Case history: The case was rejected in Meeting No. 04/80-ALC2/2017dated 23.05.2017 due to non-submission of reply of deficiency letter raised by DIPP vide UO No.12/13/2017-TSW/81 dated 02/03/2017. However, the applicant had furnished the reply with a request to reconsider their case for fixation of the ad-hoc norms. The applicant’s representation was forwarded to MSME on 28.11.2018 followed by ID reminders on 17.09.2019, 10.01.2020 & 06.03.2020 for expediting the comments. On the advice of the representative of MSME, the case was forwarded to DPIIT on 04.01.2021 for examination & comments. DPIIT vide U. O. No. P- 47011/8/2021-TSW dated 10.03.2021 had informed that the applicant’s reply is incomplete. As decided in the Meeting No. 02/80 dated 16.06.2021, deficiency letter seeking following information as raised by DPIIT was sent to the applicant on 02.08.2021:

Detail technical drawings with dimension of each export product, Catalogue, if any, may also be furnished.

Weight of each Export Product.

Weight of each of the imported and indigenous input, separately for each product, for the purpose of material balancing. Net weight (Gross weight minus wastage) for each imported and indigenous input in the export product may be indicated. Net weight along with details of other imported input to be used in the resultant product and sought to be imported/procured from sources other than the license, if any, may also be indicated.

Starting from the specification of the export product, basic calculation as to how of raw material proposed for import has been arrived at, including the net weight of components to be manufactured out of these imported materials, wastages claimed at each stage of manufacturing with complete justification and supported by documentary evidence/drawings etc.

Detailed calculations for the quantities of import items.
As per NC decision, a deficiency letter, as raised by DPIIT, was sent to the applicant on 02.08.2021 followed by reminders on 24.09.2021, 10.11.2021 & 05.01.2022. The applicant vide email dated 18.01.2022 requested to give some more time to submit their reply of deficiency letter.
Decision: The Committee considered the case as per agenda and noted that the applicant’s reply has been sent to DPIIT on 31.03.2022 for examination & comments. Further, it was noted that physical copy of the applicant’s reply was also sent to DPIIT on 25.04.2022. However, no comments have been received as yet. Therefore, the Committee decided to remind DPIIT for expediting the comments.

No.: 01/80/050/00073/AM16 Subject: Request for RLA No.: 53/21/040/00002/AM10 fixation of ad-hoc norms Case history: In the Meeting No. 11/80 date 30.11.2018, the representative of MSME stated that the norms may be fixed on the basis of DIPP recommendation vide No. 07/9/20l6-TSW dt. 08.12.2017 for License No. 5310019514 dt. 05.10.2017 as ratified in Meeting No. 16/80 dated 14.11.2017. However, the Committee observed that the description of export item in the subject application does not exactly match with the recommendation of DIPP and therefore, MSME was requested to provide comments. Based on the deliberations & as per advice of MSME, the Committee decided that Consultant (Tech -1) may look into the matter. Hence, the case was referred to Consultant (Tech -1) on 16.10.2019 for examination & comments . Consultant (Tech-1) informed that a similar case of the applicant had already been referred to PLEXCONCIL and Department of Chemicals & Petrochemicals . PLEXCONCIL vide email dated 17.12.2019 had requested for 15 days’ time to reply the query. No information had been received from Department of Chemicals & Petrochemicals. PLEXCONCIL was reminded on 12.02.2020 for the expediting the matter. PLEXCONCIL’s reply was received and forwarded to Consultant (Tech-1) on 11.03.2020 for examination of the case. However, Consultant (Tech-1) informed in the meeting that PLEXCONCIL reply mentions Acetic Anhydride as the export product, which does not make any sense. Also, a D.O. Letter was sent to JS, Department of Chemicals & Petrochemicals on 30.07.2020 to provide their comments in the matter at the earliest. Subsequently, a reminder along with copy of application was sent to Department of Chemicals & Petrochemicals on 09.03.2021 for examination & comments. As decided in the Meeting No. 02/80 dated16.06.2021, a reminder was issued on 02.08.2021. Further, as decided in meeting dated 02.09.2021, the reminder was issued on 29.09.2021. Also, as per NC decision, final reminder [Letter] was sent to Department of Chemicals & Petrochemicals on 05.01.2022 for expediting the comments. In NC meeting dated 08.02.2022, it was decided to seek opinion of Consultant (Tech-1) in this matter as no information had been received from Department of Chemicals & Petrochemicals despite several reminders. As per NC decision, an email was sent to Consultant (Tech-1) on 11.03.2022. Consultant (Tech-1) via email dated 20.05.2022 has requested to send physical file of the case and the same was sent to Consultant (Tech-1) on 25.05.2022. However, no comments have been received yet.
Decision : The Committee considered the case as per agenda and decided to wait for the comments.

Case history: The Committee considered the case as per agenda and noted that the case was rejected in Meeting No. 09/80 dated 01.08.2017 due to non-submission of reply of deficiency letter raised by DIPP. However, the firm had furnished the reply with a request to re-open case and fix the ad-hoc norms. The Committee reconsidered the case in its meeting dated 20.10.2020. However, the applicant requested to re-fix the norms and to allow them for Personal Hearing .
The applicant appeared for PH in NC Meeting 09/80 dated 14.09.2019 and explained the reason for higher wastage claims. Based on the deliberations, the Committee decided that Consultant (Tech 1) would look into the matter. Consultant (Tech-1) pointed out that applicant is requesting to increase the wastage norms for PVC compound from 10% to 16% on the basis of Department of Chemicals & Petrochemicals suggestion vide letter dated 10.09.2012 for amending the SION H-67 and AA of the applicant had been ratified based on SION H-67 which allows for only 10%. Consultant (Tech-1) suggested that PLEXCONCI L may be requested to provide Production/Consumption data of other manufacturers. The case was referred to PLEXCONCIL, Department of Chemicals & Petrochemicals on 18.10.2019 & 05.11.2019 respectively. However, PLEXCONCIL vide email dated 17.12.2019 had requested for 15 days’ time to reply the query. No information had been received from Department of Chemicals & Petrochemicals . The Committee noted that Department of Chemicals & Petrochemicals and PLEXCONCIL were reminded on 12.02.2020 for expediting the matter. PLEXCONCIL’s reply was received and forwarded to Consultant (Tech-1) on 11.03.2020 for examination. However, Consultant (Tech-1) informed in the meeting that PLEXCONCIL reply mentions Acetic Anhydride as the export product, which does not make any sense. Also, a D.O. Letter was sent to JS, Department of Chemicals & Petrochemicals on 30.07.2020 to provide their comments in the matter at the earliest. Further, a copy of application was sent to Department of Chemicals & Petrochemicals on 09.03.2021 for examination & comments. The case was considered by NC in its meeting dated 08.02.2022 and noted that the applicant’s reply was sent to DHI on 10.11.2021 for examination & comments. DHI vide letter dated 08.02.2022 informed that the applicant’s reply letter didn’t contain any new information and the comments sent by DHI earlier as per letter dated 01.11.2017 still holds good. However, the Committee noted that DHI in its comments has not mentioned about the specific deficiencies which are required to examine the case. The earlier comments sent as per letter dated 01.11.2017 are also not found. Therefore, the Committee decided to request DHI to give fresh comments in this matter.
The case was last considered in the meeting dated 31.03.2022 and the committee noted that DHI had furnished the comments vide email dated 23.03.2022 stating that there is no new information. The applicant had again confirmed that basically there was only punching of holes in the steel cord. Technically, whole manufacturing operation should not result in value addition of 342% (in Rs terms more than 80 lakhs). DHI had given comments stating that the above issue is not a technical matter. | efforts for filing the aid online application initially the portal was not allowing | to file the |
| application itself as the licence was tagged under the SION norms category. The import items | |

upload each of the items they have been facing issue of auto logout from the portal with data already posted not being saved. Now, they have requested to accept their application for norms fixation in the physical form.
The Committee reconsidered the case as per agenda and noted that the firm’s representation was forward to DHI on 19.08.2021 for examination of the case. The representative of DHI asked for background of the case. Therefore, the Committee decided to seek detailed background note along with c complete application with all enclosures like appendix 4E, Appendix4 K & Appendix 4H. As per NC decision,a deficiency letter as raised by DHI was sent to the applicant on 29.09.2021 followed by a reminder on 11.11.2021.
The case was considered in the meeting dated 31.03.2022 and the Committee noted that the case was erroneously rejected by the NC in its meeting dated 08.02.2022. The applicant had submitted the reply of deficiency letter as raised by TE on 15.12.2021. Therefore, the Committee decided to forward the applicant’s reply to TE, Consultant (Tech-3) for examination and comments. As per NC decision, the case was referred to Consultant (Tech-3) on 20.05.2022 for examination & comments. However, no comments have been received as yet.
Decision: The Committee considered the case as per agenda and decided to remind Consultant (Tech-3) for expediting the comments.

The applicant’s representation was sent to DHI on 29.12.2021. The applicant has furnished the complete information via email dated 07.04.2022 & the same was sent to DHI via email dated 08.04.2022 for examination & comments. The matter was deliberated in the meeting and it was noted that earlier, the import item at Sl. No. 91 was deleted as it was not covered under Para- 4.1.3.1 of FTP-2009-14 and the import item at Sl. No. 113 was allowed with 10% wastage. Now, the applicant has requested to allow the import items at Sl. No. 91 of 2 Number & for import item at Sl. No. 113 has requested to allow as applied for. The applicant vide their representation dated 29.04.22 has stated that they are a 100% Export Oriented Unit having Letter of Permission (LOP) No. PER:241(1998) EOB/215/98 dated 17.11.1998 as amended and the LOP has been renewed for a further period of five years from 2019-20 to 2023-24 vide letter No SEEPZ-SEZ/EOU/28/48/98-99/V-X/10864 dated 30.06.2021 for manufacture and export of vide range of products mainly applicable for electrical industries. The applicant has submitted the application for fixation of the scrape wastage norms for the scrape arising out of the production process during the year 2021-22 as per their application.
