The Committee noticed that the firm has
applied in ANF4A which is devised for authorization under para 4.7 of Handbook of Procedures Vol.I. However, RA has forwarded firm’s application without issuing authorization under para 4.7 for considering the same in terms of para 4.4.2 of Handbook of Procedures Vol.I. The Committee has withdrawn the case from the agenda and decided to seek clarification from RA.

The Committee noted that the representation is not factually correct as the quantity originally applied for was 40 MT of brass scrap and not 35MT as indicated by the firm in its representation and that the Committee has worked out the import quantity correctly. The Committee accordingly decided to reject the firm’s request for revision of norms and decided to maintain earlier NC decision.

The case regarding revision of norms in respect of above advance authorization was considered by the Norms Committee (NCI) in its M.No.09/10 held on 02.06.2009 as per the agenda. The Committee noted that the firm wanted to enhance the quantity of one import item and reduce the quantity of another import item as both the items can be substituted in place of each other. The Committee decided to ask to firm to produce documentary evidence to establish that item No. 2 & 3 namely “HDPE / MDPE” and “LDPE / LLDPE” respectively are accounted for in the export product under the subject authorization. The case regarding revision of norms in respect of above advance authorization was considered by the Norms Committee (NCI) in its M.No.09/10 held on 02.06.2009 as per the agenda. The Committee noted that the subject authorization was issued by RA as per SION C1708. The firm now requested to allow import of “FIR LUMBER” in place of import item no. 17 i.e. “PINE LUMBER” in view of its non availability in international market on competitive terms. The Committee decided to examine the possibility of amendment of norms in such case w.r.t. Policy Circular 20 and other policy provisions. The case may be relisted on 21.07.2009.

The case regarding modification of SION C562 was considered by the Norms Committee (NCI) in its M.No.09/10 held on 02.06.2009 as per the agenda. The Committee noted that the applicant firm is an 100% EOU and his request for modification of SION C562 can not be exceeded to as the SION was fixed after taking recovery for the scrap generated during the manufacturing process and for EOUs the concept of recovery does not apply.
