Minutes of the Policy Relaxation Committee Meeting no. 20/AM14 held on 10.09.2013 at 11.30 A.M. PRC Meeting was held under the Chairmanship of DGFT. F.No. 01/60/162/913/AM12/EFGC (PRC) PRC Meeting No. 20/AM14 dated 10.09.2013 Subject: Request for EOP extension of Advance Authorization No. 0410098492 dated 10.09.2008 upto 48 months for regularization purpose. The committee deliberated the case at length and noted that the firm has made exports to the tune of 17.23% within the validity of the authorization and 60% exports out side the export validity and that is too under drawback scheme. As per drawback procedure, refund is made under Automatic route within 5 working day from the date of shipment and no separate application is required for that. Hence the request of the firm to account for the export made under drawback scheme cannot be acceded to. The applicant is hereby directed to get their case regularized in terms of Para 4.28 of HBP. If the party fails to get the case regularized in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT (D&R) Act. 1992 and submit an Action Taken Report).

The Committee observed that the applicant had approached PRC earlier with the request for EOP extension, however, the Committee in its Meeting NO. 02/AM14 dt. 09.04.2013 rejected the request on the ground of less than 50% exports made within original EO Period. Now, the applicant after completing the EO has approached the Committee again for EOP extension for regularization purpose. The Committee after deliberating the case at length the following decisions were taken: I. Export obligation period is extended upto 43 months from the date of issue of authorization i.e. upto 28.02.2013. The Authorization had the validity of 36 months. II. This is only for regularization and closure purpose. III. This is subject to a payment of composition fee @ 0.5% on FOB value of export made outside the original EOP and minimum value addition of 15% as prescribed under Para 4.1.6 of FTP. IV. Export made beyond 43 months shall not be accounted for.

Subject: Request for relaxation for the grant of Chapter3 benefit/incentives under Focus Market Scheme.
The Committee noted that exports made by the applicant under FMS destined to Uzbekistan via Iran and Turkmenistan by ship, Trailers and then Train. Therefore, it took more than 3 years time in getting landing Certificate which required for obtaining benefits under FMS. The Committee also noted that the applicant was not in a position to submit any other six prescribed documents in terms of Para 3.8.3 for claiming benefits under the scheme. The landing certificate they received only on 6.5.2011 and applications for claim were made on 31.05.2011 i.e. immediately on receipt of certificate. Considering genuine hardship in getting landing certificate from various Authorities of these countries, the Committee decided to relax the provision of Para 9.3 of HBP and allowed claim which 10% late cut.
