Decision: -The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm have not given valid justification for seeking higher wastage in this case. Hence, it was decided to maintain the earlier decision taken by the NC.

M/s Lavino-Kapur Cottons Pvt. Ltd., Mumbai
PRO version F.NO.1/85/162/103/AM07-DES-VI Modification of SION, K-103 for Absorbent Cotton and K-104 for Absorbent Uncarded Cotton against import of raw cotton. Decision: -The Committee considered the case as per agenda alongwith other relevant papers and observed that this is regarding modification of SION, K-103 for Absorbent Cotton and K-104 for Absorbent uncarded cotton to allow 20% wastage of raw cotton and earlier considered by NC-6. It was observed that O/o TC, Mumbai after visit of technical study team to the unit of applicant firm had recommended 1.17 kgs/Kg in respect of Absorbent Cotton wool and 1.12 Kgs/Kg in respect of Absorbent uncarded cotton. It was noted that Norms Committee based on the above recommendations of TC, Mumbai had observed that above referred SIONs cannot be modified as the wastage norms recommended by TC, Mumbai is applied to M/s Lavino Kapur Cotton Pvt. Ltd. being a 100% EOU. till 31.03.2010 and for further application of these adhoc norms beyond 31.03.2010, TC, Mumbai may be requested to visit the unit in January, 2010 and submit a report. So far no such specific report has been received in the matter from TC, Mumbai office. Further, as regards date of applicability of this provision has not been specifically mentioned in the FTP provision, hence, Committee in consultation with the representatives of technical authorities present in the meeting decided to refer the case to BOA/Policy Division/Development Commissioner concerned for taking their suitable action in the matter.

Reference from Policy Division, PC-IV(B)- M/s Aditya Birla Nuvo Ltd. Kolkata. F.NO.1/84/162/251/AM10-DES-V Revision in DEPB rate under S.No. 37 38 of Textile Product Group.
PRO version this case has been referred by PC-IV(B) Section for seeking views of NC regarding revision of DEPB rate under S.No. 37 & 38 of Textile Product group. The details submitted by Wool Industry Export Promotion Council with regard to wool blended yarn containing wool & nylon (dyed) and wool blended yarn containing wool & nylon (grey) were gone through. The Committee observed that council has not given the average details of both the items separately so that basis of calculation can be worked out for re-fixation of DEPB rate. In view of this Committee decided to call for the same data from Wool Industry Export Promotion Council and defer the case for re-listing on 08.10.2009.
