It was therefore decided to revalidate the advance licence No. 0310330384 dt.17.5.2005 for a period of six months from the date of endorsement on the licence subject to payment of composition fee @ 1% of the unutilized cif value of the licence and also subject to verification by RA of EO fulfillment status as claimed by the firm within valid EO period. 11 The Committee noted that the following decision was taken by Grievance Redressal Committee in Department of Commerce in its meeting held on 28.3.07 :
“The Committee gave a patient hearing to the petitioner and noted that the Committee in its meetig held on 26.9.05, after appreciating all the relevant facts, had advised DGFT to extend the period of export obligation by 12 months from the date of endorsement in relaxation of the policy subject to the petitioner depositing Rs.2.00 Lakhs per month in a separate reserve account under DGFT and thereafter to remove the name of the Director(s)/Companies from the defaulter list. Further, the Committee had arrived at the decision after noting that a substantial part of the export obligation has been completed and the petitioner is ready to fulfill the remaining export obligation within the extended period, if allowed. The Committee, having regard to the fact that there is no change in the material facts of the case, directed DGFT to implement the decision taken by the Committee earlier, without any further delay.”
It was noted that the said decision of GRC has already been implemented by the concerned division of DGFT with DG’s approval on file. It was, therefore, decided to accord ex-post facto approval to the above decision of GRC.

advance authorisation No.0310110641 dt.19.11.2001.
The Committee noted that the following decision was taken by Grievance Redressal Committee in Deptt. of Commerce in its meeting held on 4.7.07 :
“The Committee gave patient hearing to the petitioner and noted that the petitioner has now discharge export obligation despite the fact that the initial orders were cancelled by their foreign buyer due to crashing of prices in Russia. Further, the imports made against advance licence seemed to have been utilised for the export product as the petitioner produced the cover of injection manufactured out of the duty free imports which was in Russian language and had since expired. Moreover, Grievance Committee of DGFT
12 had also noted that the petitioner had a certificate from Central Excise Authority to the effect that the finished product was still lying in the firm’s premises. The Committee appreciated the hardships under which the petitioner discharged export obligation and therefore, directed the DGFT to take into account the exports already made by the exporter and to extend the export obligation period to that extent for redemption of the advance licence, without unduly burdening the exporter with composition fee which may be applied notionally in this case”.
It was further noted that the said decision of GRC has already been implemented with DG’s approval on file. The Committee decided to accod ex- post facto approval to the above decision of GRC.
