Para 4.7 Decision

MEETING NUMBER : 7/82‐ALC4/2008 MEETING DATE : 13.05.2008 The Meeting No.07/09 in the year 2008‐09 to consider the cases under Duty Exemption Scheme (Chapter‐4) of Foreign Trade Policy, 2004‐09 pertaining to products falling in Chapter 29 and 30  was  held on 13.05.2008  under the Chairmanship of Export Commissioner, Shri Sanjay Rastogi in his chamber.   Following members were present:‐ 1.        Jasbir singh, IA, Chemical Division, C&PC 2.       Shri D.N. Mathur, Dy. IA, PI Division, C & PC. 3.       Dr. Arun Kumar, AD, MSME 4.        Shri Rajinder Pal Singh, Dy. DGFT. 5.       Shri Shyam Lal, FTDO   At the outset, minutes of Norms Committee Meeting No.3/09 dated 22.04.2008, 4/09 dated 29.04.2008 and 5/09 dated 29.04.2008 were ratified by the Committee.   Further, the Committee was informed that vide Public Notice No.55/2005 dated 19.09.2005 certain SIONs pertaining to Chemical and Allied Products were deleted, but their corresponding entries in DEPB Schedule are still existing. This pertains to period  before formation of Norms committee‐III. Committee decided to bring the above position to the notice of Chairman, DEPB Committee for taking a view in this regard.

M/S Pab Organics Pvt. Ltd. Norms Committee Meeting No.7/09 F.No.01/82/50/799/AM08 Meeting Date: 13.05.2008 RLA F.No.34/24/40/76/AM08 Adv. Lic. No.3410019236 dated 19.07.2007   Committee considered case as per agenda for enhancement in the quantity of Hydrobromic Acid 48% under para 4.7 of HBP.   Shri  Pankaj  Maheshwary,  Managing  Director  of  the  company  appeared  for  personal  hearing  and explained his case. He presented supporting data/relevant patents/published data and documents in support of his request. He explained that normally the process is optimized based on the intermediate which has a higher value so as to make the process more cost effective.

A䬀er hearing, Committee in light of Central Excise Data submitted by the Managing Director and in consultation with technical authorities present in meeting decided to enhance the quantity of Hydrobromic Acid 48% from 3.357 kg/kg to 5.00 kg/kg without any change in the quantity of inputs of other items.   RA concerned may take further necessary action as per above decision of NC.

F.No.01/82/162/450/AM08   Committee considered case as per agenda for fixation of value addition for DEPB rate in respect of export product 6‐APA.   Committee observed that firm has applied for fixation of DEPB rate for 6‐APA (6‐Amino Penicillanic Acid) and has furnished import/export data in repect of their firm. Committee felt that based on the data of an individual firm, DEPB rate should not be  fixed as it is  applicable to all the exporters inspite  of the fact that  other exporters might be having different consumption/production data for the same export product.   Committee  a䬀er  deliberation   and  in  consultation  with  the  representatives  of  Technical  Authority present in meeting decided to call for   consumption/production data of at least 3‐4 different firms engaged in production/export of the export product in question.   EPC  may  be  asked  to  furnish  data  along  with  copies  of  Shipping  Bills/Bills  of  Entry  etc.      for  3‐4 different firms for the export product in question, to facilitate fixation of DEPB rate.     The case may be listed for consideration on receipt of above data.

F.No.01/82/162/285/AM06   Committee considered case as per agenda for fixation of value addition for DEPB rate in respect of export product 3C7ACCA.   Committee observed that firm has applied for fixation of DEPB rate for 3C7ACCA and has furnished import/export data in repect of their firm. Committee felt that based on the data of an individual firm, DEPB

F.No.01/87/50/336/AM07 RLA F.05/24/40/225/AM07 Adv. Lic. No.051085276 dated 21.06.2006   Committee considered case as per agenda for ratification of norms for export product Silymarin Extract under para 4.7 of HBP.   Ms. Nidhi Mehta, Sr. Vice President of company appeared before Committee for personal hearing and explained the case. She was asked to submit technical details indicating the difference between import and export item. She promised to submit the details soon. Committee, therefore, decided to await reply of firm and defer case for 24.06.2008.

F.No.01/83/50/409/AM08 RLA F.No.03/94/40/187/AM08 Adv. Lic. No.0310430680 dated 25.05.2007   Committee  considered  the  case  as per  agenda  for  revision  of  norms  for  export  product  Sucralose   Shri  Manoj  Kumar  Saxena,  Vice  President  (Operations)  of  the  company  appeared  before  the Committee for personal hearing  and explained the case. He explained that the quantity allowed by NC are grossly inadequate vis‐à‐vis quantity applied by them.

A䬀er hearing,  Committee decided to call for Central Excise Data alongwith supporting literature from firm. Accordingly, case was deferred for 24.06.2008.

F.No.01/83/50/1234/AM08 RLA F.No.03/94/40/658/AM08 Adv. Lic. No.0310444208 dated 25.09.2007   Committee considered case as per agenda for correction in item of import under para 4.7 of HBP.   Committee  observed  that  there  is  a  typographical  error  in  recording  the  minutes.  Therefore,  in consultation with representative of PI Division present in meeting, NC decided to allow correction in import item  to  read  as  “(2R,5S)‐5‐[4‐Acetamido‐2‐oxo‐1(2H)‐Pyrimidinyl]‐1,3‐oxathiolan‐2‐YL,  Methyl  Menthyl Carbonate”.

Representative  of  Chemical  Division  present  in  meeting  informed  Committee  that  there  is  no justification for revision of norms. Commiittee, therefore, decided to maintain status quo.
