No. K-43014(16)/8/2020-SEZ िदनांक 07.03.2024 के अंतगत यह अवगत कराया गया है िक िवशेष आथक े अ/धिनयम, 2005 क& धारा 26 के तहत शुGक लाभ उन इकाइयa को Dदान िकए जाएंगे जो नवीकरणीय ऊजा उपकरणa क& 8थापना तथा उनके संचालन एवं अनुरण (O&M) का उपयोग केवल अपनी इकाई के कै7"टव उपभोग के लए करगी, इस िवशेष शत के साथ िक उXपािदत िवAुत को डीटीए (घरेलू शुGक े) म Dवािहत नहJ िकया जाएगा।

इकाई समय-समय पर संशो/धत िवAुत अ/धिनयम, 2003 के अंतगत बनाए गए सभी िनयमa, िविनयमa तथा तकनीक& मानकa का पालन करेगी। उXपp क& गई गैर-पारंपLरक सौर ऊजा का उपयोग केवल कै7"टव उपभोग के लए िकया जाएगा तथा इसे बाहर नहJ बेचा जाएगा। यिद िवAुत उXपादन मता 500 केडZGयू से अ/धक हो जाती है, तो इकाई क* qीय िवAुत Dा/धकरण के साथ पुनः पंजीकरण कराएगी। पावर गाइडलाइंस िदनांक 16.02.2016 तथा उनके संशोधन िदनांक 28.01.2019 एवं 07.06.2021 म* िनधाLरत अUय सभी शतs अपLरवtतत रहगी। केवल कै7"टव उपभोग हेतु 160.65 केडZGयूपी मता क& गैर-पारंपLरक सौर ऊजा उXपादन Dणाली क& 8थापना के लए इकाई का D8ताव, वाणiय एवं उAोग मंालय, नई िदmी Oारा जारी कायालय oापन संbया F. Agenda Item No.04: Application for Setting up of New Unit M/s Trigen Research Pvt. Ltd., : The proposal of the unit was placed before the Approval Committee for consideration. After deliberation, the Committee approved the proposal of M/s. Trigen Research Pvt. Ltd. for setting up of a new unit in MIDC-SEZ, in terms of Rule 17 & 18 of SEZ Rules, 2006.

Nxtra Data Limited (SEZ Co-developer) : The proposal of the unit was placed before the Approval Committee for consideration. After deliberation, the Committee considered the request of the Co-Developer and approved the list of materials, required for authorized operations to develop infrastructural facilities (Construction of Data Center), totally valued at Rs. 54,76,06,779/- duly certified by Chartered Engineer Makarand Kulkarni (Registration No. AM0935770), in accordance with Rule 12(2) of the SEZ Rules, 2006. The approval was granted subject to the Co-developer submitting (i) details of the comparison of MEP cost per square metre for both the Old Building and the New Building, and (ii) clarification on the area and location where the proposed materials would be utilized. In response, the Co-developer, vide e-mail, submitted the following details: The Old Building, having a built-up area of 25,897.35 sq. mtrs., incurred an MEP cost of Rs. 407.22 crores, resulting in an MEP cost of Rs. 1.57 lakhs per sq. mtr. The New Building, with a built-up area of 30,002.77 sq. mtrs., is estimated to have an MEP cost of Rs. 626 crores, resulting in an MEP cost of Rs. 2.08 lakhs per sq. mtr. Further, the Co-developer has stated that the present list of material valued at Rs. 54,76,06,779/- are proposed to be utilized over an area measuring 4,214.34 sq. mtrs. on the 3rd Floor of their SEZ premises located at P-1/1 and P-1/2, Rajiv Gandhi Infotech Park, Hinjewadi, Phase III, MIDC-SEZ, Pune – 411057. Agenda Item No.07: Application submitted by M/s. Tata Consultancy Services Limited for Setting up of Solar Power Generating System at SEZ Unit for captive consumption availing Duty benefits The proposal of the unit was placed before the Approval Committee for consideration. After deliberation, Committee approved the proposal of M/s. Tata Consultancy Services Ltd. for setting up of installation of a Solar Power Generating System of 160.65 KWP at SEZ Unit for captive consumption in terms of Public Notice No. 06/2021 dated 16.06.2021 & Power Guidelines K43014(16)/8/2020-SEZ dated 07.06.2021 issued by the Ministry of Commerce & Industry, New Delhi. The details of the approved proposal are as under: 1 Name of the Vendor of Solar Power Plant M/s Fourth Partner Energy Private Limited 2 Vendor-Service Engineering, Procurement, Commissioning of Complete Solar Power Plant. 3 Capacity 160.65 KWP 4 Annual Generation in capacity Approx. 2,12,058 KWH/Year 5 Cost of Project INR 62,25,188/- 6 Tax on the components & services Tax amount: Rs. 5,54,041/- The approval is subject to the following conditions: Office Memorandum issued under F. No. K-43014(16)/8/2020-SEZ dated 07.03.2024 conveyed that the Duty benefits under Section 26 of SEZ Act, 2005 shall be allowed to the units for installation as well as O&M of renewable energy equipment exclusively for captive consumption of the unit with a specific condition that power shall not be wheeled out to DTA.

The unit shall comply with all rules, regulations and technical standards framed under the Electricity Act, 2003 as amended from time to time. The non-conventional solar power generated will be used only for captive consumption and will not be sold outside. They will Re-register with Central Electricity Authority if power generation capacity exceeds 500 KW. The other conditions laid down vide power guidelines dated 16.02.2016 and amendment dated 28.01.2019 and 07.06.2021 shall remain unchanged. The proposal of the unit for installation of 160.65 KWP Non-conventional Solar Power Generation System, for captive consumption only, aligns with the O.M. issued under F. No. K-43014(16)/8/2020-SEZ dated 07.06.2021 and dated 07.03.2024 issued by MOC&I, New Delhi. Agenda Item No.08: Monitoring of Performance for M/s. Hexaware Technologies Limited (LOA No. 69) : After deliberation, the committee noted the performance of the unit for the Five years i.e. FY 2020-21 to FY 2024- 25 of 1st Block Period in terms of Rule 54 of SEZ Rules, 2006. The unit has achieved export revenue of Rs. 1.56 Crs. against the projected export of Rs 6.00 Crs. and has achieved positive NFE of Rs. 1.56 Crs. which is 100 % on cumulative basis in 1st Block Period i.e. FY 2020- 21 to FY 2024-25. As Per SO’s report the unit has achieved employment of 0 (Men-0 Women-0). Agenda Item No.09: Monitoring of Performance for M/s. Hexaware Technologies Limited (LOA No. 05) : After deliberation, the committee noted the performance of the unit for the Five years of 1st Block Period i.e. FY 2012-13 to FY 2016-17, Five Years of 2nd Block Period (FY 2017-18 to FY 2021-22) & 02 Years i.e. from FY 2022-23 to FY 2023-24 of 3rd Block Period (i.e. From FY 2022-23 to 2026-27), in terms of Rule 54 of SEZ Rules, 2006. The Unit has achieved export revenue of Rs. 119.10 Crores as against the projected export of Rs. 191.50 Crores and achieved positive NFE of Rs. 112.00 Crores which is 94.03 % on cumulative basis in 1st Block Period i.e. FY 2012-13 to FY 2016-17. The Unit has achieved export revenue of Rs. 204.58 Crores as against the projected export of Rs. 204.33 Crores and achieved positive NFE of Rs. 203.11 Crores which is 99.29 % on cumulative basis in 2nd Block Period i.e. FY 2017-18 to FY 2021-22. The Unit has achieved export revenue of Rs. 99.15 Crores as against the projected export of Rs. 97.39 Crores and achieved positive NFE of Rs. 94.98 Crores which is 95.80 % on cumulative basis in the first 2 years i.e. FY 2022-23 to FY 2023-24 of 3rd Block Period. As per SO report the unit has achieved employment of 8 1 employees (Men-31 & Women-50) as on 31.03.2024.
It was observed that the unit has reported incorrect amortization values in r/o Imported Capital Goods for all the Financial Years. The Committee directed the Unit to revise the APR (Yearwise) for all previous Block Periods to rectify the wrong amortization value. Agenda Item No.10: Change in Board of Directors in respect of M/s. Ascendas IT Park (Pune) Pvt. Ltd., (Co- Developer):- After deliberation, the Committee approved the proposal for change in the Board of Directors in accordance with Instruction No. 109 dated 18.10.2021, issued by the MOC&I.
