Committee further observed that there are three advance licences bearing Nos.0910007290 dated 12.09.2001, 0910011975 dated 11.11.2002 and 0910014608 dated 06.06.2003 issued to the firm for the export product Clarithromycin (Non‐infringing process‐CLX Route). ALC considered the case for fixation of ad‐hoc norms in respect of Annual Advance Licence No. 0910007290 dated 12.9.2001 issued to M/s Medicorp Technologies Inds. Ltd. The Committee took note of the following written comments of PI Division (now DOP) conveyed vide their U.O. dated 21.2.2003:‐ “ for allowing higher quantity of inputs there are no means to verify about the characteristics of export product; how it is different from the USP grade products and also whether the claimed non‐infringement process has been patented or not and whether such higher requirements of raw materials are justified”. The Committee held on 30.4.2003 taking note of above comments and a䬀er detailed deliberations decided to allow inputs based on Central Excise data for the period from 1.4.2001 to 28.2.2003 as under:‐ Export product Export Qty. The Committee was informaed that the norms against advance licence dated 11.11.2002 were fixed by ALC No.48/2004 held on 31.3.2004 wherein the firm’s representative who had appeared before the Committee explained that they had made the exports to the developed countries and realized higher fob price and non‐ infringing process has been reflected in the shipping bills. The Committee a䬀er hearing the representative of the
firm and in light of Certificate furnished by them from Central Excise, Pithampur, certifying the total consumption of raw material for the period 01.03.2003 to 15.09.2003 indicating that Clarithromycin non‐infringing process (CLX‐ Route) is being manufactured by M/S Biotech Synergy Ltd. exclusively for M/S Matrix Lab. Ltd, decided to allow the same quan奱�奱�es of input items given earlier against Annual Advance Licence dated 12.09.2001 considering the explanation given regarding reflection of non‐infringing process decided to allow the above inputs under para 4.7 of Hand Book of Procedures for regularization purpose. While allowing the quantity of inputs against this licence the Committee had taken into onsideration the comments of PI Division conveyed vide their U.O. dated 21.2.2003, referred to above. The firm has made representation against the decision of NC and have furnished the Central Excise data for the period 01.03.2003 to 15.09.2003 in respect of M/s Biotech Synergy Ltd. stated to be supporting manufacturer of the firm, which refers to the period of advance licence dated 11.11.2002 and which has already been considered by the ALC No. 48/2004 held on 31.3.2004 while fixing Ad‐hoc Norms in respect of Annual Advance Licence dated 11.11.2002. The firm has also clarified that though the consumption norms remain the same, the data given in the first Excise Certificate was lower because some indigenous materials were also used which were not reflected while fixing norms. The Excise data for the period 01.03.2003 to 15.09.2003 is based on the entire import quantity consumed in the process for the manufacture of Clarithromycin‐CLX Route which was exported to USA. The Committee observed that the decision taken in respect of Annual Advance Licence dated 12.9.2001 was based on the consumption data supplied by the firm for the period from 1.4.2001 to 28.2.2003 and in subsequent meeting held on 31.3.2004, the consumption data supplied by the firm for the period from 1.3.2003 to 15.9.2003 was taken into consideration by the ALC and it was decided to allow inputs as had been allowed by the Committee in respect of Annual Advance Licence dated 12.9.2001 on repeat basis. Committee perused the Production and Consumption data submitted by the firm for the period from 1.3.2003 to 15.9.2003 and observed that the quantity of items of import at S.Nos. 2to 4 are at a variance as compared to the data furnished by the firm earlier at the 奱�me of fixation of ad‐hoc norms for AAL dated 12.9.2001. In view of above Committee decided to call for the following documents/information for further consideration of cases pertaining to licences dated 11.11.2002 and 6.6.2003:‐ (a) Complete set of applications with licence details in respect of three licences mentioned above alongwith amendment sheets if any, (b) Detailed report in respect of all the three Licences pertaining to import/export. Whether there is evidence of shipment having been made under non‐infringing process. (c) Date of conversion from DTA to EOU and details of raw material and licences as on date of conversion. The case to be placed before the Committee on receipt of above information from firm/RA.
