Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that advance licence in question is of the year 2003 and the relevant Public Notice No. 42(RE: 2008)/2004-2009 dated 4th July, 2008 permitting Furnace Oil has been issued in the year 2008. Hence, in this case Furnace Oil cannot be allowed. Hence, Committee was constrained to reject the request of the firm. Firm may be informed accordingly.

Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case as detailed below: - (i) Item of import at S.No. 1 i.e Acrylic fibre 1-3 Denier may be allowed as applied by the firm; (ii) Item of import at S.No. 2 and 3 i.e Dyes and Chemicals may be allowed to 14% of FOB value within the overall CIF value of the licence in terms of General Note for Textiles at S.No.5.

M/s Apparel Merchandising Co., New Delhi F.NO.1/84/50./382/AM07/DES-V 0510194396 dated 14.11.2006. under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Hemant Sangal, an authorized representative of the firm, who appeared for personal hearing in this case. He explained the case alongwith relevant details and mentioned that in this case firm had imported total 961 Kgs of Lace of two different sizes and exported the same in the garments with total accounting for 756 Kgs of net weight of Lace on export side. In view of this technical team of the Committee felt that the use of Lace in garment does not entail any significant process wastage, whereas applicant have asked for 6% wastage. Hence, Committee after detailed deliberations observed that taking into reasonable wastage 813.6 Kgs of relevant Lace may be allowed in this case and the balance Qty. of excess import may be regularized as per relevant Policy Provision. It was also decided to delete the condition of size-wise specification mentioned on export item description in the minutes of ALC meeting held on 15.02.2007.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that case is under examination of DC(MSME). It was decided to defer the case for re-listing on 15.01.2009. Outside Agenda Case No. 1 M/s Modelama Exports Ltd., Gurgaon F.NO.1/84/162/528/AM09/DES-V Request for inclusion of Security Tags (RF HARDTAG) in Target Plus Licence No. 0510225628, 0510225629, 0510225630, 0510225631, dated 18.08.2008 issued against export readymade garments and Textile made-ups. Decision: The Committee considered this case as per agenda and observed that Security Tags are used in the garment for the purpose of security specially for preventing theft and pilferage. It was therefore felt that security Tags are an essential part of garments for security reasons. In view of this Committee in consultation with representatives of technical authorities present in the meeting observed that nexus of Security Tags with garments is established in this case. It was therefore decided to clarify the firm as well as R.A accordingly.
Case No. 2 M/s Jay Shree Textiles (a unit of M/s. Aditya Birla Nuvo Ltd.) NC 38/09 dt.18.12.2008 F.NO.1/84/162/137/AM09/DES-V Fixation of standard input output norms for Auto cone spliced flax/linen yarn Decision: The Committee considered this case as per agenda and observed that M/s Aditya Birla Nuvo Ltd. is a single Company in India engaged in the export of Flax/Linen yarn (Auto cone spliced). In view of this Committee in consultation with representatives of technical authorities present in the meeting was of the view that a Public Notice may be issued for fixation of standard input output norms (SION) for Auto cone spliced flax/linen yarn as per decision taken by NC-V in its meeting held on 27.11.2008 with the approval of DG.
