  • Extension of EOP against Advance Authorisation No. 0511013889 dated 21/07/2022. Applicant Statement: The matter was taken up. The entire submission made by the applicant was gone through. The firm has stated as below: The Policy Relaxation Committee Office of the DGFT (Head Office) New Delhi Sub: Request for EO Extension against pending Export Sr.No.6 (Qty 3265 PCS) Ref: Advance Authorisation No. 0511013889 dated 2 1.07.2022 Dear Sir, We are a certified AEO T-2 holder and a Two-Star Manufacturer Exporter in the Readymade Garments sector, engaged in export business with Overseas Buyer?s for the past 22 years. We wish to

01/60/162/49/AM-26/PRC /1086/2026 submit that against the above-referred Advance Authorisation, we have already imported approximately 95% of the fabrics and completed 85% of exports. Exports against Export Sr. No. 1 to 5 have been completed 100%. We follow a strict policy of importing fabrics strictly as per our established export averages and confirm that we have never imported excess fabric beyond export requirements. At present, around 2500 workers are working with our factory, whose livelihoods depend entirely on the continuity of our export operations. The garment export sector is currently facing severe challenges, including intense competition and negligible profit margins. Additionally, the recent 50% tariff imposed by the USA has significantly affected exports to that market.

This is our first PRC request seeking EQ Extension under the said Advance Authorisation. 2. 100% export obligation has already been fulfilled for Export Sr. No. 1 to 5. 3. Due to fabric variation, our USA buyer (TJ Maxx) did not accept the shipment under Export Sr. No. 6, quantity 3265 Pieces. 4. We requested the buyer to accept the goods with a minor discount; however, due to the 50% tariff, shipment to the USA could not be executed. 5. We are presently in discussion with a new buyer in a Gulf country to export the 3265 Pieces, which will enable us to complete 100% Export Qbligation and avoid unnecessary customs duty liability. This is a genuine and unavoidable case, and we humbly request the Hon?ble Committee to kindly extend the EQ validity up to 28.02.2026 for Export Sr. No. 6 under the above Advance Authorisation so that we can save the custom duty or close the case from CLA, New Delhi. We shall be grateful for your kind consideration and approval. Decision:- The Committee examined the submission made by the applicant and discussed the matter at length.

fabric has ever been imported beyond export requirements. At present, around 2500 workers are working in our factory, whose livelihoods depend entirely on the continuity of our export operations. The garment export sector is presently facing severe challenges due to intense global competition, negligible profit margins, and the recent 50% tariff imposed by the USA, which has significantly impacted exports to that market. This is our first request before the PRC seeking EQ extension under the said Advance Authorisation. 2. Due to fabric variation, our USA buyer did not accept the shipment under Export Sr. No. 4 & 10 (15198 pieces). 3. We requested the buyer to accept the goods with a minor discount; however, due to the 50% tariff imposed by the USA and related commercial issues, the shipment could not be executed. 4. We are presently in advanced discussions with a new buyer in a Gulf Country for export of the pending pieces, which will enable us to complete 100% Export Obligation and avoid unnecessary big amount of customs duty liability. 5.

No. 0530146444 dated 18/06/2008. 4/-

01/60/162/49/AM-26/PRC /1086/2026 Respected Sir, Having reference to the subject above, this is to bring to your kind notice that in respect of the subject EPCG Authorization, the export obligation could not be fulfilled within the initial EOP, owing to financial crisis that began in 2008 - the negative impact for which went on in the following years too. The financial crisis started in the United States in 2007 - it was only when the crisis turned into a global economic recession that developing and emerging market economies were affected, mainly through the trade channel. In many developing countries, the economic consequences of these indirect effects were as severe as the direct effects were on developed countries. Thus and so, the export obligation corresponding to the subject Authorization could not be fulfilled, despite our prolong intense during the long passage of time of initial EOP, which went on up to 19.06.20 16. It is very pertinent point for your kind information that earlier on 01.12.2016, for the purpose of grant of Bock-wise Waiver from fulfilling the export obligation, we have already paid a sum of Rs.1,86,354.00 vide Pay Order No.825366 dated 21.10.2016 (Union Bank) as Composition Fee but the waiver has not been granted, as yet.

ulfilling the export obligation, we have already paid a sum of Rs.1,86,354.00 vide Pay Order No.825366 dated 21.10.2016 (Union Bank) as Composition Fee but the waiver has not been granted, as yet. (Forwarding letter, DGFT receipt & Payorder copy are enclosed for your reference) However, beyond the expiry of the initial EOP, we had been able to identify the appropriate market niche and started offsetting the export obligation. his movement of exports were a bit slow and steady and completed only on 11.01.2024. Thus, it is also a fact that we have been so serious about redemption of the export obligation that the procedural formalities of seeking extension of the EOP had indeed escaped our attention. Accordingly, albeit the EO stands fulfilled, but the exports are outside the EOP, which now needs to be regularized in terms of the provision of Public Notice No.53 dated 25.07.2024. In this contexture, the following information in respect of the life-cycle of the Authorization is given below for your kind perusal :- Sl.No. Description of the event Occurred On 1 EPCG Authorization obtained on 18.06.2008 2 Expiry of the initial EOP (6+2 Yrs.) 18.06.2016 3 Required export obligation stands fulfilled where exports effected during the period of 15.11.2016 to 11.01.2024 4 Extension of EOP required in terms of PN No.53 dated 25.07.2024 is required for the period of 18.06.2016 to 11.01.2024 395 weeks This is further for your consideration that at the time of issuance of the Authorization, the export products were restricted to ITC HS Cr.

ired for the period of 18.06.2016 to 11.01.2024 395 weeks This is further for your consideration that at the time of issuance of the Authorization, the export products were restricted to ITC HS Cr. 85 only, which at the time of export could not be adhered to. Nonetheless, the export products pertained to Gr. Code '84' which in fact were the produce of the same Capital Goods (Food Processing Machineries. This issue also may kindly be considered with a lenient view while granting the request of extension of EOP. In the light of above, this is to pray to your kind consideration for extension of the export obligation period for a period of 395 weeks (beyond the initial EOP) in terms of Public Notice No. 53 dated 25.07.2024, or otherwise considering our genuine hardship because of the economic slowdown on 2008 onwards, for not being able to fulfil the export obligation inside the initial EOP, as above. It is further significant to mention that the extension of export obligation is required as above, only for the purpose of regularization I redemption of the Authorization - since the export obligation has already been fulfilled and due realization has also been made through
