 dt. 18.6.2007 under Para 4.7 of HBP(Vol.I) 2004-07. RLA , Cochin. Ref.No.10/24/040/00061/AM08 Dated 21.6.2007 The Committee considered the case as per agenda. It was observed that the Spices Board has given two SAR dated 9.8.2007 and 13.8.2007 for Analytical Report in respect of 2 Bill of Entries of Imports made against the advance authorization in question. It was decided that the higher yield as per SAR OR as applied by the party allowed, may be allowed. It was observed that as per WCO Scientific Committee dated 17.1.2002 the product “Sucralose” is a Hetrocyclic Compounds and classified under Chapter 29.32 of ITC(HS). As per O&MI No.12/2007 dated 20.8.2007 this product falls with jurisdiction of NC No 3. It was accordingly decided to transfer the case to NC No.3 for necessary action. No. 01/87/050/280/AM04 /DES VI Request for increase of wastage for Export of “Cut and Polished Lab Created Diamonds” against import of “Lab Created Rough Synthetic Diamonds” A/L No 0310214282 Dt. 15.3.2003 -under para 4.7 of HBP 2004-09 RLA Mumbai Ref. No.03/24/040/677/AM04 The Committee considered this case as per agenda. It was observed that in this case Advance Licence has been issed for the export prodcut “Cut and Polished Lab Created Diamonds” on 15.3.2003 under para 4.7 of HBP. It was decided to obtain comments of Policy Cell-I as to whether the case for the export product “Cut and Polished Lab Created Diamonds” advance will be covered under para 4.7 of HBP or para 4A of the FTP/HBP for the relevant policy period.
