MEETING NUMBER : 47/82‐ALC4/2010 MEETING DATE : 22.02.2011 The Mee呞ng No.47/82 in the year 2010‐11 to consider the cases under Duty Exemp呞on Scheme (Chapter‐4) of Foreign Trade Policy, 2009‐14 pertaining to products falling in Chapter 29 and 30 was held on 22.02.2011 under the Chairmanship of Addl DGFT, Shri V.K. Norms CommiƩee Mee呞ng No.47/11 F.No.01/82/050/00436/AM08/DES‐III Mee呞ng Date:22.02.2011 RA F.No.03/95/040/00466/AM08 Adv.Lic.No.0310445758 dated 09.10.2007 CommiƩee considered case as per agenda and noted that the firm had men呞oned that the product is a nutri呞onal supplement and does not require DML. However the CommiƩee observed that the export product CoQ10 So氒�gel Capsule falls under Chapter 30 which is meant for Pharmaceu呞cal Formula呞ons and the same can not be manufactured without obtaining Drug Manufacturing Licence from Drug Authority. Accordingly, it was decided to reject the case.

Since the leƩer conveying the decision of NC was not received by the firm, they made representa呞on for fixa呞on of norms in 2007. The case was again considered by NC in 20/08 mee呞ng held on 18.09.2007 and the same was rejected as 呞me barred. The firm has requested to withdraw the decision of NC taken 18.09.2007 as the norms were already fixed by NC in its mee呞ng held on 19.02.2004. given NOC for import of Hydrogenated Palm Stearine, (Non Edible Grade). CommiƩee observed that as per para 4.7 of HBP, Vol.I, Advance Authorisa呞ons for import of all vegetable/edible Oils classified under Chapter 15 can be issued under para 4.4.2 of HBP, Vol.I. The CommiƩee also felt that it is not prac呞cable to clarify Hydrogenated Palm Stearin (HPS) as edible or non‐edible oil. Further the item (ITC(HS) Code 15162091) is free for import. The CommiƩee also noted that NOC is not required for issue of Advance Authorisa呞on under para 4.4.2 of HBP, as per FTP/HBP. The CommiƩee thus decided to fix ad‐hoc norms as under or as applied by the firm which is lower for issue of Advance Authorisa呞on under para 4.4.2 of HBP on the basis of wriƩen comments received from Department of C&PC vide their U.O.
