licence, subject to payment of composition fee @1% per month on the duty
saved amount vis.-a-vis the export made after the valid EOP and also subject
to verification by RA of EO claimed to have been fulfilled within the valid

The Committee noted that the consumption of the duty free imported material was erroneously short declared in all shipping bills as 1.27 MT instead of 10.8 MT. Since the shipping bills are not amendable after three years, the firm has requested for extension in EOP so that they could complete the balance EO vis- à-vis the short declared quantity of duty free imported material against the subject licence. Since EO has been fulfilled 100%, both value-wise and quantity-wise, as per the original EO, the Committee decided to extend the EO period for a period of six months from the date of endorsement subject to payment of composition fee @ 1% per month on the duty saved amount vis-à- vis the exports made after valid EOP, and also subject to verification of RA of 100% fulfillment of original EO, as claimed by the firm.

The Committee noted that in one of the shipping bills mentioned above the relevant advance licence number and date could not be mentioned. However, licence number has been shown in invoice and ARE-I and the shipping bill has the corresponding ARE-I details. Since the documents furnished by the firm established correlation of exports made against the said shipping bill to the above mentioned advance licence, the Committee decided to accept the request of the firm to consider the shipments made against Shipping Bill No.3620053 dated 29.7.2005 towards fulfillment of EO against the subject licence, subject to verification of the documents by the RA to establish the aforesaid correlation.
