Minutes of the Policy Relaxation Committee Meeting no. 20/AM14 held on 10.09.2013 at 11.30 A.M. F.No. 01/60/162/913/AM12/EFGC (PRC) PRC Meeting No. 20/AM14 dated 10.09.2013 Subject: ­ Request for EOP extension of Advance Authorization No. 0410098492 dated 10.09.2008 upto 48 months for regularization purpose. The committee deliberated the case at length and noted that the firm has made exports to the tune of 17.23% within the validity of the authorization and 60% exports out side the export validity and that is too under drawback scheme.  As per drawback procedure, refund is made under Automatic route within 5 working day from the date of shipment and no separate application is required for that. Hence the request of the firm to account for the export made under drawback scheme cannot be acceded to.  The applicant is hereby directed to get their case regularized in terms of Para 4.28 of HBP.    (Action: RA Chennai. If the party fails to get the case regularized in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT (D&R) Act. 1992 and submit an Action Taken Report).

After deliberating the case at length the following decisions were taken:         I.            Export obligation period is extended upto 42 months from the date of issue of authorization i.e. upto 31.3.2013. The Authorization had the validity of 36 months.       II.            This is only for regularization and closure purpose.     III.            This is subject to a payment of composition fee @ 0.5% on FOB value of export made outside the original EOP and minimum value addition of 15% as prescribed under Para 4.1.6 of FTP.     IV.            Export made beyond 42 months shall not be accounted for.       V.            Shortfall, if any, shall be regularized in terms of Para 4.28 of HBP. F.No. 01/60/162/1036/AM13/EFGC (PRC) Subject: ­ Request for EOP extension of Advance Authorization No. 0710065827 dated 08.07.2009 for regularization purpose. The Committee observed that the applicant had approached PRC earlier with the request for EOP extension, however, the Committee in its Meeting NO. 02/AM14 dt. 09.04.2013 rejected the request on the ground of less than 50% exports made within original EO Period.  Now, the applicant after completing the EO has approached the Committee again for EOP extension for regularization purpose. The Committee after deliberating the case at length the following decisions were taken:           I.            Export obligation period is extended upto 43 months from the date of issue of authorization i.e. upto 28.02.2013. The Authorization had the validity of 36 months.         II.            This is only for regularization and closure purpose.     III.            This is subject to a payment of composition fee @ 0.5% on FOB value of export made outside the original EOP and minimum value addition of 15% as prescribed under Para 4.1.6 of FTP.     IV.            Export made beyond 43 months shall not be accounted for.

V.            Shortfall, if any, shall be regularized in terms of Para 4.28 of HBP. (Action : RA Bangalore)

The committee noted that there is no issue of policy relaxation which needs clarification. The committee decided to transfer the matter to Policy­IV for clarification.

F.No. 01/60/162/388/AM14/EFGC (PRC) Subject: ­ Request for EOP extension of Advance Authorization No. 0310557902 dated 01.02.2010 issued under PC­9 condition for regularization purpose.   I. Export obligation period is extended from 12 months to 18 months from the date of first import consignment i.e. upto 31.08.2011.   II. This is only for regularization and closure purpose. III. This is subject to a payment of composition fee @ 0.5% of FOB value of export made outside the original EOP and minimum value addition of 15% as prescribed under para 4.1.6 of FTP. IV. The applicant has to pay duty +interest on inputs consumed and exported after 18 months from date of first import. The committee noted that Condition No. 14 for Textile Products disallow issuance of Authorization under SION J288 for Silk fabrics.  However, the Authorisation has been issued inadvertently under the said SION.  The Committee, therefore, decided to allow conversion of Authorisation from SION to non­SION and accordingly NC will fix norms for regularization of the case.

The committee considered and granted approval for relaxation of the provisions of policy condition of Para 2 (ii) (a), (b) and (c) of  Import Licensing of Chapter 87 of ITC(HS) for import of the Tractors/Trailers mentioned at Para 6 (1) subject to the conditions they would not ply on public road  except at the time of mobilization and de­mobilization and that the equipment would be used only inside the project premises and the same will be re­exported within three months from the completion of Project.

F.No. 01/60/162/436/AM14/EFGC (PRC) Subject: ­ Request for condonation  of non mentioning the details of Advance Authorization No. 0510213821 dated 20.12.2007 on ARE­3 Form for supplies against CT­3 Form to EOUs for the purpose of counting supply for fulfillment of export obligation.   The committee deliberated the case at length and noted that  Authoristion details were neither mentioned on ARE­3  nor on invoices which are mandatory documents that prove supply of goods to EOU towards discharge of export obligation. Hence the request is rejected. The applicant is hereby directed to get their case regularized in terms of Para 4.28 of HBP.    (Action: RA CLA New Delhi. If the party fails to get the case regularized in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT (D&R) Act. 1992 and submit an Action Taken Report).

PRC has no jurisdiction to waive customs duty and interest as the same falls under the purview of Customs Act.  Since the authorization no. or file no. has not been mentioned either on shipping bill or customs attested invoices, the same export cannot be accounted for discharge of export obligation against Advance Authorization.  The applicant is therefore advised to get the case regularized in terms of Para 4.28 of HBP or under Public Notice 22 dated 12.08.2013.   (Action: RA CLA New Delhi. If the party fails to get the case regularized in terms of Para 4.28 of HBP of Public Notice 22 dated 12.08.2013 within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT (D&R) Act. 1992 and submit an Action Taken Report).

The  committee  deliberated  the  case  at  length  and  decided  to  reject  the  request  as  both  the  authorizations  are  issued  under  different  Custom Notifications and conditions, hence cannot be clubbed.

F. No. 01/60/162/442/AM14/EFGC (PRC) Subject: ­ Request condonation of delay in filling of an application against Invalidation Letter issued under Advance Authorization No. 1110022833 dated 21.07.2010 for obtaining AA for supply of intermediate goods.   The committee noted that application for Advance Authorization was filed on 31.01.2013 against the Invalidation Letter dt. 7.1.2013 issued under Advance  Authorization  No.  1110022833  dated  21.07.2010.    The  validity  of  Invalidation  letter  is  co­terminus  with  the  validity  of  Advance Authorization under which the Invalidation letter is issued.  Since validity of Advance Authorization itself expired on 31.01.2013, the issuance of Advance Authorization against the expired invalidation letter would be irregular Hence the Committee did not accede to the request

The committee deliberated the case at length and noted that under Rule 30(3) of SEZ Rules, supply of goods to SEZ unit must be against Bill of exports if supplier want to avail benefits/incentive under FTP. Hence the request is rejected. The applicant is hereby directed to get their case regularized in terms of Para 4.28 of HBP.    (Action: RA Bhopal. If the party fails to get the case regularized in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT (D&R) Act. 1992 and submit an Action Taken Report).

Subject: ­ Request for relaxation for the grant of Chapter­3 benefit/incentives under Focus Market Scheme.

The Committee noted that exports made by the applicant under FMS destined to Uzbekistan via Iran and Turkmenistan by ship, Trailers and then Train.  Therefore, it took more than 3 years time in getting landing Certificate which required for obtaining benefits under FMS.  The Committee also noted that the applicant was not in a position to submit any other six prescribed documents in terms of Para 3.8.3 for claiming benefits under the scheme.  The landing certificate they received only on 6.5.2011 and applications for claim were made on 31.05.2011 i.e. immediately on receipt of certificate.  Considering genuine hardship in getting landing certificate from various Authorities of these countries, the Committee decided to relax the provision of Para 9.3 of HBP and allowed claim which 10% late cut.

The  Committee  noted  that  the  applicant  obtained  Authorization  with  AU  condition  therefore  he  should  have  imported  goods  permitted  under Authorization.  The name of Co­Authorization holder is endorsed after fulfillment of export obligation that defeats the very purpose of Actual User Condition.  The Committee therefore did not accede to the request.
