After deliberation, the Committee noted the performance of the unit for first 4 years of 2nd Block period i.e. FY 2019-20 to FY 2022-23 in terms of Rule 54 of SEZ Rules, 2006.
• The unit has achieved cumulative export revenue of Rs. 1502.81 Crores as against projected export of Rs. 1073.49 Crores i.e. 139.99% of projected export and achieved cumulative NFE of 1441.22 Crores which is 95.90% in first 4 years of 2nd Block Period i.e. during FY 2019-20 to 2022-23. • The unit has achieved employment of 3271 employees (Men-1861, Women- 1410) as on 31.03.2023.

Since providing of “Services” in DTA against INR does not qualify as ‘Services’ as per definition given in Section 2(z) of the SEZ Act, 2005, Unit has violated the provisions of SEZ Act & Rules and hence Committee after deliberation, directed to initiate action against the unit and to issue Show Cause Notice for violation of various provision of SEZ Act/Rules and under Foreign Trade (Development and Regulation) Act, 1992.
Further, the unit has been directed to submit the undertaking regarding, not violating same SEZ Act/ Rules in future.

(ii) Brief detail of the project
M/s. Veritas Data Management India Pvt Ltd., (VDMIPL) has been formed with the Ultimate parent company Veritas Holdings Ltd. The company is registered in India at the Executive Centre India Pvt. Ltd., Level 9, Tower 2, Wold Trade Centre, Kharadi, Pune 411040 having CIN U62011PN2024FTC230263.
The Company proposed to set up SEZ unit with an area ad-measuring 1,710 Sq. Ft. at 4th Floor, Nxtra Data Ltd., Rajiv Gandhi Infotech Park, MIDC Phase III SEZ, Hinjewadi, Pune.
The space wherein the company is proposing to set up a new SEZ Unit, out of total proposed area of 1710 Sq. Ft., 1410 sq. Ft currently belongs to its group company i.e. Veritas software Technologies India Pvt. Ltd. (VSTIP). In this regard. VSTIP has filed partial exit application in relation to giving up space of 1410 Sq. Ft. to JDC Pune office separately. The said area is proposed to be occupied by the Unit.
All the assets which are present in the said premises and are belonging to VSTIPL are proposed to be transferred to the new unit. i.e. Veritas Data Mangement India Pvt. Ltd. (VDMIPL) vide the Slump Sale Agreement. Such Transfer would be inter unit transfer (IUT) i.e.bond to bond transfer. The Unit can undertake additional services in future and expand their premises.
The Company intends to carry on the business of rendering, providing, offering, promoting, organizing, facilitating the information technology enabled services and other support services as shared services to all intra group companies in the areas of finance and accounting related advisory and management and documentation services, legal matters relating advisory and management and documentation services, human resources and human welfare related compliance and management and documentation services and information technology software and infrastructure related support services. The Proposed data centre will be a captive data centre which will only be providing services within the group companies.
The company intends to invest an amount of Rs. 154.11 Crores into the project which includes Data Processing equipment’s including desktops, laptops, servers and Peripherals which will be funded from Shareholders File No.S-SEZ-PRO0MIDC/5/2024-JDCP-SEEPZ-MUMBAI I/4482/2024 199
(Equity plus loans) ie. Veritas Global Data Management B.V. (Netherlands). The applicant has projected an export revenue of Rs. 107.32 Crors with NFE of Rs. 19.49 Crores.

Maharashtra Industrial Development Corporation - Developer has been granted Letter of Approval No. F.2/129/2005-EPZ dated 07.06.2007. • The Developer has submitted List of Materials duly certified by the Chartered Engineer Shri Amit Bogawat, (Registration No. M-1474545) for Sewage and garbage disposal plant, pipelines and other necessary infrastructure for sewage and garbage disposal, Sewage treatment plants for authorized operation at Hinjewadi phase III for authorized operation • The total value of the list of material is Rs. 8,91,39,985/- • The Developer has submitted the following documents with the application (i) List of materials (ii) Chartered Engineer’s Certificate • The Specified Officer has submitted verification report dated 24.06.2024 and informed that the list of material submitted by the Developer has been verified and found that item listed at Sr.No. 2, viz. ‘C Sand’ is restricted item. b. Specific issue on which decision of Approval Committee is required:
Approval of the Committee regarding Installation of In Building Solutions (IBS) Setup in the SEZ Unit Premises.
c. Previous Reference :
The Unit’s proposal dated 22.02.2022 wherein the SEZ Unit face the problem of mobile connectivity as outside towers are not enough to provide uninterrupted connectivity inside the building which is hampering on the smooth and efficient functioning of their operations and also significant network outage which is causing business loss, hence had requested approval for installation of IBS Set up.
Their application for installation of “IBS Setup” was considered in the
UAC of 29.03.2022 and in principle, approval was issued subject to certain conditions which are follows : a. The Unit should obtain and submit NOC from the developer & other statutory bodies/authorities as may be applicable; b. The Unit will not bill for any rental or charges from the vendor/service provider for installation of such facility; c. The Unit and their vendor gives an undertaking to the effect that the said facility will not be used for providing mobile network connectivity or services to any other users outside the SEZ Unit Premises; d. The Unit submits & undertaking to the effect that they or their vendor will not avail any concession, exemption or benefit available under Section 7 or Section 26 of the SEZ Act, 2005. d. Relevant Provision:
As per first proviso to Rule 11(5) of SEZ Rules, 2006 “PROVIDED that the Developer may, with the prior approval of the Approval Committee, grant on lease land or built up space, for creating facilities such as Canteen, Public Telephone booths, first and centres, crèche and such other facilities as may be required for the exclusive use of the unit.”
Further, as per para 3 of Instruction No. 95 dated 11.06.2019 “3. The issue was examined in this department and with the approval of competent authority, it is conveyed that the same could be allowed File No.S-SEZ-PRO0MIDC/15/2022-JDCP-Part(1) I/4498/2024 7
subject to the following condition. The facilities as envisaged under the proviso to Rule 11(5) of the SEZ Rules could also be created by a Unit for its exclusive use subject to obtaining a NOC from the Developer as well as necessary NOCs/clearances/approvals from the relevant statutory authorities.
The Units shall not be eligible for any exemptions, drawback, concessions or any other benefit available under Section 7 or Section 26 of the SEZ Act, for creating or operating such facilities”.
Now the Unit vide letter dated 03.06.2024 has informed as follows:
i. they have received NOC from the Developer (i.e. MIDC Pune on 14.05.2024.
The Unit will not charge any rental or charges from vendor /service provider
for installation of IBS facility;
ii. as no concession, exemptions or benefits will be availed under Section 7 or
Section 26 of SEZ Act, 2005 neither by the Unit nor by their vendor, there
won’t be any revenue loss for the Government;
iii.the business requirement is to set up ‘IBS plus Outdoor Setup’ to cover the
cell phone users inside the building as well as within the campus and
periphery of the campus.
iv.The IBS plus Outdoor Setup would serve an area of approx 200-250 meters
of radius from the periphery of the campus. As per the technology deployed
the coverage would serve the mobile users (i.e. TCS associates, vendor,
clients, users) travelling around the TCS campus.
Now the Unit has fulfilled the conditions laid down in the Approval letter dated 07.04.2022, except the undertaking mentioned in the approval letter i.e. the Unit and their vendor gives an undertaking to the effect that the said facility will not be used for providing mobile network connectivity or services to any other users outside the SEZ Unit Premises.
e. Other Information: - • M/s.
