The Meeting No. 05/AM10 for the licensing year 2009-10 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 30.04.2009 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that case is under examination of DC (MSME). It was decided to await the same and defer the case. The case stands deferred for re-listing on 28.05.2009.

M/s Madura Garments Exports Ltd., Bangalore F.No. 01/84/50/402/AM-07/DES-V Ratification of input output norms against Advance Authorization No. 0710048675 dated 28.11.2006 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was earlier rejected due to the fact that firm did not reply to TC, Mumbai letter dated 29.01.2007. Further, in this case firm have not given the size-wise details, CAD, CAM etc in this case. As regards item of import No.2 firm have not given any justification, hence it is not allowed. In view of this Committee decided to allow the item of import at S.No.1 @ 2.15 Sq mtrs./Pc (taking cue from SION, J-175). The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Case No.108

Ref. received from Jt. DGFT, Madurai - M/s Fenner Conveyor Belting Pvt. Ltd., New Delhi F.No. 01/84/162/580/AM-09/DES-V Application for fixation of norms for the Advance Authorization issued under Para 4.7 of HBP, 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to link the earlier similar case file of the firm wherein adhoc norms have been fixed and defer the case for re-listing on 28.05.2009.

Case No.109

M/s Shivam Global apparels Pvt. Ltd., Faridabad F.No. 01/84/162/180/AM-05/DES-V Re-fixation of input output norms against Advance Authorization No. 051012281 dated 29.03.2004 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the CAD, drawing, design and copies of invoices and shipping bills available on record. It was observed that in this

PRO version case there are two fabrics i.e Polyester Satin and Polyester Organsa and both the fabrics are used for making a single garment (Girls/Ladies Dresses). The Qty. requirement for Satin fabric is 2.26 Sq mtrs./Pc and for Organsa fabric is 2.16 Sq mtrs./Pc totaling 4.42 Sq mtrs/Pc in this case. Since, in this case firm exported only 1801 Pcs, which works out the total Qty. 7960.42 Sq mtrs. (1801X4.42 = 7960.42). Thus, Committee felt that difference in weaving of Polyester fabrics (Satin & Organsa) does not make any difference in monitoring the quantity. Therefore, Committee observed that monitoring of total Qty. of Satin & Organsa together does not make any difference. Hence, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to condone the condition of monitoring the Qty. for Satin & Organsa separately in this case. R.A may be advised to issue EODC accordingly in this case. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Case No.110

M/s Shivam Global apparels Pvt. Ltd., Faridabad F.No. 01/84/50/135/AM-05/DES-V Re-fixation of input output norms against Advance Authorization No. 0510134131 dated 03.08.2004 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call the applicant firm for personal hearing before its meeting to be held on 28.05.2009 alongwith complete justification pertaining to this case.

                              The case stands for re-listing on 28.05.2009.

M/s Gaurav International, gurgaon F.No. 01/84/50/474/AM-09/DES-V Re-fixation of input output norms against Advance Authorization No. 0510238392 dated 19.03.2009 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that this case has already been considered by NC in its meeting held on 02.04.2009 and allowed the Qty. of inputs against all the three export items as applied by the firm. Now, firm have requested for addition of new Style No. 669546J in addition to the existing Style No. 664681 against export item No. 1, Style No. 669531J in addition to existing Style No. 664613 against export item No. 2 and Style No. 666781J in addition to existing Style No. 664541 against export item No. 3 in this case as per their buyer M/s Gap. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to add the aforementioned Style Nos. in each of the three export items in this case as requested by the firm. The R.A shall be advised to take necessary action subject to compliance of other Usual conditions. They may monitor the all the Style Nos. mentioned above on the export side in this case.

Case No.1 M/s Bhadresh Trading Corp. Ltd., Mumbai NC 05/AM10 dt. 30.04.2009 F.No. 01/84/162/717/AM-09/DES-V Fixation of SION for Raw Cotton not carded or combed).. Decision: The Committee considered the case as per agenda alongwith applications of four firms/companies M/s Gill & Co. Pvt. Ltd., Mumbai, M/s Dwarkadas & Sons, Mumbai, M/s Bhadresh Trading Corp. Ltd., Mumbai and M/s LGW Ltd., Kolkata for fixation of SION for Raw Cotton alongwith earlier decision of NC take on 26.3.2009 on this issue. The Committee observed that these two applications were routed through FIEO. The Committee went through the all relevant details submitted by the two new applicant firm in this matter and observed that as regards import item “Seeds” the quantitative requirement asked for varies from7.5 to 17.5kgs in the application all the four firms. The committee has also felt that since consumption of Seeds also depends on so many factors viz., quality of seeds, its origin germination condition, Geographical condition of the soil and harvesting condition. In view of the above, the

PRO version committee decided not change the quantity recommended which is at the minimum level of consumption.

Therefore, Committee after deliberations in consultation with the representative of technical authorities present in the meeting decided to recommend no quantitative change in the decision taken on 26.3.2009. However, all the items can be serially numbered and following notes can be incorporated to compute the quantitative requirement of import of packing items.

Note: 1 “It may be noted that a cotton bale would be packed either in grey cotton fabrics or in plastic woven fabrics, but never in both. Hence, import quantity of Sr. No.2 and Sr. No.3 to be computed taking into account the quantity of export product packed in grey cotton fabrics (for import item No.2) or quantity of export product backed in plastic woven fabrics (for import itemNo.3)”.

Note:2 “It may be noted that a cotton bale would be strapped either in Steel Coil or in PVC Strap, but even in both. Hence, import quantity at Sr. No.4 and /Or Sr. No.5 to be computed taking into account the quantity of export product strapped using Mild Steel Coil (Width ½”- ¾”) and/or quantity of export product in PVC straps (for import item No.5).”

        On these lines, the Committee recommends publication of SION for Raw Cotton (not carded or combed).
