Case No.01 M/s  Glenmark Pharmaceuticals Limited Mumbai

F.No.  01/60/162/32/AM12/EFGC(PRC) PRC Meeting No. 07/AM12 dated: 26.05.2011 Subject:­  Request for EOP extension of advance authorization No. 0310415372 dt. 10.1.2007 issued under Policy Circular No. 9 dt. 30.6.2003   The Committee decided to extend EOP against the aforesaid advance authorization for six months i.e. total 12 months from the date of first import for the purpose of regularization and closure subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher. The Committee also decided  that the condition of re­export/destruction of imported raw material as stipulated in Policy Circular 18 dt. 30.10.2007 be waived as the firm has stated to have already utilized the imported material fully by exporting the product manufactured from these.  However, the default in terms of duty saving proportionate to the default in export outside the prescribed EO period may be paid by the firm in accordance with the stipulated policy provisions.  RA to check and verify the aspect of raw material utilization and evaluate the duty­saving default and take necessary action as per the policy provisions.

  The Committee noted that the firm have made nil exports during the valid EOP and, therefore, it was decided to reject the case as it does not merit consideration due to no exports made both quantity and value wise in the valid EOP.

  The Committee noted the request of the firm and decided to reject as no cogent and justified reasons establishing genuine hardship have been provided by the firm.

Subject:­ Request for EOP extension of advance licence No. 0310406570 dated 3.11.2006

  The Committee decided to grant EOP extension for upto last date of export i.e.  06.09.2010 for the purpose of regularization and closure, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher.    

Case No.05  M/s  Alkem Laboratories Limited Mumbai

F.No. 01/60/162/104/AM12/EFGC(PRC) Subject:­  Request of EOP extension of advance licence No. 0310407931 dt. 14.11.2006 issued    under Policy Circular No. 9 dt. 30.6.2003.   The Committee considered the request of the firm and noted that the request has been made only for the purpose of regularization of export made outside the valid EOP. The Committee decided to grant extension for 3 months  i.e.  9 months from the date of first import  for the purpose of regularization and closure, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to exports beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and ensure a value addition of minimum 15% or as stipulated in the authorization whichever is higher.

Case No.06  M/s Continental Device India Limited Punjab

Subject:­ Request for EOP extension of advance licence No. 2210007450 dt. 13.2.2008

  The Committee noted that EO fulfilled against aforesaid Advance Authorization No. 2210007450 dt. 13.2.2008 was 87% Qty.­wise within the valid EOP.  Therefore,  the  Committee  decided  to  extend  EOP  against  the  aforesaid  advance  authorization  for  six  months  from  the  date  of communication, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to exports beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher.  

Case No.07  M/s. Amoli Organics Pvt. Ltd Mumbai

F.No. 01/60/162/1194/AM11/EFGC(PRC) Subject:­  Request for EOP extension of advance licence no. 0310442171 dt. 7.9.07 issued under Policy Circular No. 9 dt. 30.6.2003.   The Committee considered the request of the firm and noted that the request has been made only for the purpose of regularization of export made outside the valid EOP. The Committee decided to grant extension for 5 months  i.e.  11 months from the date of first import  for the purpose of regularization and closure, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to exports beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and ensure a value addition of minimum 15% or as stipulated in the authorization whichever is higher.  

Case No.08  M/s.  Granules India Limited

F.No 01/60/162/1988­90/AM11/EFGC(PRC) Subject:­Request for EOP extension and conversion of export product of 3 advance licence no. 0910026310 dt18.5.06 (ii)  0910027291 dt. 9.8.06 (iii) 0910027017 dt. 25.7.06.   The Committee noted that the firm have made less than 50% exports during the valid EOP and, therefore, it was decided to reject the case as it does not merit consideration due to low exports made both quantity and value wise in the valid EOP.    

Case No.09  M/s. Alembic Limited Vadodara

F.No  01/60/162/837/AM11/EFGC(PRC) Subject:­ Revalidation of advance licence No. 3410018078 dt. 13.7.07 for clubbing with adv. Lic No. 34100015179 dt. 6.1.2006.

The Committee considered the request for clubbing of  two above authorizations. It was noted that the authorizations have not been issued in continuity with a distinct overlap in the validity period. The Committee therefore did not agree to club the authorizations.

  The Committee noted that the firm have made less than 50% exports during the valid EOP and, therefore, it was decided to reject the case as it does not merit consideration due to low exports made quantity wise in the valid EOP.    

Case No.12 M/s. Plethico Pharmaceuticals Limited Indore

F.No  01/60/162/48/AM12/EFGC(PRC) Subject:­   Request  to  regularize the exports as per PN ­2 dt. 27.8.2009 (i.e change of EO period from 6 months to 12 months from the date of 1st import) for EO fulfilled against advance licence no. 1110020704 dt. 20.7.2009 as per policy circular no. PC­9 dt. 30.6.2003.   The Committee considered the request of the firm and noted that the request has been made only for the purpose of regularization of export made outside the valid EOP. The Committee decided to grant extension for 2 months  i.e.  8 months from the date of first import  for the purpose of regularization and closure, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and ensure a value addition of minimum 15% or as stipulated in the authorization whichever is higher.

  The Committee noted that EO fulfilled against aforesaid Advance Authorization No. 1110013333 dt. 5.5.2006 was more than 50% both Qty.  wise and value wise within the valid EOP. Therefore, the Committee decided to extend EOP against the aforesaid advance authorization for six months from the date of communication, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher.    

Case No.23 M/s.    Uni­Med (India) Mumbai

F.No.     01/60/162/1339/AM11/EFGC(PRC) Subject:­  Request for EOP extension of advance licence no. 0310498271 dt. 16.12.2008 issued under Policy Circular No. 9 dt. 30.6.2003 for further export.   The Committee noted that the firm have made a request for EOP extension of above mentioned advance authorization after the period of expiry of more than 1½ year from the date of expiry of export obligation.  The Committee rejected the request of the firm as there are no merits for consideration due to highly delayed request.

F.No. 01/89/180/20/AM09/PC­2(A) Subject:­  Request for policy relaxation for import of 2 nos. of Trailer – Mounted Oil Well Drilling Rig manufactured with left hand steering and control   The Committee considered and approved the request of M/s Focus Energy Limited New Delhi  for import of 2 nos. of Trailer – Mounted Oil Well Drilling Rig manufactured with left hand steering and control in relaxation of the provisions of Para 2(II) (a) (ii) (b) and (c) (i) (ii) (iii)  of Import Licensing Note of Chapter 87 of ITC (HS).  The permission is subject to the condition that the vehicles would not ply on the public roads and would be use only on project site.
