Details of decision taken against individual cases :
Issue regarding payment of composition fee in case of revalidation of licence.
Before discussing the agenda for the PRC meeting dt.30.1.08, the above issue was
raised by concerned Jt.DGFTs who had attended the Open House recently held in
Mumbai by FIEO. With the permission of Chair, the issue was discussed in the
Committee and it was felt that the composition fee of 2% of unutilised cif value in
case of revalidation of licence is over-burdensome for the exporters who have
been pleading for relief in this regard in different fora. The, Committee decided
to reduce the composition fee from 2% to 1% on unutilised cif value in case of
revalidation of licence. However, it was decided to apply this reduced rate of
composition fee only to cases approved by PRC in this meeting and to future
cases. Thus, earlier cases of revalidation duly approved by PRC shall not be
reopened for this purpose.
Further it was discussed whether the basis of composition fee will change from
cif value of advance licence to duty saved amount. However, it was noted that
the problem in case of duty saved amount will arise as to duty at the time of
import or duty at the time of issue of licence etc. Hence, it was decided to
continue with the cif value rather than the duty saved amount as the basis of
composition fee.

The Committee noted that EO fulfilled in this case is 100% both qty. wise and
value wise, as claimed by the firm. It was therefore decided to revalidate the
advance licence No. 1010019989 dt.28.3.2005 for a period of six months from the
date of endorsement on the licence subject to payment of composition fee @ 1% of
the unutilized cif value of the licence and also subject to verification by RA of EO
fulfillment status as claimed by the firm.

It was therefore decided to revalidate the advance licence No. 5210016171 dt.11.1.2005 for a period of six months from the date of endorsement on the licence subject to payment of composition fee @ 1% of the unutilized cif value of the licence and also subject to verification by RA of EO fulfillment status as claimed by the firm.

The Committee noted that EO fulfilled in this case is 125% qty. wise and 73% value wise, as claimed by the firm. It was therefore decided to extend the EO period against advance licence No. 0310224074 dt.11.9.2003 for a period of six months from the date of endorsement on the licence subject to payment of composition fee @ 1% per month on the duty saved amount vis- a vis unfulfilled portion of EO and also subject to verification by RA of EO fulfillment status as claimed by the firm.

It was therefore decided to revalidate the advance licence No. 5210016401 dt.4.2.2005 for a period of six months from the the unutilized cif value of the licence and also subject to verification by RA of EO fulfillment status as claimed by the firm.

While the Committee approved the relaxation of the condition of Homologation, it was felt that such vehicles coming on the road should go for Homologation. Deptt. Of Road Transport and Highways may be advised to comply with this in future.

The Committee noted that EO fulfillment against licence Nos. (i) 0410057379 dt.21.5.04 (ii) 0410059734 dt.13.7.04 is 100% both in terms of qty. as well as value, as claimed by the firm. It was therefore decided to revalidate the advance licence No. (i) 0410057379 dt.21.5.04 (ii) 0410059734 dt.13.7.04 for a period of six months from the date of endorsement on the licence subject to payment of composition fee @ 1% of the unutilized cif value of the licence and also subject to verification by RA of EO fulfillment status within the validity period of licence, as claimed by the firm.
However, revalidation of licence No. 0410066944 dt.7.2.05 will be taken up by the Committee only on receipt of information as to actual exports performed, both value wise and qty-wise.

Subject: Request for grant of revalidation beyond 30 months of import licence
No.0350000985 dt.4.7.05 (24 months original validity and six months revalidation granted by Jt.DGFT, Mumbai upto 3.1.08) for further revalidation upto June, 2008.
The Committee felt that in respect of import licence for negative list items, there is no justification to keep such a long validity period for this licence. Therefore, it was decided to reject the request.

The Committee noted that EO fulfilled in this case is 100% both qty. wise and
advance licence No. 0310236757 dt.17.11.2003 for a period of six months from the
the unutilized cif value of the licence and also subject to verification by RA of EO
fulfillment status as claimed by the firm.

the unutilized cif value of the licence and also subject to verification by RA of EO
fulfillment status as claimed by the firm. However, Committee did not consider the
request for enhancement of advance licence made by the firm.

It was therefore decided to revalidate the advance licence No. 0810040138 dt.7.7.2004 for a period of six months from the date of endorsement on the licence subject to payment of composition fee @ 1% of the unutilized cif value of the licence and also subject to verification by RA of EO fulfillment status as claimed by the firm.

The Committee noted that the firm has fulfilled 74% of EO (qty. wise) and 100% (value wise) within the valid EO period as claimed by the firm. As 23 % of EO (Qty. wise) is outside the valid EO period, Committee decided to extend the EO period in respect of advance licence No. 0310058625 dt.25.10.2000 upto 24.7.04 only for regularization purpose subject to payment of composition fee @ 1% per month on the duty saved amount vis.-a-vis the export made after the valid EOP and also subject to verification by RA of EO fulfillment status within the valid EO period,as claimed by the firm.
