ADC’s observations:

• The Unit has achieved cumulative export revenue of Rs. 234.40 Crores as against projected export of Rs. 142.23 Crores (which is 164.80% of projected export) and achieved cumulative NFE of 229.65 Crores which is 97.97% in 4 years of 2nd Block Period i.e. during ( FY 2018-19 to 2021-22) • The unit has achieved Employment of 593 employees (Men – 498 & Women – 95) as on 31.03.2022. • Approval Committee may like to monitor the performance of the Unit for FY 2018-19 to 2021-22 (4 years of 2nd Block period).

a. Proposal :

Request of M/s. Xcaliber Infotech Pvt Ltd., located at Plot No. 12/1, Rajiv Gandhi Infotech Park, Phase III, Hinjewadi, Pune for extension of Letter of Approval bearing No. SEEPZ/MIDC-SEZ/XIPL/83/2022-23/2161 dated 17.02.2023 which will expire on 16.02.2024.

LOA issued on:

17.02.2023 Valid upto 16.02.2024.

Nature of business of the Unit

: IT/ITES Software Electronics Robotics software.

b) Detailed reasons for extension of LOA:

The Unit could not submit lease deed within 06 months after the LOA was issued. As per the request of the Unit, the Approval Committee in its meeting held on 21.09.2023 has granted extension of further six months for submission of Registered Lease Deed in terms 2nd Proviso to Rule 18(2)(ii) of SEZ Rules, 2006. The Unit has submitted the reason for extension is that the draft lease deed took more time than expected in MIDC Mumbai Office to get approved. The Unit vide email dated 05.02.2024 has informed that they will be submitting the lease deed before end of February 2024.

c. Relevant provision:

Proviso to Rule 19 (4) of SEZ Rules, 2006

valid reasons to be recorded in writing for a further period not exceeding two years. :”

MIDC Pune SEZ Developer has allotted vacant land admeasuring 19,858 Sq. Meter to the unit at plot no 12/1, Rajiv Gandhi Infotech Park, Hinjewadi, Phase III, Pune. The Unit has informed that they will be submitting lease deed before the end of February 2024. Further the Unit will require time to complete the construction activity in their SEZ Unit premises. The Approval Committee may like to consider the proposal of the Unit for extension of further one year in terms of the provisions of Rule 19(4) of SEZ Rules, 2006.

Maharashtra Industrial Development Corporation - Developer has been granted Letter of Approval No. F.2/129/2005-EPZ dated 07.06.2007 • The Developer has submitted List of Materials duly certified by the Chartered Engineer Shri Amit Bogawat, (Registration No. M-1474545) dated 22.12.2023 for M & R of Water supply scheme and providing FRP porta security cabin and toilet in HSR for authorized operation • The total value of the list of material is Rs. 7,44,918.00 • The Developer has submitted that they need the list of material for Maintenance and Repair of Water supply scheme and providing FRP porta security cabin and toilet in HSR for authorized operation at MIDC-SEZ. • They will keep the record of utilization of the approved list of material. • The Developer has submitted the following documents with the application i. List of materials ii. Chartered Engineer’s Certificate • The Specified Officer has submitted verification report dated 04.01.2023 and informed that the list of material submitted by the Developer has been verified and found in Order. Bond Balance as on date is Rs.3,66,17,297/- which is sufficient for the procurement of Indigenous material of estimated value of Rs. 7,44,918/- covered under the aforementioned application. • The procurement of goods is allowed in terms of Rule 12(2) of SEZ Rules, 2006 read with Rule 10 of SEZ Rules, 2006.

Relevant provisions :

As per MOC&I’s O.M. dated 07-06-2021 issued under F. No. K-43014(16)/8/2020- SEZ, in partial modification of Power guidelines issued vide letter No. P-6/03/2006- SEZ (Vo,.III) dated 16.02.2016, following proviso under para (iii) has been appended :

“Provided that, with the approval of Unit Approval Committee, a Unit may setup a non-conventional power plant within the premises of the Unit for the exclusive purpose of captive consumption subject to the condition that no tax/duty benefits stipulated under Section 26 of SEZ Act, 2005 shall be available for setting up as well as operations and maintenance of such power plant. Such captive generating power plants shall comply with all rules, regulations and technical standards framed under the Electricity Act, 2003 as amended from time to time. Captive generative power plants with capacity 500KW and above has to be re-registered with Central Electricity Authority”. d. Other Information : • LOA No. SEEPZ-SEZ/MIDC-SEZ/TCSL/50/2014-15/05554 dated 01.03.2018 (Original LOA) • Location: Plot No. 5, MIDC-IT-ITES-SEZ, Rajiv Gandhi Infotech Park, Phase III, Hinjewadi, Pune 411057. • Date of Commencement of Production: 20.01.2020

• The Unit has submitted that: a. They are proposing to install 264 KWP solar power generation system. b. The Solar modules will be installed on roof top of their building at (Tower 1 & Tower 2) located at Plot No. Plot No. 5, MIDC-IT-ITES-SEZ, Rajiv Gandhi Infotech Park, Phase III, Hinjewadi, Pune 411057. c. The said Solar Power Plant shall be set up exclusively for captive consumption purpose only. d. The said solar power plant will be set up by their vendor i.e. M/s Kirloskar
Solar Technologies Pvt. Ltd., in accordance to the revised power guidelines. e. The Unit will not be availing any duty/tax benefits on material and
installation under SEZ Act or Rules for setting up, operations and maintenance of such power plant. • Further, the Unit has submitted undertaking that : • No tax/duty benefit stipulated under Section 26 of SEZ Act, 2005 shall be available for setting up as well as operations and maintenance of such power plant. • Such Captive generating power plants shall comply with all rules, regulations and technical standards framed under the Electricity Act, 2003 as amended from time to time. • Captive generative power plants with capacity 500 KW and above has to be registered with Central Electricity Authority. They will register with Central Electricity Authority if power generation capacity exceeds 500 KW.

f. ADC Observations :

The proposal may be considered subject to the condition that : a. the Unit will not be eligible for any exemptions, drawback, concessions or any other benefit available under Section 7 or Section 26 of the SEZ Act for creating or operating such facilities. b. the unit will have to fulfill any conditions / safeguards laid down by the State Government / Electricity department, from time to time c. the non-conventional solar power generated will be used only for captive consumption and will not be sold outside .They will register with Central Electricity Authority if power generation capacity exceeds 500 KW. 2. The proposal of the unit for installation of 264 KWP rooftop Non-conventional Solar Power Generation System, on roof top of building for captive consumption only, aligns with the O.M. issued under F. No. K-43014(16)/8/2020-SEZ. dated 07-06-2021 in amendment to Power guidelines dated 16.02.2016 issued by MOC&I.
