एज4डा आइटम नंबर 03: मेसस एलटीआईमाइंडटी लिमटेड के दशन क0 िनगरानी िवचार-िवमश के बाद, सिम8त ने एसईजेड िनयम, 2006 के िनयम 54 के संदभ म4, पहली Sलॉक अव8ध के पहले 2 वषU यानी िवQ वष 2022-23 और 2023-24 के लए यूिनट के दशन को नोट िकया। जैसा िक नीचे िवतार से बताया गया है: यूिनट ने थम Sलॉक अव8ध के पहले 2 वषU यानी 2022-23 और 2023-24 म4 59.88 करोड़ Vपये के अनुमािनत िनयात के मुकाबले 15.79 करोड़ Vपये का िनयात हा6सल िकया है और संचयी आधार 15.20 करोड़ Vपये का सकाराWमक एनएफई हा6सल िकया है जो 96.44% है । यूिनट ने थम Sलॉक अव8ध म4 अनुमािनत रोजगार 450 के मुकाबले 274 कमचाRरयX (पुVष-171, मिहला-103) का रोजगार हा6सल िकया है। एज4डा आइटम नंबर 04: मेसस एमफै6सस लिमटेड के दशन क0 िनगरानी िवचार-िवमश के बाद सिम8त ने एसईजेड िनयम 2006 के िनयम 54 के संदभ म4 3 Sलॉक अव8धयX यानी िवQ वष 2017-18 से िवQ वष 2023-24 के लए यूिनट के दशन को नोट िकया, जैसा िक नीचे िवतार से बताया गया है। दूसरे Sलॉक अव8ध का अं8तम वष यानी िवQ वष 2017-18 तीसरे Sलॉक अव8ध के 5 वष यानी िवQ वष 2018-19 से िवQ वष 2022-23 चौथे Sलॉक अव8ध का पहला वष यानी िवQ वष 2023-24 एसईजेड िनयम 2006 के िनयम 54 के अनुसार नीचे िवतार से बताया गया है

यूिनट ने 468.51 करोड़ Vपये के अनुमािनत िनयात के मुकाबले 338.26 करोड़ Vपये का िनयात हा6सल िकया है और 1444.05 करोड़ Vपये का सकाराWमक एनएफई हा6सल िकया है, जो िक िZतीय Sलॉक अव8ध के 5व4 वष यानी िवQ वष 2017-18 म4 संचयी आधार पर 97.11% है।
यूिनट ने 1953.63 करोड़ Vपये के अनुमािनत िनयात के मुकाबले 3284.61 करोड़ Vपये का िनयात हा6सल िकया है और 3260.05 करोड़ Vपये का सकाराWमक एनएफई हा6सल िकया है, जो तीसरे Sलॉक अव8ध यानी िवQ वष 2018-19 से 2022-23 के 5 वषU म4 संचयी आधार पर 99.25% है।
यूिनट ने 800.00 करोड़ Vपये के अनुमािनत िनयात के मुकाबले 1218.71 करोड़ Vपये का िनयात राजव हा6सल िकया है और 1210.03 करोड़ Vपये का सकाराWमक एनएफई हा6सल िकया है, जो चौथे Sलॉक अव8ध के पहले वष यानी िवQ वष 2023-24 म4 संचयी आधार पर 99.29% है।
यूिनट ने 4200 के अनुमािनत रोजगार के मुकाबले 2899 कमचाRरयX (पुVष-1875 मिहला-1024) को रोजगार हा6सल िकया है।
यूिनट को सही पRरशोधन मूMय और एनएफई को अFतन करने के लए िवQ वष 2017-18 से िवQ वष 2022-23 क0 अव8ध के लए अपने एपीआर को संशो8धत का िनदLश िदया। है।
सिम8त ने पाया िक इकाई ने भारतीय Vपये म4 ा[ भुगतान के आधार पर डीटीए म4 सेवाएं दान क0 ह\ , 6जनका िववरण नीचे िदया गया है: िवQ वष डीटीए िब@ी Vपये म4 करोड़ 2017-18 19.45 2018-19 24.66 2019-20 8.69 2020-21 7.62 2021-22 6.77 2022-23 4.39 2023-24 9.31 कुल 80.88

चूंिक भारतीय Vपये के बदले डीटीए म4 सेवाएं दान करना एसईजेड अ8धिनयम 2005 क0 धारा 2(जेड) म4 दी गई पRरभाषा के अनुसार सेवाओं के ]प म4 यो^य नह9 है, इसलए यूिनट ने एसईजेड अ8धिनयम और िनयमX के ावधानX का उ_ंघन िकया है और इसलए सिम8त ने िवचार-िवमश के बाद इकाई के खलाफ कारवाई शु] करने और एसईजेड अ8धिनयम/िनयमX के िव#भa ावधानX और िवदेशी bयापार (िवकास और िविनयमन) अ8धिनयम 1992 के तहत उ_ंघन के लए कारण बताओ नोिटस जारी करने का िनदLश िदया। एज4डा आइटम नंबर 05: मेसस कॉिcज4ट टेनोलॉजी सॉMयूशंस इं8डया ाइवेट लिमटेड Zारा िनदेशक मंडल म4 पRरवतन के अनुमोदन के लए आवेदन । िवचार-िवमश के बाद, सिम8त ने एमओसीआई Zारा जारी िदनांक 18.10.2021 के िनदLश संdया 109 के अनुसार िनदेशक मंडल म4 पRरवतन के लए यूिनट के ताव को मंजूरी दे दी, 6जसका िववरण नीचे िदया गया है: िनदेशक मंडल क0 अनुमोिदत सूची:

After deliberation, the Committee confirmed the minutes of the 125th meeting of Approval Committee held on 21.02.2025.

Agenda Item No.02: Action taken report for the minutes of the meeting held on 21.02.2025. After deliberation, the Committee has noted the Action taken report for the meeting held on 21.02.2025. Agenda Item No.03: Monitoring of Performance for M/s. LTIMindtree Limited After deliberation, the committee noted the performance of the unit for first 2 years of 1st Block period i.e. FY 2022-23 and 2023-24., in terms of Rule 54 of SEZ Rules, 2006. As detailed below: The Unit has achieved export revenue of Rs. 15.79 Crores as against projected export of Rs. 59.88 Crores and achieved cumulative NFE of Rs. 15.20 Crores which is 96.44 % in first 2 years of 1st block period i.e. 2022-23 and 2023-24. The unit has achieved employment of 274 employees (Men-171,Women-103) against the projected employment of 450 Agenda Item No.04: Monitoring of Performance for M/s. The Unit has achieved export revenue of Rs. 338.26 Crores as against the projected export of Rs. 468.51 Crores and achieved positive NFE of Rs. 1444.05 Crores which is 97.11 % on cumulative basis in 5th Year of 2nd Block Period i.e. FY 2017-18.
The Unit has achieved export revenue of Rs.3284.61 Crores as against the projected export of Rs. 1953.63 Crores and achieved positive NFE of Rs. 3260.05 Crores which is 99.25% on cumulative basis in 5 years of 3rd Block Period i.e. FY 2018-19 To 2022-23. The Unit has achieved export revenue of Rs. 1218.71 Crores as against the projected export of Rs. 800.00 Crores and achieved positive NFE of Rs. 1210.03 Crores which is 99.29% on cumulative basis in 1st year of 4th Block Period i.e. FY 2023-24.
The unit has achieved employment of 2899 employees (Men-1875, Women-1024) against the projected employment of 4200.
The unit is directed to revise its APR for the period FY 2017-18 to FY 2022-23 to update the correct amortized value and net foreign exchange earnings.

The Committee observed that the unit has provided services in DTA against the payments received in INR as detailed below: F.Y. DTA Sale in INR in Cr 2017-18 19.45 2018-19 24.66 2019-20 8.69 2020-21 7.62 2021-22 6.77 2022-23 4.39 2023-24 9.31 Total 80.88

Since providing of “Services” in DTA against INR does not qualify as ‘Services’ as per definition given in Section 2(z) of the SEZ Act, 2005, Unit has violated the provisions of SEZ Act & Rules and hence Committee after deliberation, directed to initiate action against the unit and to issue Show Cause Notice for violation of various provision of SEZ Act / Rules and under Foreign Trade (Development and Regulation) Act, 1992. Agenda Item No.05: Application for approval of change in board of directors submitted by M/s. Cognizant Technology Solutions India Pvt. Ltd.
