Application of M/s. Nxtra Data Limited, Co- Developer, located at Plot No. 13/10A, 28, MIDC, Rajiv Gandhi Infotech Park, Phase-III, Hinjewadi, Pune 411057 for approval of List of Material for operations and maintenance of Data Center Building for authorized Operation. b. Specific Issue on which decision of Approval Committee is required: - Approval for List of material required for operations and maintenance of Data Center Building for authorized operation totally valued at Rs. 1,89,79,002/-
c. Relevant Provisions: - As per Rule 12 (2) of SEZ Rules, 2006 “The Developer shall make an application, after obtaining approval for the authorized operation under rule 9, to the Development Commissioner, along with the list of goods and services, including machinery, equipments and construction material required for the authorized operations, duly certified by a Chartered Engineer for approval by the Approval Committee”. d. e. Other Information: - • M/s. Nxtra Data Limited, Co- Developer has been granted Letter of Approval No. F.2/129/2005-SEZ dated 14.12.2017 • The Co-Developer has submitted List of Materials duly certified by the Chartered Engineer Makarand Kulkarni, (Registration No. 093577-0 dated 17.02.2006) dated 19.03.2024 for Operation and Maintenance which is authorized operation for development of their SEZ located at M/s. Nxtra Data Limited, Co- Developer, Plot No. 13/10A, 28, MIDC, Rajiv Gandhi Infotech Park, Phase-III, Hinjewadi, Pune 411 057. • The Co-Developer has informed that the list of material required for providing Infrastructural facilities in the aforesaid sector Specific SEZ for Information Technology/Information Technology Enabled Services (IT/ITES) which is authorized operation for development of their SEZ in the aforesaid sector specific SEZ for IT /ITES. • The total value of said materials is Rs. 1,89,79,002/- • SO has been requested vide letter dated 20.03.2024 to submit verification report and SO’s vide his verification report dated 26.03.2024 has submitted that, the Co-Developer has Bond Balance of Rs. 64,37,59,905 which is sufficient for the procurement of Indigenous material of estimated value of Rs.1,89,79,002/-. Accordingly, the list of material is in order, the CE vide his letter dated 19.03.2024 have also certified that, these materials are required for Authorized Operations of M/s. Nxtra Data Ltd. (Co-Developer) and hence the request of Co-Developer may be considered.

f. ADC’s Observation : -

• Approval Committee may kindly consider the request of the Co-Developer for approval of list of material as per Rule 12(2) of SEZ Rules, 2006.

a. Proposal:

Proposal submitted by M/s. Infosys Limited (Unit III), Ascendas – SEZ, Building Cypress, Floor 6 to 8, International Tech Park, Plot No. 18, MIDC- IT/ITES-SEZ, Rajiv Gandhi Infotech Park, Phase III, Hinjewadi, Pune-411 057, for approval of setting up of cafeteria and appointment of service provider in the Cafeteria in the SEZ Unit Premises.

b. Specific issue on which decision of Approval Committee is required:

Approval of the Committee for setting up of cafeteria and appointment of service provider in the cafeteria, as detailed below:

c. Relevant Provision:

As per para 3 of Instruction No.95 dated 11.06.2019 ‘3. The issue was examined in this department and with the approval of competent authority, it is conveyed that the same could be allowed subject to the following conditions. The facilities as envisaged under the proviso to Rule 11(5) of the SEZ Rules could also be created by a Unit for its exclusive use subject to obtaining a NOC from the Developer as well as necessary NOCs/ clearances/approvals from the relevant statutory authorities. The units shall not be eligible for any exemptions, drawback, concessions or any other benefits available under Section 7 or Section 26 of SEZ Act, for creating of operating such facilities.

d. Other Information: - • M/s. Infosys Limited has been granted LOA No. SEEPZ-SEZ/MIDC-SEZ/IL Unit III/63/2018-19/136 dated 07.08.2018. • Location of the Unit: M/s. Infosys Limited, Ascendas SEZ Unit III Building Cypress, Floor 6 to 8, International Tech Park, Plot No. 18, MIDC-IT/ITES- SEZ, Rajiv Gandhi Infotech Park, Phase III, Hinjewadi, Pune-411 057 • Date of commencement of authorized operation: 01.08.2019 • LOA valid up to: 31.07.2024 File No.S-SEZ-PRO0MIDC/26/2022-JDCP I/4068/2024 128

• The unit vide their letter dated 06.03.2024 had requested for approval of setting up of cafeteria and appointment of service provider. • The unit has submitted that:

The Unit and the service provider will not be taking any duty benefits on the procurement related to Cafeteria.
The unit shall provide space as mentioned above.
The vendor will be serving Tea, Coffee, Refreshments and will bring the pre-cooked food to their employees of the Unit. • In support of the above unit has submitted the following documents: • Copy of Fire NOC of the building • Copy of NOC from Co-Developer • Copy of GST Certificate of Vendor • Copy of FSSAI Certificate

d. ADC’s Recommendations:
• Approval Committee may kindly consider the proposal for setting up of cafeteria and appointment of service provider in the cafeteria, in terms of para 3 of Instruction No.95 dated 11.06.2019 issued by MOC&I.

a. Proposal :

       Proposal submitted by M/s Tudip Technologies Pvt. Ltd., IT/ITES SEZ

Unit Located at Plot No. 11/2, MIDC-IT-ITES-SEZ, Hinjewadi, Pune for granting duty exemption for procurement of material w.r.t. installation of Rooftop Non- Conventional Solar Plant in SEZ Unit premises.

b. Previous Reference:

During the Approval Committee meeting held on 09.02.2024, the committee approved the proposal of M/s Tudip Technologies Pvt. Ltd for setting up of Roof Top Non-Conventional Solar Power plant for Captive consumption in terms of Office Memorandum dated 07.06.2021 issued in addendum to Power Guidelines dated 16.02.20216 issued by MOC&I amounting to Rs. 75,04,027/- (including 13.8 % taxes) having capacity of 138.24 KW.
Accordingly approval letter was issued to the Unit dated 20.02.2024.

In view of the O.M. dated 07.03.2024, issued by MOC&I, the unit vide their letter dated 11.03.2024 has requested for permission to avail duty benefits for installation of Rooftop Non-conventional Solar power Plant at their SEZ unit against the approval letter dated 20.02.2024 issued to them. The unit also informed that, they have not procured any material required for the installation of Non-conventional Solar Power Plant. d. Report of The Specified Officer:

In respect of the application of the Unit dated 11.03.2024, the specified officer was requested to submit the verification report. The Specified Officer vide his letter dated 20.03.2024 has submitted the verification report and informed that the unit has not procured any material w.r.t. Solar Power Plant. e. Specific Issue on which decision of Approval Committee is required:

Approval of the Committee for installation of Rooftop Non-conventional Solar power Plant, for captive consumption with availing of duty benefits, for captive consumption in terms of Office Memorandum dated 07.03.2024 issued by MOC&I as detailed below: File No.S-SEZ-PRO0MIDC/1/2024-JDCP I/4077/2024 23

f. Relevant provisions: As per MO&I’s O.M. dated 07-03-2024 issued under F. No. K-43014(16)/8/2020- SEZ: “The undersigned is directed to refer to the subject mentioned above and to state that in Partial modification of Power Guidelines issued vide this Department’s O.M. of even No. dated 07.06.2021, it is conveyed that the Duty benefits under Section 26 of SEZ Act, 2005 is allowed to the Units for Installation as well as O & M of renewable energy equipment exclusively for captive consumption of the Unit with specific condition that the power shall not be wheeled out to DTA.”
g. Other Information: • LOA No. SEEPZ-SEZ/MIDC-SEZ/TTPL/67/2019-20/ dated 08.03.2019 & 29.03.2020 (Original LOA & Addition of Location) • Location: Plot No. 11/2, Lower Ground Floor, Ground & First Floor, MIDC-IT- ITES-SEZ, RGIP, Hinjewadi, Phase III, Pune 411057. • Date of Commencement of Production: 16.01.2020
• Validity of LOA: 15.01.2025 • The Unit has submitted that: a. Copy of Approval for Installation of Solar Plant. b. Copy of Power Guidelines amendment vide No. K-43014(16)/8/2020-SEZ dated 07.03.2024. c. The said Solar Power Plant shall be set up exclusively for captive
consumption purpose only.

h. ADC Observations :

• The Approval committee may kindly consider the proposal of the unit for installation of rooftop Non-conventional Solar power Plant, for captive consumption with availing of duty benefits, in terms of MOC&I O.M. issued under F.No.K-43014(16)/8/2020-SEZ dated 07.03.2024.

AGENDA NOTE FOR CONSIDERATION OF THE APPROVAL COMMITTEE

a. Proposal :

       Request  of  M/s  Tata  Consultancy  Services Ltd.,  IT/ITES  SEZ  Unit

Located at Plot No. 5, Rajiv Gandhi Infotech Park, Hinjewadi, Phase III, Pune 411057 for granting duty exemption for procurement of material w.r.t. installation of Rooftop Non-Conventional Solar Plant in SEZ Unit premises. b. Previous Reference:
During the Approval Committee held on 09.02.2024, approved the proposal of M/s Tata Consultancy Services Ltd., for setting up of Roof Top Non-Conventional Solar Power plant for Captive consumption in terms of Office Memorandum dated 07.06.2021 issued in addendum to Power Guidelines dated 16.02.20216 issued by MOC&I amounting to Rs. 1,35,00,000/- (including 13.8 % taxes) having capacity of 264 KWP. Accordingly approval letter was issued to the Unit dated 20.02.2024.

Now, MOC&I has issued Officer Memorandum dated 07.03.2024 stating that, “Duty benefits under Section 26 of SEZ Act, 2005 is allowed to the units for installation as well as O&M of renewable energy equipment exclusively for captive consumption of the unit with a specific condition that the power shall not be wheeled out to DTA.” c. Current Application: - In view of the O.M. dated 07.03.2024, issued by MOC&I, the unit vide their letter dated 19.03.2024 has requested for permission to avail duty benefits for installation of Rooftop Non-conventional Solar power Plant at their SEZ unit against the approval letter dated 20.02.2024 issued to them. The unit has informed that, they have received certain goods against the Delivery Challans (as supply being against a work order) for installation of Non-Conventional Solar Plant. d. Report of The Specified Officer: In respect of the application of the Unit dated 19.03.2024, the specified officer was requested to submit the verification report. The Specified Officer vide his letter dated 26.03.2024 has submitted the verification report and informed that the unit has procured 05 line items as given below by Delivery challan under non-benefit:

f. Relevant provisions:

As per MO&I’s O.M. dated 07-03-2024 issued under F. No. K-43014(16)/8/2020- SEZ,:

“The undersigned is directed to refer to the subject mentioned above and to state that in Partial modification of Power Guidelines issued vide this Department’s O.M. of even No. dated 07.06.2021, it is conveyed that the Duty benefits under Section 26 of SEZ Act, 2005 is allowed to the Units for Installation as well as O & M of renewable energy equipment exclusively for captive consumption of the Unit with specific condition that the power shall not be wheeled out to DTA.”
g. Other Information: • LOA No. SEEPZ-SEZ/MIDC-SEZ/TCSL/50/2014-15/05554 dated 01.03.2018 (Original LOA) • Location: Plot No. 5, MIDC-IT-ITES-SEZ, Rajiv Gandhi Infotech Park, Phase III, Hinjewadi, Pune 411057. • Date of Commencement of Production: 20.01.2020
• Validity of LOA: 19.01.2025 • The Unit has submitted that: a. They are proposing to install 264 KWP solar power generation system. b. The Solar modules will be installed on roof top of their building at (Tower 1 & Tower 2) located at Plot No. Plot No. 5, MIDC-IT-ITES-SEZ, Rajiv Gandhi Infotech Park, Phase III, Hinjewadi, Pune 411057. c. The said Solar Power Plant shall be set up exclusively for captive

consumption purpose only. d. The said solar power plant will be set up by their vendor i.e. M/s Kirloskar Solar Technologies Pvt. Ltd., in accordance to the revised power guidelines.
