Case No. 1:  M/s Cito Chem Industries Pvt. Ltd., Indore.

File No. 01/60/162/1597/AM11/EFGC(PRC) PRC Meeting No.  12/AM11 dated: 26.11.2010 Subject: EOP extension of advance authorization no. 1110021071 dt. 18.09.2009 issued under Policy Circular No. 9 dated 30.06.2003.   The Committee noted that the export obligation fulfilled in respect of aforesaid Advance authorization was about 30% both Qty.­wise and value­wise within 6 months from the date of 1st import i.e. 06.10.2009.  The Committee noted that advance authorization was issued on 18.09.2009 after the Public Notice No. 2 dt. 27.08.2009.  It was therefore, decided to extend EOP, against the aforesaid advance authorization, for a period of six months from the initial valid EOP of 05.04.2010 and thereby making total EOP as 12 months i.e. up to 4.10.2010 from the date of 1st import i.e. 06.10.2009, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP, verification of all conditions of PC­9 and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond the export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorization and not just on the unutilized CIF.

  The Committee discussed the case and decided to defer for re­examination especially to verify the basis of extensions already granted by RA and export obligation fulfilled during the earlier EOP and the extended EOP.    

Case No. 6:  M/s Intas Pharmaceutical Ltd., Ahmedabad.

File No. 01/94/180/227/AM11/PC­4 Subject: Seeking clarification whether the approval of Policy Relaxation Committee is required, for utilization of inputs imported under PC N. 9/2003 outside export obligation period, under same licence or to an alternate exporter even after payment of duty.   The Committee considered the request of the firm and noted that it was not a case of Policy Relaxation.  The case needs to be strictly considered in accordance with the specific provisions of Policy Circular no. 9 dated 30.06.2003 and Policy Circular No. 18 dated 30.10.2007.

Subject: Clarification on composition fee for revalidation.

  The Committee reiterated that in cases of clubbing composition fee @5% to be levied for EOP extension per year and also a composition fee @1% of the unutilized cif value to be levied for revalidation as already decided in the PRC meeting held on 06.01.2010.    

Case No. 19:  M/s Hetero Labs Ltd., Hyderabad

File No. 01/60/162/1574/AM11/EFGC (PRC) Subject: Request for revalidation of advance authorization no. 0910021559 dt. 18.01.2005 and for its clubbing with advance authorization no. 0910018125 dt. 12.04.2004 for the purpose of regularization.   The Committee considered the request of the firm and decided to club advance authorization No. 0910021559 dt. 18.01.2005 and 0910018125 dt. 12.04.2004 for the purpose of regularization.  RA may revalidate advance authorization subject to payment of composition fee @1% of the unutilized Cif value of the authorization and also subject to verification of EO fulfillment status as claimed by the firm by RA. Extension in EO required for clubbing and regularization of authorizations where there is shortfall will be done by imposing a composition fee @5% per year as already decided in the PRC meeting held on 6.1.2010.  RA should ensure that PC­9 conditions (if it is so) are fully met for each authorization and only PC­9 authorizations should be clubbed. It is further clarified that in authorizations where there is violation of the conditions of PC­9, that will not be considered for clubbing and they need to be considered in accordance with the provisions of Policy Circular ­18 dated 30.10.2007.  Also in no circumstance, the total EOP (including extended period) should exceed 1 year (counted from date of 1st import) be considered for clubbing of Policy Circular No. 9 dated 30.06.2003.    

Case No. 20:  M/s Nagarjuna Construction Company Ltd., Hyderabad.

File No. 01/89/180/22/AM11/PC­2(A) Subject: Policy Relaxation for import of a left hand drive “off road refueling truck ATZ” form Russia import of which is otherwise covered under Para 7 of ILN.   The Committee considered the request and observed that the vehicle to be imported are the make of Tata / Layland.  It was not clear as to why they are importing Indian make LHD from Russia.  Further the utility and function of the vehicle need to be clearly understood.  The case is to be re­examined on file.    

Case No. 21:  M/s P.R. Overseas Delhi.

Subject: Request for extension of EO validity of advance authorization no. 0510172668 dt. 22.12.2005.

  The Committee noted that the firm have made a request for EOP extension of above mentioned advance authorization after the period of expiry of more than 1½ year from the date of expiry of EO period of authorization.  The Committee rejected the request of the firm as there are no merits for consideration due to highly delayed request.     

Case No. 22:  M/s Lyka BDR International Ltd., Mumbai.

File No.   01/60/162/1233/AM11/EFGC(PRC) PRC Meeting No.12/AM11 dated: 26.11.2010 Subject: Clubbing/redemption of LUT in advance authorization no. 0310393822 dt. 09.08.2006, 0310417936 dt. 01.02.2007 and 0310434069 dt. 27.06.2007.   The Committee considered the request of the firm and decided to club advance authorizations no. 0310393822 dt. 09.08.2006, 0310417936 dt. 01.02.2007 and 0310434069 dt. 27.06.2007 for the purpose of regularization.  A composition fee @1% of the unutilized cif value to be levied for revalidation of the required advance authorization for the purpose of clubbing over and above the clubbing fee. Extension in EO required for clubbing and regularization of authorization where there is shortfall will be done by imposing a composition fee @5% per year as already decided in the PRC meeting held on 6.1.2010. RA is directed to examine the case in terms of Public Notice No. 23 dated 4.12.2009 and take necessary action and make necessary endorsements at the time of revalidation. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorization and not just on the unutilized CIF.    

Case No. 23:  M/s Alps Industries Ltd., Ghaziabad.

Subject:  EOP extension of advance authorization no. 0510210285 dt. 10.10.2007.

  The Committee noted that the export obligation fulfilled in respect of aforesaid Advance authorization was more than 50% both Qty.­wise and value­wise within the valid EO period.  Therefore, the Committee decided to extend EOP against the aforesaid advance authorization for a period of six months from the date of communication of the decision of PRC, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP, subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make  necessary  endorsements  regarding  value  addition  of  minimum  15%  or  as  stipulated  in  the  authorization  whichever  is  higher.  The  15%  value  addition  for  evaluating entitlement is to be applied on the entire FOB and CIF of the authorization and not just on the unutilized CIF.

  The Committee noted the firm’s request for clubbing and decided to reject the same as the import items of both the advance authorizations are different and therefore, can not be considered for clubbing.

Case No. 28:  M/s Imperial Auto Industries Ltd., Faridabad

Subject: EOP extension of advance authorization no. 0510209778 dt. 28.09.2007.

  The Committee noted that the export obligation fulfilled in respect of aforesaid Advance authorization was more than 50% both Qty.­wise and value­wise within the valid EO period.  Therefore, the Committee decided to extend EOP against the aforesaid advance authorization for a period of six months from the date of communication of the decision of PRC, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP, subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make  necessary  endorsements  regarding  value  addition  of  minimum  15%  or  as  stipulated  in  the  authorization  whichever  is  higher.  The  15%  value  addition  for  evaluating entitlement is to be applied on the entire FOB and CIF of the authorization and not just on the unutilized CIF.

    The Committee noted the request of the firm and decided to reject as the reasons given by the firm are not cogent and justified.

  The Committee noted that the firm have made a request for EOP extension of above mentioned advance authorization after the period of expiry of more than 1½ year from the date of expiry of EO period of authorization.  The Committee rejected the request of the firm as there are no merits for consideration due to highly delayed request.     

Case No. 34:  M/s Ravi Foods Pvt. Ltd., Hyderabad.

File No. 01/60/162/1651/AM11/EFGC(PRC) Subject: Revalidation of DFIA no. 0910032967 dt. 13.02.2008.   The Committee noted that above mentioned DFIA has already endorsed as transferable. The Committee therefore rejected the request of the firm.    

Case No. 35:  M/s Ajanta Pharma Ltd., Mumbai.

    The Committee noted that the firm have made a request for EOP extension of above mentioned advance authorization after the period of expiry of more than 1½ year from the date of expiry of EO period of authorization.  The Committee rejected the request of the firm as there are no merits for consideration due to highly delayed request.     

Case No. 36:  M/s Ranbaxy Laboratories Ltd., Gurgaon.

File No. 01/60/162/1637/AM11/EFGC(PRC) Subject:  Request  for  EOP  extension  of  advance  authorization  no.  0510084975  dt.  01.04.2003  and  0510119114  dt.  25.02.2004  for  the  purpose  of  clubbing  with  advance authorization nos. i.                                          0510179899 dt. 31.03.2006 ii.   0510198472 dt. 25.06.2007   The Committee noted that the firm have made a request for clubbing in respect of advance authorizations no. 0510084975 dt. 01.04.2003 and 0510119114 dt. 25.02.2004 after a period of more than 4 years after expiry of EOP of authorizations  and decided to reject the request as there are no merits for consideration due to highly delayed request and also the items of both the advance authorizations no. 0510179899 dt. 31.03.2006 and 0510198472 dt. 25.06.2007 are different and can not be clubbed.    

Case No. 37:  M/s Madura Garments Exports, Bangalore.

Case No. 38:  M/s Vysali Pharmaceutical Ltd., Cochin.

Subject: Clubbing of 2 advance authorization nos. 1010024346 dt. 06.09.2006 & 1010026246 dt. 13.04.2007.

i. 0410091111 dt. 19.09.2007 ii. 0410089277 dt. 03.05.207 iii. 0410087265 dt. 01.02.2007   The Committee considered the request of the firm and decided to club advance authorizations nos. 0410091111 dt. 19.09.2007, 0410089277 dt. 03.05.2007 and 0410087265 dt. 01.02.2007 for the purpose of regularization.  RA may revalidate advance authorization subject to payment of composition fee @1% of the unutilized Cif value of the authorization and also subject to verification of EO fulfillment status as claimed by the firm by RA. Extension in EO required for clubbing and regularization of authorizations where there is shortfall will be done by imposing a composition fee @5% per year as already decided in the PRC meeting held on 6.1.2010.  RA should ensure that PC­9 conditions (if it is so) are fully met for each authorization and only PC­9 authorizations should be clubbed. It is further clarified that in authorizations where there is violation of the conditions of PC­9, that will not be considered for clubbing and they need to be considered in accordance with the provision of Policy Circular ­18 dated 30.10.2007.  Also in no circumstance, the total EOP (including extended period) should exceed 1 year (counted from date of 1st import) be considered for clubbing of Policy Circular No. 9 dated 30.06.2003.

File No. 01/60/162/1636/AM11/EFGC(PRC) Subject:  Request  for  EOP  extension  of  advance  authorization  no.  0510090799  dt.  23.05.2003  and  0510149515  dt.  24.01.2005  for  the  purpose  of  clubbing  with  advance authorization nos. i.                     0510179440 dt. 24.03.2006 ii.                   0510209543 dt. 26.09.2007 iii.                  0510216565 dt. 18.02.2008 iv.                 0510236806 dt. 19.02.2009   The Committee noted that the firm have made a request of advance authorization no. 0510090799 dt. 23.05.2003 for clubbing after the period of expiry of more than 4 years from the date of expiry of authorization.  The Committee rejected the request of the firm as there are no merits for consideration due to highly delayed request.   The Committee, however, considered the request of the firm for other Advance Authorization Nos. 0510149515 dt. 24.01.2005, 0510179440 dt. 24.03.2006, 0510209543 dt. 26.09.2007, 0510216565 dt. 18.02.2008 and 0510236806 dt. 19.02.2009 and decide to permit clubbing of these authorizations.  Composition fee @1% of the unutilized cif value to be levid for revalidation of the required advance authorization for the purpose of clubbing.   Extension in EO required for clubbing and regularization of authorization where there is shortfall will be done by imposing a composition fee @5% per year as already decided in the PRC meeting held on 6.1.2010. RA is directed to examine the case in terms of the Public Notice No. 23 dated 4.12.2009 and take necessary action and make necessary endorsements at the time of revalidation. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorization and not just on the unutilized CIF.

  The Committee deliberated in detail the case and decided that the actual decline in the exports during 2008­09 and 2009­10 of the Indian Hotel Company Ltd., due to destruction of the Heritage Wing of the Taj Mahal Hotel, Mumbai may be reduced in absolute terms to re­compute the annual average for all EPCG authorizations obtained during 2008­09 and 2009­10.  The Committee did not relax the specific export obligation for the EPCG authorization required to be fulfilled by the firm.
