J Decision: The Committee considered the case as per agenda and observed that the firm have applied for fixation of norms under para 4.06 for export of Palm Stearin Methyl Ester (Bio diesel) and import item RBD Palm Sterin. As reported by RA, Hyderabad, the application has been rejected as the export-import falls under Para 4.11 of FTP (ineligible categories). The applicant had submitted that they have already made exports against the Licence without the norms. After verification with RA, Hyderabad, the Committee noted that the applicant had made exports of 4932.425 MT of Bio-Diesel vide Shipping Bill No.l494455 under EPCG Licence and NOT under any Advance Authorisation. 2. The Committee further noted that:- (i) First of ail under para 4.6 of FTP, export and import cannot be made without fixation of norms. So the export, if made, will be ultra-virus. (ii) For the sake of argument, even the principle of prior export is accepted, the applicant does not comply with this condition as per the RA report (export is under EPCG Licence and not under Advance Authorisation. Under the circumstances, Norms Committee decided that there is no need for fixation of norms in this case.
