DGFT.                     At the outset the minutes of Norms Committee Meeting 20/08 held on 23.8.2007 were ratified by the committee.          List of Members Present in the Meeting is at Annexure I.          Total Number of Cases 37.          No.535   M/s. It was decided to remind Spices Board to expedite comments.   Consideration of the case was deferred for relisting on 27.9.2007.     No.537   F.No.01/85/162/275/AM 08/DES VI Export of Oleoresin Oregano against  import of  Oregano. Advance Authorization No.1010026776  dt. 21.6.2007 under Para 4.7 of HBP(Vol.I) 2004-07. RLA , Cochin. It was observed that in this case SAR report about the yield of import consignment(s) from Spices Board is awaited. Applicant has applied for ratification of Advance Authorisation based on 4.00% yield in this case. Accordingly the committee decided to ratify the Advance Authorisation in this case as under:-   (A)    RA shall work out the EO as per yield percentage certified      in the SAR of Spices Board against specified quantity of        imports against each import consignment.   An illustration is given as under:-   S. RLA ,Cochin  Ref.F.No.10/24/40/31/AM04   No.549   M/s Vallabhdas Kanji Ltd., Kerala F.No.01/85/50/188/AM 05/DES VI Export of Hot & Spicy marinade against import of Monosodium Glutamate. A/L No.1010017927 dt.12.10.2004- under para 4.7 of HBP(Vol.I). RLA ,Cochin  Ref.F.No.10/81/40/110/AM05                           The committee considered these cases as per agenda. It was observed that the maximum permissible limit of use of Monosodium Glutamate in some Food Products under PFA Rules is miniscule i.e. 500 mg/Kg. This is an indicator that large quantity(s) of imported item i.e. Monosodium Glutamate in ratio of 300 Gms in 1 Kg of Food Marinade, which have been requested by the applicant, appear unreasonable. Moreover, Monosodium Glutamate is not admissible for use in many food items and its usage is also restricted/banned in many countries on account of health considerations. Keeping in view the above, the committee decided to maintain rejection of these case.         RLA may also be advised to take necessary consequential action subject to other usual terms and conditions of the Foreign Trade Policy/ Procedure.           No.550  Misc./08 M/s. AGA Fruits (P) Ltd; Bangalore. F.No.01/85/162/113/AM.08/DES.VI Request for release of further advance authorisation for export of Mango Pulp pending grant of EO extension by H.Qrs.          The committee considered the case as per agenda. It was observed party‛s request for grant of EO extension is already with Grievance Cell of DGFT for their consideration. No action is thus required on the party of NC or DES.VI Section. Export of Essential Oil of Mustard against import of Mustard Seeds. Clarification sought by RLA under para 4.7. RLA Cochin Ref: No. 10/24/40/05/AM06.          The committee considered these cases as per agenda. It was observed that the import item “Mustard Seed” of Seed Quality falls against ITC(HS) 12075010 and of Other falls against ITC(HS) 12075090. The purpose of import by applicant may be distillation of essential oils (as stated by the applicant) and not extraction of fixed oil/oil cake but the intent of the provisions laid down under para 4.7 of HBP (Vol.I) is not to allow Oilseeds classified under Chapter 12 of ITC(HS) fir Advance Liccence/Authorisation under adhoc category. Committee therefore did not find merit in the argument put forward by the applicant and decided to maintain rejection for issue of advance authorisation under para 4.7 of HBP (Vol.I).         RLA may also be advised to take necessary consequential action subject to other usual terms and conditions of the Foreign Trade Policy/ Procedure.     No.552 M/s. It was observed that in these cases SAR report about the yield of import consignment(s) from Spices Board is awaited. Advance Authorization No.0710051498 dt. 3.5.2007 under Para 4.7 of HBP(Vol.I) 2004-09. RLA , Bangalore. Ref.No.07/24/040/049/AM08          The Committee considered these cases as per agenda. It committee in consultation with the representative of the Technical Authority present in the meeting decided that the party may be asked to furnish details of the Type, size and specifications of packing of export product.   It was also observed that the comments of MFPI are still awaited. Kancor Ingredients Ltd., Ernakulam F.No. 01/85/162/1030/AM07/DES-VI Export of Ginger Oil FCC against  import of Crude Ginger Oil. Advance Authorization No  1010025793  dated 26.02.2007 under para 4.7 of HBP 2004-2009 RLA, Cochin, Ref. No. 10/24/40/138/AM07               The Committee considered these cases as per agenda. Sh. J.J. Negandhi, Executive Director of the firm appeared for personal hearing before the committee and explained that the “FCC” stands for Food Chemical Codes which is compendium of specifications for food ingredients as per US Food Law. He also explained that the Terpenes has no commercial value and it is thrown as waste. The committee decided to ask the firm to furnish following information/details:-   (a)              A declaration on Non judicial stamp paper to the effect that the “Terpenes” generated in the manufacture of Ginger Oil FCC has no commercial value. The same is thrown as waste.   (b)              Production and consumption data for the production of “Ginger Oil FCC” manufactured from “Crude Ginger Oil” duly certified by jurisdictional central excise authority.   (c)              The content of “Ginger Oil” in the export product “Ginger Oil FCC” duly certified by a Chartered Engineer.   (d)              Copies of foreign Buyers‛s order(s).   (e)              Copies of Shipping Bills alongwith their Packing List duly certified by customs authority.   Consideration of the case was deferred for relisting on 20.9.2007.           No.557 M/s. Negandhi, Executive Director of the firm appeared for personal hearing before the committee and explained about various types of their products  of T-5 and T-14 quality. The committee after delibration of the case decided to ask the firm to furnish following information/details:-   (a)                           Purity of three export products namely (a) Curcumin Powder (b) Turmeric Standardized Extract and (c) Oleoresin Turmeric duly certified by a Chartered Engineer.   (b)              Oil content in Oleoresin Turmeric duly certified by a Chartered Engineer.   (c)              Water content in Curcumin Powder duly certified by a Chartered Engineer.   (d)              Extract content in Oleoresin Turmeric and in Turmeric Standardized Extract duly certified by a Chartered Engineer.   (e)              Copies of Shipping Bills for the three export products namely (a) Curcumin Powder (b) Turmeric Standardized Extract and (c) Oleoresin Turmeric alongwith their Packing List duly certified by customs authority.   Consideration of the case was deferred for relisting on 20.9.2007.            No.562   M/s. No.  8/24/40/080/AM08          The Committee considered the case as per agenda. It was observed that the Export Product “Eyecryl plus set bearing IOL, Sterile Cartaridge” falls under Chapter 90. As per O&MI No.12/2007 dated 20.8.2007 this product falls with jurisdiction of NC No.2. It was decided to transfer the case to NC No.2 for necessary action.                                   The Committee considered these cases as per agenda. It was observed that the firms have been given opportunity for a PH to justify the case before the Committee. It was observed that no one appeared before the committee. It was decided that one more opportunity be given to all firms to appear for PH before NC to be held after two weeks.
