    The Committee noted that the firm had generated E­com file on 17.3.2006 however could not file application due to non availability of shipping bill in server and  on the basis of the technical records, the Committee decided to  accept the request for issue of  DEPB after imposing a cut of 10% on the entitlement as offered by the party. This cut is imposed because shipping bills were transmitted in the server and were appearing in the system in the month of December 2009, however the application was submitted to claim DEPB on 3.6.2011. F.No. 01/60/162/315/AM13/EFGC(PRC) Subject:­  Request for relaxation of endorsement of advance authorization No. 0510175413 dated 30/01/2006 on shipping bills towards the fulfillment of EOP.   The Committee noted that the firm has already availed the benefit of DEPB on some shipping bill which can not be counted for towards discharge of export obligation under advance authorization and therefore rejected the request  to accept DEPB cum free shipping bill. Subject:­  Request for revalidation of advance authorization No. 0310511442 dt. 13.3.2009.

  The case was placed before the Committee and after deliberating the case in length the following decision was taken: i)             Export obligation period is extended for 6 months from the date of endorsement.  However, request for endorsement to RA shall be made within a month from the date of communication of PRC decision. ii)            This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP. iii)           The request for  revalidation is rejected.

Case No.8. M/s. Delton Cables Limited,  New Delhi

F.No. 01/60/162/305/AM13/EFGC(PRC) Subject:­  Request under 2.5 of FTP 2009­2014 warranting relaxation of policy and procedures in the matter of advance authorization No. 0510232761 dt. 17/12/2008.   The committee noted  that the party has exported goods mentioning advance authorization no. on shipping bill. However, due to mistake, instead of DEEC shipping bill they filed free shipping under “No Export Incentive”  It was therefore decided that the shipping bill no. 1890975 dt 10.9.2008 shall be taken into account towards discharge of export obligation against the said licence  subject to the following condition: I)             If shipping bill bear the advance licence no. or file no. II)            If ARE­1 bear the licence no. and shipping bill no for correlation.

III)           If export items are same. IV)           No other benefits availed against the said shipping bill. (Action : RA, Delhi)

Case No.18. M/s. Alkem Labortatories Limited,  Mumbai

F.No. 01/60/162/327/AM13/EFGC(PRC) Subject:­  Request for EOP extension for regularization purpose of advance licence No. 0310478373 dt. 11/7/2008 issued under PC­9 condition.   The case was placed before the Committee and after deliberating the case. It was noticed that the applicant has fulfilled 100% exports though outside the EOP. The following decisions were taken for regularization purpose.   i)        Export obligation period is extended from 6 months to 12 months from the date of each consignment.    ii)        This is only for regularization and closure purpose. iii)           This is subject to a payment of composition fee @ 0.5% of FOB value  of export made outside the original EOP i.e. 31.1.2009  and minimum value addition of 15% as prescribed under Para 4.1.6 of FTP. iv)           The condition of re­export/destruction of imported raw material as stipulated in Policy Circular 18 dt. 30.10.2007 be waived as the firm has stated to have already utilized the imported raw material fully by exporting the product manufactured from these.

Case No.19. M/s. Sampark Industries Limited, New Delhi

Subject:­  Request for extension of EOP for 2 years against the advance authorization No. 0510225393 dt. 11/8/2008.

  The committee after deliberating the unusual case in length noted that the reasons cited are force majeure and  can be considered as a genuine hardship,  thus the following decisions were taken:         I.                Export obligation period is extended for 12 months from the date of endorsement. However, request for endorsement to RA shall be made within a month from the date of communication of PRC decision.       II.                This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.   (Action : RA, Delhi)

Case No.20. M/s. Prayag Aviation  Limited,  Kolkata

F.No. 01/53/162/468/AM13/P­17/IC

Subject:­  Request for change of category from Passenger to Private.

  The Committee noted that M/s. Arki Aviation, Pune was granted Import Authorization for import of one Bell Helicopter Model 407 for Private Use with actual user condition on the recommendation of DGCA. Now M/s. Prayag Aviation  Limited,  Kolkata have purchased the aircraft from  M/s. Arki Aviation, Pune and interested to operate it under passenger category. The Committee also noted that DGCA vide their letter dated 16.2.2012 has given no objection for using aircraft in ‘passenger’ category in place of private category. In view of the aforesaid recommendations, PRC decided to allow the request of the applicant firm in relaxation of actual user condition from Private use to Passenger category. (Action : RA, Kolkata)

Case No.21. M/s. Uttam Galva Steel Limited,  Mumbai

Subject:­  Request for revalidation of advance authorization No. 0310492018 dt. 27/10/2008..

  The committee noted that though there was some delay at the part of RA in granting revalidation,  the firm however did not approach with their grievance to the RA immediately on expiry of validity. They approached RA only after a period of  more than 2 years. The committee further noted that the firm has not cited  any reasons of delay preventing them not to approach RLA immediately after the expiry of the validity of the licence. The committee therefore did not find any reason to consider the request of the firm at this distance of time and keeping in view the unexplained inordinate delay,  the request is rejected.

Case No.22. M/s. Veejay Lakshmi Engineering Works Limited, Coimbatore.

F.No. 01/60/162/611/AM10/EFGC(PRC) Subject:­  Request for acceptance of physical export in lieu of deemed exports on account of cancellation of order by indigenous buyer  for advance authorization No. 3210002605 dt. 16.11.2000.   The Committee observed that the licencee has made physical exports against the Deemed exports licence  and earned foreign exchange. Even though the licence is issued prior to PN 45 (dated 14.1.2005), in the instant case it was decided to accept the physical exports made against Advance LIcence no. 3210002605 dt. 16.11.2000 and regularize the case, after verification of the physical exports made against the licence by the concerned RA.   (Action : RA, Coimbatore)

Case No.23. M/s. Gharda Chemicals Limited, Mumbai

Subject:­  Request for relaxation of policy provision for issuance of DEPB.

  The case was discussed in length. It was noticed by the Committee that in this case exports were made during the years 2007 and 2008 and whole exports proceeds were also realized during 2007­08. They have neither made any attempt to file application in time nor made any complaint to RA that shipping bills were not reflecting in server data base. The ground that BRCs were received by them on 18.3.2011 without any certificate from the bank giving reason of taking 3 years time after realization of proceeds is not acceptable to the committee.            The committee therefore decided to reject the request and also decided to review the similar case approved in meeting no. 12/AM13 dated: 03.07.2012. RA may be asked to call back DEPB issued already.   (Action : RA, Mumbai to call back DEPB if it is already issued on the basis of PRC decision dt. 3.7.2012)

Case No.24. M/s. Phillips Carbon Black Limited,  Kolkata

F.No. 01/60/162/109/AM13/EFGC(PRC) Subject:­  Request for clubbing in terms of Para 4.20.1 of HBP & discharge of export obligation & Redemption of Bond/LUT in terms of para 4.25 & 4.26 of HBP against the 6 advance authorizations. . Deferred for obtaining  a report from RA, Kolkata regarding date of application filed by the firm for clubbing under PN 79 dt. 13.10.2011.

F.No. 01/60/162/129/AM13/EFGC(PRC) Subject:­  Request for permission for payment of customs duty and Interest alongwith waiver from PC­18 condition of Advance  authorization No. 3410018130 dt. 20.2.2007.   The Committee decided that the condition of re­export/destruction of imported raw material as stipulated in Policy Circular 18 dt. 30.10.2007 be waived as the firm has stated to have already utilized the imported material fully by exporting the product manufactured from these under DEPB Scheme and is ready to pay duty + interest. .  RA may check and verify the aspect of raw material utilization and payment of duty + interest and if found to be true, the case may be regularized.   (Action : RA Vadodara)

Subject:­  Request for revalidation of advance authorization No. 0310546437 dt. 19.11.2009.

  The Committee noted the contents of request of the  firm and decided to reject as no cogent and justified reasons establishing genuine hardship warranting relaxation under Para 2.5 of the FTP have been provided by the firm.

Case No.32. M/s. Medreich Limited, Bangalore

F.No. 01/60/162/351/AM13/EFGC(PRC) Subject:­  Request for (1) extension in export Obligation period against  Advance Authorization 0710065660 dated 29.6.2009­ Import  made from unregistered source and (2) Request for accept Customs duty + Interest towards the difference of qty between  Applied norms and Ratified Norms.             I.            Export obligation period is extended from 6 months to 12 months from the date of first import.       II.            This is only for regularization and closure purpose.    III.        This is subject to a payment of composition fee @ 0.5% of FOB value  of export made outside the original EOP and minimum value addition of 15% as prescribed under Para 4.1.6 of FTP.     IV.            The condition of re­export/destruction of imported raw material as stipulated in Policy Circular 18 dt. 30.10.2007 be waived as the firm has stated to have already utilized the imported raw material fully by exporting the product manufactured from these.  However, the default in terms of duty saving proportionate to the default in export outside the EO period of 12 months from the date of 1st import as stated above may be paid by the firm in accordance with the stipulated policy provisions.  RA to check and verify the aspect of raw material utilization and evaluate the duty­saving default and take necessary action as per the policy provisions for regularization of the case   (Action : RA, Bangalore)

Case No.33. M/s. Farwood Industries Limited, Chennai

Subject:­  Request for revalidation & EOP extension of advance authorization No. 0410109498 dt. 18.11.2009.

  The Committee noted the request of the firm and decided to reject as the reasons cited establish no genuine hardship warranting relaxation under Para 2.5 of FTP.

Case No.34. M/s. Guhan Textiles Pvt Limited Coimbatore

F.No. 01/60/162/882/AM08/EFGC(PRC) Subject:­  Request for clubbing of 3 AA i) 3210004896 dt. 16.7.2001, ii) 3210005161 dt. 10.8.2001 and iii) 3210006398 dt. 28.11.2001 both for physical exports and deemed exports issued in 2001 and restoration of clubbing of AAs already made which was subsequently cancelled by RA Coimbatore.   The Committee observed that clubbing of licences issued under physical and deemed export categories were allowed by RA, Coimbatore which was withdrawn on the basis of Audit Objection. It is represented by the party that there was no difference in duty structure under Custom Notification no. 50/ 2000 and 51/2000 except that notification no. 50/2000 does not allow exemption from anti­dumping and safe guard duty. However, item imported under licences in question was “raw cotton” which did not attract any anti­dumping and safe guard duty. The committee agreed fully with the contention of the applicant and thus allow clubbing of licences issued prior to Public Notice 45 dt. 14.1.2005.

(Action : RA, Coimbatore – Clubbing and redemption earlier be restored.)

Case No.35. M/s. Western Cans Pvt Limited,  Mumbai

F.No. 01/60/162/331/AM13/EFGC(PRC) Subject:­  Request for acceptance of supplies made one day before the filing of application for advance intermediate authorization No. 0310383200 dt. 5/6/2006 for regularization purpose.     The case was discussed in length with due diligence and it was decided to report on the ground that export/supply made without declaring the intend on the document can’t be taken into account towards discharge of export obligation. Similarly, supply made before filing of application can not be taken into account.
