Case History: This is regarding Order dated 06.06.23 of Madras High Court in W.P.No.26422 of 2015 in M/s. Xomox Sanmar Ltd. Vs. The DGFT & Anr., received vide mail dated 23.06.23.

In the said petition, the petitioner has challenged DES-I’s letter No.01/80/050/00670/AM11/DES.1/1162 dated 12.08.14 whereby the request of the petitioner for ratification of norms in respect of Advance License No.0410120070 dated 23.12.2010 was rejected by NC-I in its meeting No.07/15 dated 24.06.14 on the grounds that the items of export as well as items of imports are valves and there is no manufacturing activity involved because upon manufacturing a new product with distinctive named should come into existence.

a; Vide Order dated 06.06.23 (copy enclosed), the court has set aside the impugned order and remanded the matter to the file of Respondent 1, to be decided afresh and in line with the discussion in the said order after ascertaining if the petitioner has in fact, made any additions to the imported valves by procurement of indigenous products.

  1. Consequent upon this order, RA, Chennai asked the petitioner to file a representation afresh. In compliance, the petitioner has forwarded their letter dated 20.12.23 vide mail dated 20.12.23, wherein the details of their earlier representation dated 07.04.11 and supporting documents are mentioned. The petitioner has requested that it may be given an opportunity of being heard before any orders are passed in this matter.

  2. Subsequently, the case was considered by NC-1 in its meeting dated 03.01.24 and the Committee decided to call the applicant in PH in the forthcoming meeting to explain the case in detail. Accordingly, the firm was called for PH before NC-1 on 19.02.24. 7. The representative of the firm, Shri V. Guruprasath, AVP, M/s XomoXSanmar Ltd appeared for the PH on 19.02.2024 and briefed the case before the committee. He informed that they had supplied items after fitment of various indigenous items like gear boxes, actuators, limit swishes etc. and testing. After deliberations, the Committee decided to call the applicant in the next meeting along with the following information/documents: (i) Copy of application made at the time of getting Advance Authorization (ii) Copy of Advance Authorization (iii) Details of import and export items (iv) Details of indigenous inputs used (v) Copies of Bill of export showing items supplied to SEZ against the AA. (vi) Details of deemed export (vii) Any other documents relevant to the case.

It was requested by them that some more time (40 days) may be given to collect the requisite documents as sought in earlier meeting. No. 15/80-ALC2/2018 dated 06.03.2019 as per the written comments of DHI vide their U.O. No. 3/96/2016/TSW(B) dated 24.12.2018. However, the applicant had requested for review of already fixed ad-hoc norms. The Committee reconsidered the case and noted that a deficiency letter seeking following information as raised by DHI was sent to the applicant on 24.02.2020 followed by reminders on 06.11.2020 & 06.08.2021:

The firm vide email dated 19.02.2021, 06.03.2021 & 10.08.2021 has furnished the technical documents containing Manufacturing Process and Nesting Diagram indicating scrap/wastage for Raw Materials and requested to fix the ad-hoc norms. GM, Manish Kumar, AGM(F & A) & Nagendra Mishra, Manager attended the PH and briefed the committee in detail. MHI has pointed out that data provided by BEML is inconsistent and not complete. It has been assured by the representatives of firm that rectified & authenticated data in respect of referred items would be provided within a week. After due deliberation, the committee decided to wait for the rectified data and the complete information from the firm and on receipt of the same, MHI would examine the case expeditiously.

Thereafter, vide mail dt.11.01.24, the detailed information/data received from the firm was forwarded to MHI for examination and comments. Comments of MHI has been received vide OM dt.05.03.24.

The above mentioned three licenses relate to execution of a deemed export order for supply of 12 DT Cars supplied to OMRC and the import items mentioned in the list are required for manufacturing of these DT cars .
