MINUTES OF THE NORMS COMMITTEE- VI MEETING No. NC/6/MEET/Apr/202425/1 DATED: 06/05/2024 Please Note For information of exporters, Norms Committee - VI handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC (HS) Chapter 1 to 26, 94 to 98 .Communications in respect of cases/pertaining to NC- VI may be sent to email address: nc6.dgft@nic.in I. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC. II. Wherever the Committee has fixed Norms, the concerned RA may ensure that AA is issued on the wastages/consumption as ratified by the Committee or as per wastages claimed in the application, whichever is less. Subject Modification of SION E-125 for export of “Shea Stearine” against import of “Shea Nuts”. DECISION: NC noted that SION E-125 was notified in 2006 in which the recoverable wastage was also deducted while arriving at the import entitlement of Shea Nuts. Further NC also noted that request from the firm M/s Manorama Industries was received for revision of SION E 125. MoFPI had set up an internal Committee to examine this issue and in September 2022 recommended an upward revision in E 125. MoFPI had also observed that the price of Shea Nuts and its byproducts are dynamic in nature in short as well as medium term as such the IO norms needs to be reviewed at regular intervals. NC also noted that besides M/s Manorama Industries Limited, there is another major exporter, i.e. M/s 3F Industries who is a largest exporter in this EXIM business and accordingly inputs/data from M/s 3F Industries was also requested. However, initially no data for revision was submitted by M/s 3F Industries & they did not agree for any change/enhancement in SION E-125. Accordingly, the Committee did not modify SION E-125 for a higher entitlement based on data submitted by a single exporter, i.e.

NC therefore decided to (a) recommend to DGFT for suspending SION E- 125 fixed in 2006 and (b) to call for applications in ANF 4B along with supporting documents for re-assessing IO norms in E 125. Accordingly, vide PN No. 33/2023 dated 12.10.2023 SION E-125 was suspended. Based on the request of the firms to explain their production process a PH was held on 1st March, 2024. Representatives of M/s 3F Industries Ltd. and M/s Manorama Industries Limited attended and submitted their presentation before the NC and urged for an immediate revision of SION E-125 in order to avoid the difficulties they are facing due to its suspension. The Committee heard both the parties and requested them to submit their written submission alongwith all relevant documents for further examination of the matter.
