DECISION DEFERRED The Committee considered the case as per agenda. It was observed that this case is regarding modification of SION F-8 for the export product Hand Knotted Woolen Carpets. The request is to include Carpet Thread Waste Wool in the existing norms for Carpet Thread Wool. It was observed that production and consumption data of the export product and inputs called from the party is still awaited. Requisite data for consideration of SION cases is also awaited from Carpet EPC Bhadohi. The comments of DC(SSI) and All Indian Handicraft Board are also still awaited. Committee decided to remind party and other departments to expedite their reply/comments. Consideration of the case was deferred for relisting on 18.10.2007.

DECISION DEFERRED The Committee considered these cases as per agenda. It was observed that this is a representation of the applicant against rejection of their request for import of Acetone for export of Lecithen powder as the technical authority was of the view that there is no nexus between the import and export item and thus it is not covered under the parameters of the duty exemption scheme as enumerated in Foreign Trade Policy. Directorate Of VVO&F has been requested on 31.7.2007 to furnish comments on party‛s representation. The same are still awaited. They may be reminded to expedite comments in these cases. DECISION DEFERRED The Committee considered these cases as per agenda. It was observed that none of the applicant firm appeared for PH which was granted twice to he applicant to justify the case before the Committee. The committee deliberated upon these cases and decided that APEDA may be requested to furnish detailed consumption data for the use of Fuel in Furnace for manufacture of Biscuits. The committee also considered the other request of the applicants with regard to amendment of SION E-5, to include Bakery Shortening/RBD Palm Oil/RBD/Palm Kernel Oil. It was decided that the SION are for general industry and change in norms to suit specific applicant. Accordingly it was decided that status quo may be maintained. Consideration of the case was deferred for relisting on 18.10.2007. No.599 M/s. Synergy Natural Cares, Delhi F.No.01/85/50/035/AM08/DES.VI. Export of Handicraft Soya Palm Wax Candles against import of Soya Wax, Palm Wax and perfumes etc. Adv. Auth. No.0510204785 Dt. 12.6.2007 (Para 4.7 of HBP) RLA, CLA, New Delhi Ref.No.05/24/40/142/AM08 DECISION TRANSFERRED TO NC NO.4 The Committee considered the case as per agenda. It was observed that the Export Product “Handicraft Soya Palm Wax Candles” falls under Chapter 34. As per O&MI No.13/2007 dated 3.9.2007 this product falls with jurisdiction of NC No.4. Auth No. 0210100478 dt. 1.5.2007 (Para 4.7 of HBP 2004-09) RLA, Kolkatta Ref.No. 02/24/40/29/AM08 DECISION APPROVED The Committee considered the case as per agenda. The committee observed that in the similar such cases for the export product “Shellac” from the imported item “Sticklac” it has been decided to allow a yield of 55% on imported quantity. It was also decided as under:-

(2) Where the export obligation quantity (yield) as a percentage of import product quantity is lower than 55%, the import quantity be reduced proportionately. Accordingly it was decided to allow import of 100,000 Kgs of Sticklac against export of 55,000 Kgs of Shellac. RA may be advised to ratify the Advance Authorisation accordingly under para 4.7 of the HBP subject to other usual terms and conditions of the Foreign Trade Policy/Procedure. The committee observed that in the similar such cases for the export product “Shellac” from the imported item “Sticklac” it has been decided to allow a yield of 55% on imported quantity. The committee observed that in the similar such cases for the export product “Shellac” from the imported item “Sticklac” it has been decided to allow a yield of 55% on imported quantity. It was also decided as under:- (1) Where applicant have applied for export obligation quantity higher than or equal to 55% yield on imported quantity, the case is approved as applied for. (2) Where the export obligation quantity (yield) as a percentage of import product quantity is lower than 55%, the import

The committee observed that in the similar such cases for the export product “Shellac” from the imported item “Sticklac” it has been decided to allow a yield of 55% on imported quantity. The committee deliberated on the case and decided to ratify the norms as per written comments of Technical Authority except import item No.4 namely “Synthetic Flavouring Essence” which shall not be allowed as it is not possible to correlate the imported inputs in the export product. The net import content of inputs (without wastage) shall be accounted for in the total export products to be exported. A complete set of documents submitted by the applicant be also forwarded to RA for working quantity of imports to be allowed in this case. Committee also decided that the applicant shall not be granted any repeat advance authorization on the basis of above IO norms and applicant may be asked to apply for fixation of SION. RA may be advised to ratify the advance authorization accordingly and also take suitable action in terms of the provisions of the Foreign Trade Policy/Procedure and subject to other usual conditions. The full form of Nutmeg (BWP) is Broken Wormy Punky Nutmegs. The representative of Spices Board informed that these are immature nuts before they are ripe. It was observed that in these cases SAR report about the yield of import consignment(s) from Spices Board is awaited. Applicant has applied for ratification of Advance Authorisation based on 18.14% yield in these cases. Accordingly the committee decided to ratify the Advance Authorisation in these

It was observed that in an earlier similar case considered in NC Meeting No.18/07 held on 10.8.2006 import has been allowed with 1% wastage. Accordingly it was decided to allow import of 5050 Kgs of " Xanathan Gum against export of 5000 Kgs of “Ground Xanathan Gum Powder (200 mesh size or above) Food/Technical grade with minimum 95% or above or powder content of the export product applied for. RA may be advised to ratify the advance authorization accordingly and also take suitable action in terms of the provisions of the Foreign Trade Policy/Procedure and subject to other usual conditions. No.615 M/s. Core Chemicals Private Limited, Mumbai F.No.01/85/162/315/AM08/DES.VI. Export of Refined Epoxidised Soyabean Oil against import of Refined Soyabean Oil. Issue of Advance Authorisation under para 4.4.2 of HBP 2004-09. RLA, Mumbai 03/94/40/85/AM08/ZLA DECISION DEFERRED The Committee considered these cases as per agenda. The committee decided to ask the applicant to furnish following information/details:- (a) ITC(HS) Classification of export product “Refined Epoxidised Soyabean Oil”. (b) Molecular weight of export product “Refined Epoxidised Soyabean Oil” duly certified by a Chartered Engineer. (c) Percentage Yield of import item “Refined Soyabean Oil” duly certified by a Chartered Engineer.
(d) Details of indigenous inputs alongwith quantity, required for production of per unit of export product, duly certified by a Chartered Engineer. It was also decided to remind DC(SSI) to expedite comments. A copy of application may also be referred to the Department of Chemicals and Petro-Chemicals for comments. Consideration of the case was deferred for relisting on 18.10.2007. No.616 M/s. Shingote Agro FoodsPvt. Ltd; Pune F.No. 01/85/162/498/AM08/DES-VI Modification of SION E-38 for inclusion of Guar/Bajra with other similar export products against import of Packing Material DECISION DEFERRED The Committee considered these cases as per agenda. It was decided to refer the case to APEDA for their comments as well as to furnish export data of “Guar and Bajra” for the last three years. It was also decided to refer the case to the Department of Agriculture (Trade Division) for comments. Consideration of the case was deferred for relisting on 18.10.2007. No.619 M/s. P.S.S. Krishnamurthi Exports (P) Ltd; Tuticorn. F.No. 01/85/162/312/AM08/DES-VI Fixation of SION for the export product “Plants and Parts of Plants in Packing material” against import of Relevant Packing Material. DECISION DEFERRED The Committee considered these cases as per agenda. Shellac & Forest Products EPC, Kolkatta has also forwarded a list of Minor Forest Produce Item as given in Appendix 37A of HBP (Vol.I) and requested for fixation of SION for the Packing Material as per Packing Policy i.e. import of relevant Packing Material in finished form with 1% wastage and in case of raw material of Packing Material with 5% wastage. The committee deliberated upon the list and decided that the description of export product “Plant and Parts of Plants” is too generic and may include a wide gamut of export products. produce items like Lac, Natural Gum and natural Resin/Gum Resins. Committee therefore decided to request Shellac and Forest Products EPC to forward list of Minor Forest Produce export items covered under ITC(HS) 1301 alongwith their export figures (itemwise) to consider the matter further.
