DPIIT vide U. O. No. P-47011/289/2018-TSW dated 20.12.2021 and decided to seek opinion of Consultant (Tech-3) in this matter. As per NC decision, the case was forwarded to Consultant (Tech-3) on 11.03.2022 for his opinion. However, no comments have been received as yet.

Case history: The case was rejected in Meeting No. 06/80-ALC2/2018 dated11.07.2018 on the ground that the parts of the import items given (Unit of Measurement) in sets and number of parts in each set and their composition is not known. The Committee found that it was very difficult to enforce accountability and rejected the case. However, the applicant had requested for review of the case. The firm had given representation dated 25.02.2019 enclosing a statement giving composition along with unit of measurement in numbers against each set of imported items. The Committee reconsidered the case and noted that the applicant’s representation was sent to DHI for examination on 21.02.2020 followed by a reminder on 15.10.2020. Further, reply of deficiency received from the applicant was sent to DHI via email on 14.06.2021 to examine the case. DHI has given their comments dated 16.11.2021. The case was discussed in meeting dated 16.11.2021 and the Committee observed that DHI had recommended very high wastage for certain import items. However, name of raw material & shape were not mentioned in the description of import items neither in ANF-4A/Condition Sheet nor in the comments of DHI. Therefore, the Committee decided to get clarification on the same from the applicant & DHI for the import items at Sl. Nos. 13, 22, 48 to 53, 79 to 82, 85 to 88, 327 & 328. As per NC decision, an email was sent to the applicant & DHI on 05.01.2022. The applicant’s reply against email dated 05.01.2022 was sent to DHI on 07.02.2022 for comments. Decision : The Committee considered the case as per agenda and noted that DHI vide email dated 16.02.2022 has stated that the recommended wastages for import items are reasonable. Also during deliberation in the meeting, the representative of DHI has reiterated that the recommended wastage are reasonable for import items as given in the DHI’s letter dated 16.11.2021. Therefore, the Committee decided to fix the ad-hoc norms as per comments given by DHI vide letter dated 16.11.2021 as under:

The export weight is 1600MT is to be incorporated in the Advance Authorization.
Quantity of import items at Sl. No. 13, 22, 79 to 82, 327 & 328 may be allowed as 1.05Kgs/Kg content in the export product.
Quantity of import item at Sl. No. 48 may be allowed with net wastage of 390% after recovery of 10%.
Quantity of import item at Sl. No. 49 may be allowed with net wastage of 711% after recovery of 10%.
Quantity of import item at Sl. No. 50 may be allowed with net wastage of 387% after recovery of 10%.
Quantity of import item at Sl. No. 51 may be allowed with net wastage of 695% after recovery of 10%.
Quantity of import item at Sl. No. 52 may be allowed with net wastage of 290% after recovery of 10%.
Quantity of import item at Sl. No. 53 may be allowed with net wastage of 334% after recovery of 10%.
Quantity of import item at Sl. No. 85 may be allowed with net wastage of 268% after recovery of 10%.
Quantity of import item at Sl. No. 86 may be allowed with net wastage of 264% after recovery of 10%.
Quantity of import item at Sl. No. 87 may be allowed with net wastage of 186% after recovery of 10%.

Import item at Sl. No. 208 may be deleted as it is a kit.
For import items at Sl. No. 319, 322 & 323, the words form description “ Rough Machining ” may be replaced with the words “ Finished Machining ”.
Import items at Sl. No. 33, 39, 68, 76, 117, 306 to 318, 326, 329 & 331 may be deleted as requested by the applicant.
Import item at Sl. No. 333 may be deleted as the applicant has not submitted the drawing & calculation of import item.
Quantity of import item at Sl. No. 330 may be allowed as per DGFT’s Policy of Consumable items .
Quantity of rest of import items may be allowed as per GN-4 with nil wastage & accountability clause . ( Weight of components given in weight balance are to be incorporated in Advance Authorization )

Case history: The Committee considered the case as per agenda and noted that the subject AA has not been considered in any of the NC meeting for fixation of ad-hoc norms yet. Further, the Committee noted that the applicant’s representation was forwarded to DHI to examine the case on 15.05.2021 followed by a reminder on 13.08.2021. DHI vide their mail dated 01.07.2021 has conveyed that the case is very old and the following documents are required to examine the case: 1. Background note on the case giving the NC decision/ Deficiency letter along with the corresponding reply in a chronological order. 2. Complete application with ANF 4B with all enclosures like appendix 4E, Appendix4 K & Appendix 4H. The applicant’s reply was sent to DHI on 29.09.2021 for examination & comments. The representative of DHI informed vide letter dated 16.11.2021 that the applicant’s reply was incomplete and they did not furnish the point-wise reply as per deficiency letter. Therefore, the Committee decided to ask again from the applicant for furnishing the requisite information within 15 days: 1. Background note on the case giving the NC decision/ deficiency letter along with the corresponding reply in a chronological order. 2. Complete application with ANF 4B with all enclosures like appendix 4E, Appendix4 K & Appendix 4H. The case was last considered in meeting dated 08.02.2022, the Committee noted the comments of DHI received vide letter dated 08.02.2022 wherein it was stated that the applicant had proposed to fix ad-hoc norms for import of 42 items instead of 118 items applied earlier against the subject AA Number. Further, the Committee noted that the Consumption Certificate/ accountability statement submitted by the applicant contains a list of 45 import items in which one item at Sl. No. 67 is repeated. Therefore, the Committee decided to seek clarification on the same from the applicant & DHI.

The applicant’s clarification received and the same was forwarded to DHI for examination & comments.

Decision: The Committee considered the case as per agenda and noted the comments of DHI received vide email dated 14.01.2022 & 02.03.2022. Further, DHI has clarified that the applicant has requested to fix ad-hoc norms for import of 44 items instead of 118 items applied earlier against the subject AA Number. The list of 44 items is as per the accountability statement submitted by the applicant (Copy enclosed). Therefore, as per comments of DHI, the Committee decided to fix the ad-hoc norms as under:

The total export weight is 2214.30MT and it may be added in the description of export item.
The quantity of import items at Sl. No. 25 ( SS Blade Profiles ) may be allowed with 10% wastage on repeat basis as approved for AA No. 0910037842 dated 06.05.2009.
The quantity of import items at Sl. No. 26 ( SS Flats ) may be allowed with 370% wastage on repeat basis as approved for AA No. 0910037842 dated 06.05.2009.
The quantity of import items at Sl. No. 28 ( SS Strip ) may be allowed with 2% wastage
The quantity of the rest of the import items as mentioned in the accountability statement (Copy enclosed) may be allowed as per GN-4 with accountability clause with no wastage on weight or number terms.

Note: RA concerned may ensure before issuing the EODC that no court case or any other ECA action against the subject AA number is pending.

RA concerned may take further necessary action as per the decision of NC.
