The Meeting No. 44/AM-09 for the licensing year 2008-09 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 29.01.2009 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting No. 36/AM09 dated 04.12.2008, Meeting No. 37/AM09 dated 11.12.2008, Meeting No. 38/AM09 dated 18.12.2008, Meeting No. 39/AM09 dated 25.12.2008 and Meeting No. 40/AM09 dated 01.01.2009 were ratified. Thereafter, Agenda for individual cases for Meeting No. 44/AM09 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Manual agenda cases

Ltd., Kanpur NC 44/09 dt. 29.01.2009 F.No. 01/84/50/364/AM-09/DES-V Ratification of input output norms against Advance Authorization No. 0610014514 dated 03.11.2008 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the width of webbing has not been exactly specified i.e 10MM to 102MM is very wide range, which cannot be permitted. Further, thickness of webbing has been given 0.75” to 0.250”, which itself is a very wide variation, hence cannot be allowed. In view of this Committee decided to maintain status quo in this case. R.A may be advised to call back the A/A for amendment as per observation of NC. They may not issue any such A/A of such wide range of width and thickness in future. Firm may be informed accordingly.

Decision: The Committee considered the case as per agenda and perused the report submitted by the team, who visited the unit of the firm. The Committee after detailed deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case as detailed below: - Export item Import item Qty. allowed Textile fabrics with Pyrovatex fire retardant finish Pyrovatex (R) CP New (90-95% solid content) @ 288 grms per Kg content of the export product. As regards firm’s request for fixation of SION for this product, Committee decided to advise the firm to process their proposal through their Export Promotion Council, who will send Industry data of last three years of 4-5 different firms engaged in the same manufacturing process for further consideration.
The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Decision: The Committee considered the case as per agenda in consultation with the representatives of technical authorities present in the meeting decided to remind applicant firm to comply with DC (MSME) instructions regarding supply of information/documents under intimation to DGFT for further consideration and defer the case for re-listing on 12.03.2009.

Decision: The Committee considered the case as per agenda and perused the R.A letter dated 17.11.2008 as well as revised written comments of TC, Mumbai conveyed vide letter dated 13.02.2008 and observed that there was indeed a typographical error in respect of Qty. of import item No. 2 mentioned in the minutes of NC meeting held on 04.09.2008. In view of this Committee in consultation with the representatives of technical authorities present in the meeting decided that in respect of import item No.2 Qty. may be allowed 0.342 Sq mtrs/Pc instead of 34.2 Sq mtrs/Pc as per revised comments of TC, Mumbai vide their letter dated 13.02.2008.
The R.A shall be advised to take necessary action subject to compliance of other usual conditions.
