Case history: The case was rejected in Meeting No. 04/80-ALC2/2017dated 23.05.2017 due to nonsubmission of reply of deficiency letter raised by DIPP vide UO No.12/13/2017-TSW/81 dated 02/03/2017. However, the applicant had furnished the reply with a request to reconsider their case for fixation of the ad-hoc norms. The applicant’s representation was forwarded to MSME on 28.11.2018 followed by ID reminders on 17.09.2019, 10.01.2020 & 06.03.2020 for expediting the comments. On the advice of the representative of MSME, the case was forwarded to DPIIT on 04.01.2021 for examination & comments. DPIIT vide U. O. No. P-47011/8/2021-TSW dated 10.03.2021 had informed that the applicant’s reply is incomplete. As decided in the Meeting No. 02/80 dated 16.06.2021, deficiency letter seeking following information as raised by DPIIT was sent to the applicant on 02.08.2021:

  1. Detail technical drawings with dimension of each export product, Catalogue, if any, may also be furnished.

  2. Weight of each Export Product.

Starting from the specification of the export product, basic calculation as to how of raw material proposed for import has been arrived at, including the net weight of components to be manufactured out of these imported materials, wastages claimed at each stage of manufacturing with complete justification and supported by documentary evidence/drawings etc.

However, the Committee observed that the description of export item in the subject application does not exactly match with the recommendation of DIPP and therefore, MSME was requested to provide comments.

Consultant (Tech-1) informed that a similar case of the applicant had already been referred to PLEXCONCIL and Department of Chemicals & Petrochemicals . PLEXCONCIL vide email dated 17.12.2019 had requested for 15 days’ time to reply the query. No information had been received from Department of Chemicals & Petrochemicals. PLEXCONCIL was reminded on 12.02.2020 for the expediting the matter. PLEXCONCIL’s reply was received and forwarded to Consultant (Tech-1) on 11.03.2020 for examination of the case. However, Consultant (Tech-1) informed in the meeting that PLEXCONCIL reply mentions Acetic Anhydride as the export product, which does not make any sense. Also, a D.O. Letter was sent to JS, Department of Chemicals & Petrochemicals on 30.07.2020 to provide their comments in the matter at the earliest. Subsequently, a reminder along with copy of application was sent to Department of Chemicals & Petrochemicals on 09.03.2021 for examination & comments. As decided in the Meeting No. 02/80 dated16.06.2021, a reminder was issued on 02.08.2021.

However, the applicant requested to re-fix the norms and to allow them for Personal Hearing .

The applicant appeared for PH in NC Meeting 09/80 dated 14.09.2019 and explained the reason for higher wastage claims. Based on the deliberations, the Committee decided that Consultant (Tech 1) would look into the matter. Consultant (Tech-1) pointed out that applicant is requesting to increase the wastage norms for PVC compound from 10% to 16% on the basis of Department of Chemicals & Petrochemicals suggestion vide letter dated 10.09.2012 for amending the SION H-67 and AA of the applicant had been ratified based on SION H-67 which allows for only 10%. Consultant (Tech-1) suggested that PLEXCONCI L may be requested to provide Production/Consumption data of other manufacturers. The case was referred to PLEXCONCIL, Department of Chemicals & Petrochemicals on 18.10.2019 & 05.11.2019 respectively. However, PLEXCONCIL vide email dated 17.12.2019 had requested for 15 days’ time to reply the query.

The Committee also noted that the case was referred to DHI on 31.10.2020 and the recommendation of the DHI is still inconclusive. Case history: The applicant has stated that they are a 100% Export Oriented Unit having letter of permission (LOP) No. KASEZ/100%EOU/II/08/09-10/11623 dated 23.11.2009 are the Member of EPC for EOUs and KSEZs. The applicant has stated that the company is an EOU unit and it is registered with Kandla Special Economic Zone (KASEZ) and there is a requirement by KASEZ that EOU unit needs to fix the norms of its export product. The applicant vide their representation dated 11.01.2020 had requested for fixation of input/output Norms for the import/export products.

The copy of application was sent to MSME on 08.09.2020 for examination of the case. As per comments of MSME received via email dated 16.06.2021, a deficiency letter was sent to the applicant on 13.08.2021 for furnishing the following information :

Further, the value addition of more than 300% is not possible with the type of activity involved. The applicant has also clarified that they were executing a turnkey cement plant and had increased value of items supplied initially to get more money from the buyer at the initial stage. The matter was deliberated in the meeting and the committee observed that this is an old case having licence of the year 2015. The justifications submitted by the applicant are also found unconvincing. Therefore, committee decided to call the applicant on personal hearing during the forthcoming meeting of the Norms Committee to explain their case.
