Subject: Revalidation of Authorization/certificate against Advance Authorization No.

5611000954 dated 29.12.2022. This is a deferred case of PRC Meeting No.30AM25 held on 04.04.2025 (Case No.20). Applicant Statement: We invite your kind attention to the above referred meeting of the Policy Relaxation Committee of DGFT wherein our plea & request has been rejected on the ground that the applicant has not submitted any cogent reason ! justification in support of its request for revalidation of the above cited Advance Authorization. A copy of the said decision of PRC is enclosed herewith for your ready reference. Being aggrieved by the aforesaid decision of the PRC we are hereby

/ £ approaching your good again for rendering justice to understand circumstances of the case explained by us and reproduced here under once again. If the committee did not found the facts to be genuine then should inform us what probable reasons they expect & will consider to be genuine that a business should suffer to request for revalidation. Sir, vide our application to the PRC for revalidation of the license we had informed the genuine hardship faced by us which is as under: We had taken the above referred Advance Authorization for import of (1) Polypropylene (2) UV Stabilizer to be used in manufacturing a product to be exported.

hardship faced by us which is as under: We had taken the above referred Advance Authorization for import of (1) Polypropylene (2) UV Stabilizer to be used in manufacturing a product to be exported. Since waiting for receipt of the UV Stabilizer from the foreign supplier prior to export would have resulted in failure of our executing the export order in time, loss of earning the foreign exchange for our country, and as there was no condition as regards to pre-import for the export to be done, we used other raw material from our stocks to fulfill export obligation under the above advance authorization, though the material consumed out of our stock was also the imported one which was imported by us on earlier occasion duly paying requisite import and other duties. The quantity of 50 MT of U V Stabilizer was remaining to be imported in the above captioned license, order for supply of which was placed by us on a foreign supplier for shipment to be affected within the validity of license i.e. before 30 April 2024. However, the foreign supplier could not supply balance quantity due to heavy breakdown in its processing line and this situation was completely beyond our control and was unforeseen by us. In support of this we had provided the following documents to PRC: 1) Copy of Offer of foreign supplier dated 06/01/2024 2) Copy of our Purchase Order dated 08/01/2024 3) Copy of the swift message dated 10/01/2024 for advance remittance affected for the above captioned import. 4) Copy of the letter dated.

06/01/2024 2) Copy of our Purchase Order dated 08/01/2024 3) Copy of the swift message dated 10/01/2024 for advance remittance affected for the above captioned import. 4) Copy of the letter dated. 20-04-2024 received from the foreign supplier expressing its inability on account of heavy breakdown in its processing line and informing that there will be further delay of 60-90 days on the orders booked. Under the circumstances explained above you will kindly agree with us that there has been no lapse on our part and we had no other option but to approach DGFT / PRC for granting us one time revalidation under the short duration of 90 days. However, PRC did not consider the above documentary evidences and the situation to be cogent and rejected our application. Sir, in case revalidation of the license is not considered the foreign exchange remittance made to the supplier will go down the drain and our country will lose valuable foreign exchange and compel us to close our small scale unit which we have built up brick by brick. We are sure the office of your goodselves will direct the PRC to revalidate the license as we are genuinely suffering due to the above unforeseen incidence took place at the place of our supplier which is absolutely beyond our control and therefore can be termed as force majeure condition for us. For your this act of kindness we shall be grateful to you forever as it will save not only the foreign exchange but safeguard bread and butter of the employees associated with our manufacturing unit.

r your this act of kindness we shall be grateful to you forever as it will save not only the foreign exchange but safeguard bread and butter of the employees associated with our manufacturing unit. Thanking you, Yours faithfully, For MasterPlast India Pvt Ltd. Authorized Signatory. Personal hearing: The firm was provided opportunity of personal hearing before the PRC as requested by them. During the personal hearing, Mr. Vijay Kumar, authorised representative stated that they fulfilled the Export Obligation using inputs available in its stock. But they had

placed an order the inputs amounting to 50 MT of UV Stabilizer with their foreign buyer when they had only 6 weeks of validity period and also made advance remittance to the foreign supplier; and that the supplier failed to dispatch the material within the validity period due to breakdown of the supplier's processing line. It was contended that the situation was beyond the applicant's control and amounted to force majeure, and that non-revalidation would cause severe financial hardship. Decision: The Committee has carefully considered the written submissions, the documents placed provided by the firm as well as the oral statements advanced during the personal hearing. It was observed that the applicant did not replenish its stock for corresponding export under the subject Authorization within the prescribed validity. The committee finds no cogent reason for relaxing the policy in this case and hence, the request for revalidation of the Advance Authorisation is rejected. Case No 19 M/s.

24/08/2016. The COVID-19 pandemic and subsequent worldwide lockdowns severely impacted our export operations. We faced multiple challenges, including: Inadequate foreign exchange earnings, Severe shortage and unavailability of containers, Skyrocketing ocean freight rates, and Cancellation of overseas orders due to shipment delays. Despite these challenges, we havd continued our efforts to fulfill the obligations. We had received an export order worth USD 328,000 (copy attached for your kind reference), but we could not fully execute the order due to delays in the import of raw materials and unforeseen circumstances. However, we managed to make a partial shipment on 21.08.2025, valued at USD 75,680, prior to the expiry of the license. Unfortunately, we were unable to dispatch the remaining consignment, which was ready for shipment, due to the sudden imposition of a 100% US Tariff, making the export commercially unviable. We also received a duty challan for USD 55,076 from our US Buyer (copy is attached for your reference). The unexpected tariff has caused us significant financial loss and has led to the temporary shutdown of our factory until the additional tariff is lifted. In light of the above, we respectfully request the Honorable Chairman and Members of the EPCG Committee to kindly consider granting us a two-years extension of the Export Obligation Period (EOP), i.e., up to 24.08.2027, to allow us to fulfill the balance export obligations.

The Ministry of Commerce and Industry has published data on trend of exports of Iron & Steel products (Chapter 72) which shows that there has been a sharp increase of exports in 2 years i.e., FY 2020-2 1 & FY 202 1-22 (COVID years) and this trend was reversed drastically in FY 2022-23 & FY 2023-24.

(Chapter 72) which shows that there has been a sharp increase of exports in 2 years i.e., FY 2020-2 1 & FY 202 1-22 (COVID years) and this trend was reversed drastically in FY 2022-23 & FY 2023-24. This reduction in subsequent years was on account of subdued economic sentiments globally, reduced demand from Europe & China, recessionary trends in Europe and to a certain extent in America, correction in the export price as compared to the COVID period, competitive price of exports from Korea and Japan, tightening of interest rates in western countries, geopolitical tension in Ukraine, West Asia and onset of dispute in Middle East. JSL has also faced a similar trend of first increase & then decline in exports. Due to sharp increase in exports in FY 2020-21 (172%) & FY 2021-22 (44%), the AEO for FY 2022-23, FY 2023-24 & FY 2024-25 has increased significantly. The AEO for FY 2022-23 has increased to Rs. 8130 cr straight from Rs. 3783 cr. in FY 2021-22 and AEO for FY 2023-24 is even more (at Rs. 9611 cr.) However, at the same time due to reduced exports (volume as well as price) it is getting difficult to maintain even AEO of the licenses taken in FY 2022-23 onwards. The provisions under para 5.17(a) of the HBP 2023 provide a framework for adjusting the AEO based on sectoral export declines. While the Circular No.

EO of the licenses taken in FY 2022-23 onwards. The provisions under para 5.17(a) of the HBP 2023 provide a framework for adjusting the AEO based on sectoral export declines. While the Circular No. 10/2023-2024 dated 22/02/2024 issued for FY 2022-23 will help us meet the export obligations and other license conditions for the said year, however the same % reduction in AEO for FY 2023-24 will not be helpful because the AEO of FY 2023-24 is much higher than FY 2022-23 and exports are on the declining side, as explained in the preceding paras. Considering the same, we request your good self that the AEO for the licenses obtained in FY 2023-2024 and 2024-25 may be reduced based on base year (FY 2021-22) so as to neutralize the effect of increase in exports during COVID. This will help our organization to meet the license conditions in a structured manner. Failure to grant the requested reduction in AEO will not only cause undue financial burden on JSL which may have undesired consequences on company plan for expansion and employment generation. Such an outcome would be detrimental not only to the company's workforce but also to the broader economy of the country. While filing the PRC application, we are required to provide

11/04/2014. With reference to the above, we would like to inform you that we have imported 04 AUTOMATIC SHUTLELESS RAPIER WEAVING MACHINES vide the EPCG licence from JT DGFT, PUNE . The said license was valid till 11.04.2020. We imported the capital goods under EPCG on 03.05.2014 considering very good export market. It took us some months to install the machinery and make it ready to weave. It took some more months to create perfect sample to the satisfaction of our overseas buyers , which were to be exported through a 3rd party exporter. The samples were accepted and we were about to manufacture on a large scale when lightning struck the market in the form of demonetization. The markets came to a standstill. It took a few months for the market to revive. During this time all our export orders were cancelled. We started to sell in the local market praying for the export markets to revive. The markets were just limping back when again the markets were upset by imposition of GST on 01.07.2017. This impacts of GST shutdown the markets for about 6 months with the traders protesting throughout India. Although the petitioner's export obligation under the EPCG Authorization was to be fulfilled within a period of 6 years, i.e., by 03.03.2022, it is an undisputed fact that both the Central and State Government has granted exemptions from time-bound obligations in all sectors either while counting the limitation period or fulfilling the obligations under the exemptions in light of the pandemic.
