LEGAL FRAMEWORK

POLICY AND LAWS CONCERNING CITES IN INDIA
International trade in all wild fauna and flora in general, and the species covered under CITES in particular, is regulated jointly through the provisions of the Wildlife (Protection) Act 1972, the Foreign Trade (Development Regulation) Act 1992, the Foreign Trade Policy of Government of India and Customs Act, 1962. The Director of Wildlife Preservation, Government of India is the Management Authority for CITES in India.
1.1 Wildlife (Protection) Act, 1972 Hunting of wild animals has been prohibited under Sec. 9 of the Wildlife (P) Act, 1972. No person is allowed to hunt any wild animal specified in Schedule I, II, III and IV except as provided under sections 11 and 12 of the Act. The Act also prohibits under section 17A, the collection or the trade in specified plants (whether alive or dead or part or derivative) i.e. those listed in Schedule VI of the Act, from any forest land and any area specified by notification by the Central Government. The Schedule VI of the Act lists all the six plants of Indian origin included in CITES appendices. Trade in Scheduled animals / animal article i.e.

Similarly, the Act disallows trade in all kinds of imported ivory, including that of African elephant. Export or import of wild animals and their parts and products is, however, allowed for the purpose of scientific research and exchange of animals between Zoos and is subject to licensing by the Director General of Foreign Trade (DGFT), Government of India. The Act has been amended in 2006 leading to the establishment of the National Tiger Conservation Authority and the Wild Life Crime Control Bureau (WCCB) with a statuary backing.

1.2 Foreign trade (Development and Regulation) Act 1992
This Act replaces the earlier Imports and Exports (Control) Act, 1947. The Foreign Trade Policy incorporating the export and import policy is formulated and announced by the Central Govt. under section 5 of this Act. As per section 8 (1) no export or import shall be made except in accordance with the provisions of this Act, the rules and orders made there under. As per section 3(1) the Central Govt. makes provisions for the development and regulation of foreign trade by facilitating imports and exports. As per section 3(2) the Central Govt.

As per section 3(3) all goods to which any order under subsection (2) applies shall be deemed to be goods the import or export of which has been prohibited under section 11 of the Customs Act, 1962 and all the provisions of that Act shall have effect accordingly.

1.3 Foreign Trade Policy (2009-2014) Foreign Trade Policy announced periodically by the Ministry of Commerce contains, inter alia, information regarding the wildlife and wildlife products which are either prohibited or permitted for the purpose of import or export. It also contains the conditions (which include compliance with CITES) governing import and export of permissible species of wildlife and wildlife products. The policy is decided in consultation with the Management Authority for CITES in India as far as matter relating to wild fauna and flora are concerned and is enforced through the Customs Act, 1962. The Foreign Trade Policy is brought out under the provisions of the Foreign Trade (Development & Regulation) Act 1992 and it regulates the import and export of all goods including wildlife.

1.3.1 Import policy Import of animals and their parts and products for zoological parks and circuses or for research purpose may be permitted subject to the provisions of CITES and on recomendations of the Chief Wildlife Warden of the States and Union Territories under license from DGFT. Import of plants is also subject to the provisions of CITES. The current policy does not permit commercial import of African ivory in view of the ban imposed by CITES. Import of other derivatives of wildlife is restricted and can be made only with prior permission of DGFT, subject to the conditions prescribed. Import of wild animals as pets in the personal baggage of a passenger is also subject to the provisions of CITES in accordance with the Ministry of Commerce’s Public Notice No. 27ITC (PN) 180. dated 15.7.80.

1.3.2 Export Policy The Export Policy permits re-export of commodities except to the extent such exports are regulated by any other provisions of this Policy or any other law for the time being in force. Items prohibited for export are not permitted to be carried in the personal baggage also. Extracts of the Policy and ITC (HS) classification have been reproduced in Chapter II & III respectively of this report. It is worth mentioning that all forms of wildlife including their parts and products are prohibited for export except in cases where it is specifically allowed under different parts of ITC (HS) classification of Export & Import items. Peacock tail feathers which were earlier allowed for Export under a limited ceiling are now prohibited for export. Export of exotic birds except 6 species listed under Table ‘B’ of Schedule 2 is also prohibited at present. Further the Ministry of Commerce vide public notice no. 47 (PN) 92-97 dt. 30-3-94 had prohibited the exports of a number of plants, plant portions and their derivatives if obtained, from wild. This list has been amended from time to time, A list of 29 prohibited plant taxa is given in Chapter III.

1.3.3
Special Conditions for Import & Export
All imports and exports of wild animals and plants are permitted only through the Customs points at Mumbai, Kolkata, Delhi, Chennai, Cochin, Amritsar and Tuticorin. Two essential conditions governing the import and
export of Wildlife and the derivatives are,
1. Compliance with the provisions of CITES. 2. Inspection of the consignments by the Regional Deputy Directors of Wildlife Preservation at the Customs points. In case of items covered under CITES, an endorsement is made on the relevant CITES export permit.
1.4. Customs Act, 1962 Section 3(3) of the Foreign Trade (Development and Regulation) Act 1992 provides that all items (including wild Fauna & Flora) covered in the Import & Export policy will be deemed to be covered under Section 11 of the Customs Act, 1962.As a consequence, all cases of violation of the Import-Export Policy in general and CITES in particular, constitute an offence under the Customs Act and are dealt with by the Customs officials.

QUARANTINE REGULATIONS The Livestock importation Act 1898 empowers the Central Government to regulate, restrict or prohibit the import into India or any specified place therein, of any livestock which may be liable to be affected by infectious or contagious disorders.

The Central Government has notified poultry, parrots, pigeons, canaries and finches as livestock for the purpose of the said Act. The Foreign Trade (Development and Regulations) Act 1992 also empowers the Central Government to regulate import and export of birds and animals with a view to control
the spread of communicable diseases. The Ministry of Agriculture has appointed Animal Quarantine officers at Delhi, Mumbai Chennai and Kolkata to verify the health of animals and birds before export and after import and to issue Quarantine Clearance Certificates. The Animal Quarantine Officer may, if needed, cause for the detention of any animal or bird to be imported at a quarantine station for observation and prevent the entry of such birds and animals as are diseased. The import of plants is also regulated under the provisions of the Destructive Insects and Pests Act, 1914 and the notifications issued there under i.e. the Plant Quarantine (Regulation of Import into India ) Order 2003. All imported plant consignments should be accompanied by :

All imported materials are inspected and, if necessary, fumigated or otherwise disinfected at the port of entry by the Plant Quarantine Officer.

As per section 3(14) of the aforesaid order, all consignment of seeds and plants for propagation and regulated articles such as live insects, microbial cultures, bio-control agents and soil shall only be imported into India through regional plant quarantine stations of Amritsar, Chennai, Kolkata, Mumbai or New Delhi or through any other points of entry as may be notified from time to time for this purpose, provided that no import of germplasm/transgenic plant material and genetically modified organisms shall be permitted through New Delhi Airport.

As per section 6(1) No consignment of germplasm/transgenics/Genetically Modified Organisms(GMOs) shall be imported into India for research/experimental purpose without valid permit issued by the Director, National Bureau of Plant Genetic Resources, New Delhi-110012.

MANAGEMENT AUTHORITIES-CITES: India is a signatory to CITES since 1976. The Additional Director General (Wildlife) cum Director, Wildlife Preservation, MOEF, Govt. of India is the Management Authority, CITES in India. There are 4 functional Assistant Management Authorities (AMA-CITES) working on behalf of MA-CITES at Delhi, Calcutta, Chennai and Mumbai.

     3.1      Scientific Authorities

Following are the Scientific Authorities to deal with the CITES related matter in the country.

3.2 ENFORCEMENT 3.2.1 Considering the seriousness of organised Wildlife Crime having the inter-state and International ramification and illegal trade of Wildlife parts and products, the Wildlife Crime Control Bureau was created in 2007 under the provisions of the Wildlife Protection Act 1972. The Wildlife Crime Control Bureau, Head Quarter is situated at New Delhi and erstwhile Regional Wildlife Preservation offices have been designated as regional Wildlife Crime Control Bureau offices. These offices are located at New Delhi, Kolkata, Mumbai and Chennai. In addition there is a Wildlife Crime Control Bureau Office in Jabalpur, Madhya Pradesh. The Bureau is a multidisciplinary organisation with the following mandate given under 38 Z of the Wildlife Protection Act. 38Z: Powers and functions of the Wildlife Crime Control Bureau- (1) Subject to the provisions of this Act, the Wildlife Crime Control Bureau shall take measures with respect to –
(i) Collect and collate intelligence related to organized wildlife crime activities and to disseminate the same to State and other enforcement agencies for immediate action so as to apprehend the criminals and to establish a centralized wildlife crime databank; (ii) Co-ordination of actions by various officers, State Governments and other authorities in connection with the enforcement of the provisions of this Act, either or through regional and border units set up by the Bureau;
(iii) Implementation of obligations under the various International Conventions and protocols that are inforce at present or which may be ratified or acceded to by India in future; (iv) Assistance to concerned authorities in foreign countires and concerned International organizations to facilitate co-ordination and universal action for wildlife crime control; (v) Develop infrastructure and capacity building for scientific and professional investigation into wildlife crimes and assists State Government to ensure success in prosecutions related to wildlife crimes;

50 and section 55 of this Act ; and
(ii) Such other powers as may be prescribed. 3.2.2 The enforcement of CITES provisions is presently being carried out by the Customs officials and Regional Deputy Directors, Wildlife Crime Control Bureau through the Customs Act, 1962 at the point of Import/Export and by the State Wildlife Departments headed by Chief Wildlife Wardens under the Wildlife (Protection) Act, 1972 elsewhere. The Chief Wildlife Wardens also issue licences to the dealers and manufacturers of wildlife items and legal procurement certificate to the exporters of wild fauna and flora to establish the legality of the consignment in question. The Directorate of Revenue Intelligence (DRI), the Central Bureau of Investigation (CBI), the Police, the State Forest Departments and various other Central/State agencies also provide assistance in controlling illegal trade in wildlife.

2.2 Compliance with Laws Every exporter or importer shall comply with the provisions of the Foreign Trade (Development and Regulation) Act, 1992, the Rules and Orders made there under, the FTP and the terms and conditions of any Authorisation granted to him. All imported goods shall also be subject to domestic Laws, Rules, Orders, Regulations, technical specifications, environmental and safety norms as applicable to domestically produced goods. No import or export of rough diamonds shall be permitted unless accompanied by Kimberley Process (KP) Certificate as specified by the Gem & Jewellery Export Promotion Council (GJEPC).

DGFT may, through a notification, adopt and enforce any measure necessary for : i. Protection of public morals. ii. Protection of human, animal or plant life or health. iii. Protection of patents, trademarks and copyrights and the prevention of deceptive practices. iv. Prevention of use of prison labour. v. Protection of national treasures of artistic, historic or archaeological value. vi. Conservation of exhaustible natural resources. vii. Protection of trade of fissionable material or material from which they are derived; and viii. Prevention of traffic in arms, ammunition and implements of war. 2.7 Restricted Goods Any goods the export or import of which is restricted under ITC (HS) may be exported or imported only in accordance with an Authorisation or in terms of a public notice issued in this regard.

2.8 Terms and Conditions of Licence/Certificate/Permission/Authorisation Every Authorisation shall be valid for prescribed period of validity and shall contain such terms and conditions as may be specified by RA which may include :

a. The quantity, description and value of the goods ; b. Actual User condition ; c. Export obligation ; d. The value addition to be achieved ; and e. The minimum export/import price.
2.14 Transit Facility Transit of goods through India from or to countries adjacent to India shall be regulated in accordance with the bilateral treaties between India and those countries and will be subject to such restrictions as may be specified by DGFT in accordance with International Conventions.

2.18 Import of samples Import of samples shall be governed by the provisions given in Handbook (Vol. 1). 2.19 Import of Gifts Import of gifts shall be permitted where such goods are otherwise freely importable under this Policy. In other cases, a Customs Clearance Permit (CCP) shall be required from DGFT.
2.20 Passenger Baggage Bonafied household goods and personal effects may be imported as part of passenger baggage as per the limits, terms and conditions thereof in the baggage rules notified by the Ministry of Finance.

Bonafide personal baggage may be exported either along with the passenger or, if unaccompanied, within one year before or after the passenger’s departure from India. However, items mentioned as restricted for exports in ITC (HS) shall not be exported as a gift, without an Authorisation.

2.35 Export of Imported Goods Goods imported, in accordance with FTP, may be exported in the same or substantially the same form without an Authorisation provided that the item to be imported or exported is not restricted for import or export in ITC (HS). Exports of such goods imported against payment in freely convertible currency would be permitted against payment in freely convertible currency. 2.36

provided that the item is freely exportable without any conditionality / requirement of licence / permission as may be required under ITC (HS) Schedule ll.
2.36A Hides, Skins and semi finished leather may be imported in the Public Bonded warehouse for the purpose of DTA sale and the unsold items thereof can be re-exported from such bonded warehouses at 50% of the applicable export duty. However, this facility shall not be allowed for import under private bonded warehouse.

4.1.3 Advance Authorisation An Advance Authorisation is issued to allow duty free import of inputs, which are physically incorporated in export product (making normal allowance for wastage).

CHAPTER - 9
DEFINITIONS
9.1 For the purpose of FTP, unless the context otherwise requires, the following words and expressions shall have the following meanings attached to them. 9.2 “Accessory” or “Attachement” means a part, sub-assembly or assembly that contributes to the efficiency or effectiveness of a piece of equipment without changing its basic functions. 9.3 “Act” means the Foreign Trade (Development and Regulation) Act, 1992 (No. 22 of 1992).

(1) An application for grant of a licence for import of Animals, Birds and Reptiles (including their parts and products) may be made in the form given in ANF 2B of the Handbook of Procedures Vol. 1, to the Director General of Foreign Trade along with the recommendation of the Chief Wild Life Warden of the State concerned.

An application for grant of a licence for import of Stallions and Broodmares may be made in the form given in ANF 2B of the Handbook of Procedures Vol. 1, to the Director General of Foreign Trade along with the recommendation of Director, Animal Husbandry and Veterinary Services of the State Government concerned or the Department of Animal Husbandry and Dairying, Ministry of Agriculture, Government of India.

The import of stallions and broodmares against licences shall be subject to the following conditions:

(i) Import of such animals shall be subject to the health regulations in force;

(ii) Applications shall be considered only from stud farms which have been in existence for at least three years and registered with the Animal Husbandry Commissioner, Department of Agriculture and Cooperation, Government of India. However, this period of three years may be relaxed on merits;
(iii) A certificate of fitness issued either by the veterinary officer or by a qualified veterinary doctor registered with the Government of the country of origin shall be furnished at the time of customs clearance.

For recognized scientific/research institutions, in addition to the above requirement, recommendation of Committee for the purpose of Control and Supervision of Experiments on Animals (CPCSEA) under the Prevention of Cruelty to Animals Act, 1960 shall also be required for issuance of Import licence.

(1) Import of seeds of vegetables, flowers, fruits and plants, tubers and bulbs of flowers, cutting, sapling, budwood etc., of flowers and fruits for sowing or planting is permitted without a licence in accordance with a permit for import granted under the Plant Quarantine (Regulation of Imports into India) Order, 2003. However, import of Poppy seeds if permitted for import under the Plants, Fruits and Seeds (Regulation of Import into India) Order, 1989 for sowing or planting shall be subject to the condition that importer shall produce a certificate from the competent authority of the country of origin that opium poppy has been grown licitly/legally in that country as per requirements of the International Narcotics Control Bureau.

(2) Import of living plants, seeds for sowing or plant material shall be made by the Indian Council of Agricultural Research, Agricultural Universities, Botanical and Horticulture Departments of other Universities and State Governments, without a licence. OIL SEEDS AND OLEAGINOUS FRUITS; MISCELLANEOUS GRAINS, SEEDS AND FRUIT; INDUSTRIAL OR MEDICINAL PLANTS;STRAW AND FODDER.

Notes.

Heading 1207 applied, inter alia, to palm nuts and kernels, cotton seeds, castor oil seeds, sesamum seeds mustard seeds, safflower seeds, poppy seeds and shea nuts (karite nuts). It does not apply to products of heading 0801 or 0802 or to olives (Chapter 7 or Chapter 20).

Heading 1208 applies not only to non-defatted flours and meals but also to flours and meals which have been partially defatted or defatted and wholly or partially refatted with their original oils. It does not, however, apply to residues of headings 2304 to 2306.

For the purposes of heading 1209, beet seeds, grass and other herbage seeds, seeds of ornamental flowers, vegetable seeds, seeds of forest trees, seeds of fruit trees, seeds of vetches (other than those of the species Vicia faba) or of lupines are to be regarded as “seeds of a kind used for sowing”.
