Singh, Jt. DGFT. At the outset the minutes of Norms Committee Meeting 17/08 held on 2.8.2007 were ratified by the committee. List of Members Present in the Meeting is at Annexure I. Grant of advance authorization under para 4.7. for restricted item of import. RLA, Kanpur Ref: No. 06/81/040/44/AM07. The Committee considered the case as per agenda. It was observed that the import “Bullock Pizzle” falls under the category of “Wild Animals including their Parts and Products”. The same are defined as Prohibited item in the Wild Life (Protection) Act 1972. The Restricted Items of Import as per ITC(HS)/Prohibited item is not covered under para 4.7 of the Hand Book of Procedure. The committee accordingly decided to reject the case. Party‛s representation has already been sent to MFPI on 18.6.2007. The indigenous angle is not applicable to Advance Licensing Scheme. It was decided to ask MFPI to furnish their written comments on the increase in the wastage requested by the applicant. Consideration of the case was deferred for relisting on 6.9.2007. No.436 M/s. The Committee observed that import of Crude Palm Oil of FFA 202% +/- 0.2% as mentioned against S.No.15 of ANF 4Aby the applicant, is not allowed to be imported under Advance Authorisation Scheme. It was observed that in this case SAR report about the yield of import consignment(s) from Spices Board is awaited. Applicant has applied for ratification of Advance Authorisation based on 2.00% yield in this case. Accordingly the committee decided to ratify the Advance Authorisation in this case as under:- (A) RA shall work out the EO as per yield percentage certified in the SAR of Spices Board against specified quantity of imports against each import consignment. 2004-2009 RLA Mumbai No.03/94/40/532/AM06 The committee considered the case as per agenda. It was observed that in the absence of drawn of samples an SAR could not be furnished by Spices Board. The applicant has imported only 21 MT of Turmeric and made exports for 1.60 MT of Curcumin Powder with 7.62% yield against the advance authorisiation obtained for import of 100 MT of Turmeric and made exports for 2.00 MT of Curcumin Powder with 2.00% yield. The committee on the basis of details of average exports from available records and specific comments of the representative of the Spices Board present in the meeting allowed imports with 7.62% yield as per production and consumption data furnished by application duly certified by a Chartered Engineer. No further import and export shall be allowed. It was also decided that no repeat advance authorisation on these basis shall be allowed to the applicant. It was also decided that the applicant may be informed that such a lapse should not be repeated in future, otherwise action will be taken under Spices Act 1987 and FT(D&R) Act, 1992. RA may be advised to ratify the Advance Authorisation under para 4.7 of the HBP for regularization purpose subject to other usual terms and conditions of the Foreign Trade Policy/Procedure.
