Subject: EUC RELAXATION AND POST REPORT OF SHIPMENTS ANNUALY

4 Applicant's Statement: Cisco Systems Inc. respectfully requests relaxation of the conditions under Para 10.15(11) of the Handbook of Procedure 2023, as detailed in the attached Letter of Explanation dated November 19, 2025. Cisco manufacturing partner in India, Flex, supports global exports of Cisco products classified under SCOMET Category 8A502, with distribution involving a multi-country, multi-party supply chain. Exported items are distributed to ultimate end-users through a network of Cisco partners, resellers, regional distributors, and retailers. Each product may be re- transferred multiple times before reaching the ultimate end-user. This dynamic, multi- tiered structure is typical for the telecom sector mass market products and makes it operationally unfeasible to track and collect end user certificates (EUCs) from every ultimate end-user through thousands of intermediaries. The administrative burden would be immense for both Cisco and DGFT. Cisco and Flex maintain robust expert compliance and transaction screening programs to ensure adherence to Indian and international export control laws, with all intermediaries aware of their obligations to prevent diversion to prohibited uses or end-users. We request: (1) acceptance of EUCs from initial Cisco consignees as sufficient; (2) annual, rather than quarterly, export reporting.

Applicant Statement: Due to unforeseen international trade restrictions and tariff revisions imposed by the United States Government, our committed exports to the US market could not be executed within the prescribed time period. These sudden tariff rule changes disrupted our confirmed orders, as our buyers either withheld or delayed shipments until tariff-related issues were resolved. Since the majority of our Advance Authorization exports were targeted towards the US market, this regulatory change was beyond our control and directly impacted our export performance. Despite our best efforts to explore alternate markets, we could not achieve the required volumes within the stipulated period. Please note that due to slow demand of the resultant product in foreign market we have been unable to fulfil balance export obligation of 60.43%. i.e. (18846205 Number) However, we have confirmed export orders in hand now which are planned for execution in coming months. 22/02/2019, 310829813 dated 20/06/2019, 310831602 dated 17/09/2019, 310831780 dated 25/09/2019, 310833623 dated 23/12/2019, 310836832 dated 23/06/2020, 310837126 dated 10/07/2020 AND 310839206 dated 28/10/2020. Applicant Statement: Around and during COVID period, due to changes in staff in both the departments, viz., Marketing and Export Documentation, despite having 8 active advance authorisations of various products, export shipments got cleared under draw back. ? Immediately after lockdown, we approached various customs ports, from where the shipment had happened, for conversion of Shipping Bills from Draw Back to Advance Authorisation. Our request dated 12/05/2021, at JNPT was rejected on the ground that application for amendment should have been done within 3 months of LEO Date. Rejection was communicated on 30/11/2021. Aggrieved by the rejection we filed Write petition no 804 of 2022 in Hon'ble High Court of Judicature of Mumbai. After Hon'ble High Court of Judicature of Mumbai's decision, the Commissioner of Customs re-examine the matter without invoking the time limitation as stipulated in Board's Circular and rejected the application vide order dated 22/08/2022.

Aggrieved by the rejection we applied before Hon'ble CESTAT, which set aside the order passed by the Commissioner of Customs, JNPT and directed to consider our application without considering the benefits that may flow to us and to strictly adhering to the judicial determinations as set out in several decisions. Meanwhile we returned all the Draw Back benefits before applying to CESTAT. The Commissioner of Customs, JNPT, again rejected our application based on Regulations of 2025. We are in the process of analyzing the Order and shall take decision on further appealing to higher authority. MEANWHILE, if we are of the opinion that if we could get EOP extension from DGFT, we can export under the license and meet the obligation. This will help us avoid duty and interest cost as it's very tough to stand in international market with avoidable costs. Request: Kindly grant us EOP extension till 31/07/2026 and oblige. Decision: The Committee went through the statements made by the firm and noted that the applicant has not submitted any cogent reason! justification in support of any genuine hardship faced by them. Accordingly, the Committee decided to reject the request. (Action: Applicant)
