Para 4.7 Decision

MEETING NUMBER : 3/82‐ALC4/2008 MEETING DATE : 15.04.2008   The Meeting No.03/09 in the year 2008‐09 to consider the cases under Duty Exemption Scheme (Chapter‐4) of Foreign Trade Policy, 2004‐09 pertaining to products falling in Chapter 29 and 30 due for 15.04.2008 was actually held on 22.04.2008  under the Chairmanship of Export Commissioner, Shri Sanjay Rastogi as Export Commissioner was on leave on 15.04.2008.   Following members were present:‐ 1.        Shri D.N. Mathur, Dy. IA, PI Division, C & PC. 2.       Dr. Arun Kumar, AD, Department of MSME 3.       Shri Rajinder Pal Singh, Dy. DGFT. 4.       Shri Shyam Lal, FTDO   At the outset minutes of Norms Committee Meeting No.2/09 dated 08.04.2008  were ratified by the Committee.

M/s Lupin  Ltd M.No.03/09 F.No.01/82/162/1352/AM 05 Meeting Date 15.04.2008

Committee considered the case as per Agenda and heard S/Shri Harish Narula, President, Venktesh Pai,  Sr.Manager and Ashok Madan,  Sr.General Manager of the firm, who appeared for PH.      They  explained  that    export  obligation  against  all  the  34  advance  licenses  have  been completed within the stipulated export obligation period of 6 months and payments have been realized.      They also informed that  the entire material imported against these advance licenses  have been fully utilized in the export production of  7 ADCA,  3C7ACCA, Cephalexin, Cefaclor and Cefadroxil.         They explained that as  per  the  clarification  of  DCGI,  Pencillin‐G  Potassium  First Crystal    is  a  dual  use  drug,  which  is  also  used  as  a  drug  intermediate  to  manufacture  semi‐ synthetic Pencillins and Drug Controller Office issues permission to import this input without site registration and without import licence to be used as intermediate in the manufacture of other intermediates or semi‐synthetic Pencillins.   They informed the Committee that  the  imported material against all these 34 Advance Licences has been used as  drug intermediate.     Committee  a䬀er  detailed  deliberation  observed  that    all  the  34  advance  licences  were issued during the period from 19th September, 2003 to 22nd April,2004 in terms of Policy Circular No.9 dated 30.6.2003 and Policy Circular No.15 dated 17.9.2003 respectively.  The condition of pre‐import  from  registered  importer  was  imposed  by  DCGI  Notification  issued  in  Jan,  2003.  Subsequently,  DCGI keeping in view the demand of the industry for exemption from registration for dual use items issued Circular No.6‐2/2004DC dt. 13.12.2005.  DCGI vide their letter No.17‐ 1/2005‐DC  dt.  26.6.2007    has  clarified  that    they  issue  permissions  to  import  Pencillin‐G Potassium  First  Crystal  without  site  registration  and  without  import  licence  to  be  used  as intermediate in the manufacture of other intermediate of semi‐synthetic Pencillins and sought for confirmation regarding end use of the material by firm. The firm has confirmed that they have utilized the material imported against all these 34 Advance Licences for the manufacture of drugs as drug intermediate.   Committee perused the decision of PRC taken in its meeting held on 26.7.2006 and a䬀er detailed deliberations  with the representatives of technical authority present in the meeting and keeping in view the circumstances explained in firm’s letter dated 30.12.2005 for not complying with the pre‐import  conditions,  Committee  decided  to  call  for  the  details  of  export    products manufactured and exported by the firm out of imported inputs i.e. Pencillin‐G Potassium First Crystal  duly  certified  by  Chartered  Accountant/Engineer  and  refer  the  case  alongwith  earlier decision   to Policy Relaxation Committee for consideration.
