Meeting No.NC/1/MEET/Jan/202122/12 (Offline Cases) of the Norms Committee (NC-I) for the licensing year 2021-2022 was held on 08.02.2022 under the Chairmanship of Shri Akash Taneja, Additional Director General of Foreign Trade to consider the applications under Duty Exemption/Remission Schemes (Chapter-4) of the applicable Foreign Trade Policy and the Handbook of Procedures. The following Members of the Committee were present in the meeting:

  1. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RA should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC.

  2. Wherever the Committee has fixed norms, the RAs should allow inputs as per wastage norms approved or as applied, whichever is less.

Case history: In the Meeting No. 11/80 date 30.11.2018, the representative of MSME stated that the norms may be fixed on the basis of DIPP recommendation vide No. 07/9/20I6-TSW dt. 08.12.2017 for License No. 5310019514 dt. 05.10.2017 as ratified in Meeting No. 16/80 dated 14.11.2017. However, the Committee observed that the description of export item in the subject application does not exactly match with the recommendation of DIPP and therefore, MSME was requested to provide comments. Based on the deliberations & as per advice of MSME, the Committee decided that Consultant (Tech -1) may look into the matter. Hence, the case was referred to Consultant (Tech -1) on 16.10.2019 for examination & comments. Consultant (Tech-1) informed that a similar case of the applicant had already been referred to PLEXCONCIL and Department of Chemicals & Petrochemicals. PLEXCONCIL vide email dated 17.12.2019 had requested for 15 days’ time to reply the query. No information had been received from Department of Chemicals & Petrochemicals. PLEXCONCIL was reminded on 12.02.2020 for the expediting the matter.

Subsequently, a reminder along with copy of application was sent to Department of Chemicals & Petrochemicals on 09.03.2021 for examination & comments. As decided in the Meeting No. 02/80 dated16.06.2021, a reminder was issued on 02.08.2021. Further, as decided in meeting dated 02.09.2021, the reminder was issued on 29.09.2021. Also, as per NC decision, final reminder [Letter] was sent to Department of Chemicals & Petrochemicals on 05.01.2022 for expediting the comments. However, no information has been received so far.

Decision: The Committee considered the case as per the agenda and noted that no information has been received from Department of Chemicals & Petrochemicals despite several remainders. Therefore, the Committee decided to seek the opinion of Consultant (Tech-1) to expedite the matter.

SI. No. 03 Status: Cases) dated 08.02.2022 Engineers Ltd. Subject: Request for fixation of Case history: The case was rejected in the Meeting No. 09/80 dated 01.08.2017 due to nonsubmission of reply of deficiency letter raised by DHI. The case was reconsidered in M.No. 07/80 dated 22.10.2020 and it was decided to send a deficiency letter to the applicant as per comments of DHI. In response to DL, applicant’s reply dated 23.11.2020, was sent to DHI on 01.12.2020. DHI informed that the applicant's reply had Appendix 4K dated 04.06.2016 only and not contained information as sought in M. No. 07/80 dated 22.10.2020 (Held on 23.10.2020). Therefore, as decided in the Meeting No. 02/80 dated 16.06.2021, a deficiency letter was issued to the applicant on 17.08.2021 for furnishing the following information:

Since, they had stated that the export product is not under the purview of DIPP/ DHI, it was forwarded to MSME on 18.03.2019 followed by reminders on 24.09.2019, 10.01.2020 & 12.02.2020. A deficiency letter (To provide excel sheet of calculations) was sent to the applicant as per comments of MSME received via email dated 22.10.2020. The applicant's reply was sent to MSME on 18.11.2020 to examine the case. MSME via email dated 16.06.2021 has asked to submit certain information. However, the applicant requested to re-fix the norms and to allow them for Personal Hearing. The applicant appeared for PH in NC Meeting 09/80 dated 14.09.2019 and explained the reason for higher wastage claims. Based on the deliberations, the Committee decided that Consultant (Tech 1) would look into the matter. Consultant (Tech-1) pointed out that applicant is requesting to increase the wastage norms for PVC compound from 10% to 16% on the basis of Department of Chemicals & Petrochemicals Suggestion vide letter dated 10.09.2012 for amending the SION H-67 and AA of the applicant had been ratified based on SION H-67 which allows for only 10%. Consultant (Tech-1) suggested that PLEXCONCIL may be requested to provide Production/Consumption data of other manufacturers. The case was referred to PLEXCONCIL, Department of Chemicals & Petrochemicals on 18.10.2019 & 05.11.2019 respectively. However, PLEXCONCIL vide email dated 17.12.2019 had requested for 15 days’ time to reply the query. No information had been received from Department of Chemicals & Petrochemicals.

The Committee found that it was very difficult to enforce accountability and rejected the case. However, the applicant had requested for review of the case. The firm had given representation dated 25.02.2019 enclosing a statement giving composition along with unit of measurement in numbers against each set of imported items. The Committee reconsidered the case and noted that the applicant's representation was sent to DHI for examination on 21.02.2020 followed bya reminder on 15.10.2020. Further, reply of deficiency received from the applicant was sent to DHI via email on 14.06.2021 to examine the case. DHI has given their comments dated 16.11.2021.

The case was discussed in meeting dated 16.11.2021 and the Committee observed that DHI had recommended very high wastage for certain import items. However, name of raw material & shape were not mentioned in the description of import items neither in ANF-4A/Condition Sheet nor in the comments of DHI.
