The proposal of M/s. SG Pharma for correction in the Letter of Approval LOA
No. SEEPZ/NEWSEZ/JNPT-SEZ SGPGPL/17/2021-22 issue dated 07.06.2022 w.r.t.
Minutes of Meeting of Approval Committee held on 28.04.2022 (Table agenda item
No.2)
b) Specific Issue on which decision of Approval Committee is required: -
Inclusion of Trading Activities in the Letter of Approval LOA No.
SEEPZ/NEWSEZ/JNPT-SEZ SGPGPL/17/2021-22/ issue dated 07.06.2022 w.r.t.
Minutes of Meeting of Approval Committee held on 28.04.2022 (Table agenda item
No.2).
Relevant Provisions :-
In terms of Rule 17, Rule 18 and Rule 19(2) of SEZ Rules, 2006 states that –
“Provided that the Approval Committee may also approve proposals for broad-
banding, diversification, enhancement of capacity of production, change in the items
of manufacture or services activity, if it meets the requirement of rule 18”.

D. Other Information:
The applicant in their project report has stated as under:-
1. The unit has stated that there is prolonged delay in responding the representations
submitted to them this office since 7th June 2022. In the said letter the unit has
stated that the Letter of Approval awarded to them has not been implemented in its
entirety as approved by the Unit Approval Committee, necessitating a rectification
and issuance of a fresh and accurate LOA.
2. They have further stated that the lack of timely action has not only led to the financial
strain due to increased project costs but also significant business losses for both
manufacturing and trading operations.
3. They have requested to resolve this issue and expedite the issuance of the new
corrected LOA for which they are duly eligible.
E. Observance:
1. It may be mentioned that the proposal of Unit for setting up of new unit at JNPA,
NEW SEZ was submitted before the Approval Committee meeting held on
30.03.2022 & 28.04.2022. In the clarification sought by the unit regarding application
for Manufacturing or Trading Services, the unit stated that they would like to
Manufacturing as well as Trading Activity and continue to hold the clientele. They will
be keeping separate records, storage, employees, Books of Accounts, etc. of both
these two separate vertical of businesses.
2. The proposal of the unit was submitted before the Approval Committee held on
28.04.2022. After deliberating, the Committee approved the proposal of M/s SG
Pharma Global Pvt. Ltd. for setting up a Unit for Manufacturing and Trading Activity.
The unit was issued LOA on 07.06.2022 for Manufacturing Activity.
3. The unit has now requested to issue Fresh LOA. It is seen from the records that the
unit intend to manufacturing Tablets, Capsules and Oral Sachets and would like to
trade Injection (Liquid), Oral Dosage i.e. Tablets, Capsules and Oral Sachets and
Injection (Dry Powder i.e. Vial also). The items proposed by the unit for Manufacture
or Trading purpose are more or less similar. It would be very difficult to monitor the
activity under one premise.
4. The Approval Committee in its meeting held on 28.04.2022 approved the proposal of
the unit for Manufacturing and Trading Activity. So, they want correction in the Letter
of Approval LOA No. SEEPZ/NEWSEZ/JNPT-SEZ SGPGPL/17/2021-22/ issue dated

Marketing strategy/buy
back plan
For Marketing of services from the proposed SEZ unit, they
would set up dedicated marketing team who will travel across the
globe and generate business. Further they are in discussion with
various international customers and are in final stage of negotiation,
however without having any approval for setting up of SEZ unit they
are not able to execute any written agreement.
Other information
M/s Shah TC Global Exim LLP was incorporated on 20th
January, 2017 at Registrar, Delhi in accordance to section 12(1) of
the liability Partnership Act, 2008.
The LLP is promoted by Mehul Shah, Parth Toshani, Freya
Shah. All the 3 partners are well qualified and have diverse
experience in procuring active pharmaceutical ingredients (API) from
across the globe to meet the ever-growing demand of the India
Pharmaceutical Industry.
The core business of their entity will be to procure API from
China, stock the same at the FTWZ and then supply to India's prime
and reputed formulation manufacturers in India and also to their
sister concern Shah TC Distribution LLP for Domestic as well as for
their export business requirement.
Shah TC Distribution LLP is a leading player in the
pharmaceutical industry, proudly standing as one of the largest of
Active Pharmaceutical Ingredients (APIs) in India. With their sister
concern, with a robust supply chain network, they have established a
top-tier supplier, delivering high quality APIs to their customers
across the Country.
Vide letter date 08.10.2024, the unit has submitted the

Provisional Officer letter of Space for Proposed New FTWZ Unit in
NSBP-FTWZ, JNPA-SEZ for setting up a FTWZ unit (i.e. Trading)
In addition to the above, the applicant has another Unit at
Arshiya FTWZ covered under LOA No. SEEPZ-NEWSEZ/Arshiya-
Raigad/138/2016-17/06961 dated 06.04.2016 for trading activity and
the said LOA is valid upto 14.05.2027. The Unit in Arshiya FTWZ is
functional.
Recommendation
Proposal of M/s Shah TC Global Exim LLP for setting up a Trading
and Warehousing Activities unit at M/s. JNPA-SEZ is submitted to
Approval Committee for consideration in terms of Rule 17 & 18 of
SEZ Rules, 2006.

maintain their business continuity and to avoid further disruption. They will follow all
necessary actions, regulations and procedures.
M/s DP World vide letter dated 24.10.2024 has conveyed that M/s Global
Power Source PTE Ltd. and M/s Goodpack IBC (Singapore) PTE Limited wants to
move cargo from Arshiya FTWZ to Nhava Sheva Business Park (NSBP).
Further, M/s Global Power Source PTE Ltd. and M/s Goodpack IBC
(Singapore) PTE Limited has submitted the details vide letter dated 24.10.2024 and
23.10.2024 for transfer of goods from Arshiya FTWZ to JNPA-NSBP. The details are

goods from India to various countries across the world as per the
demand.
The Firm is promoted by Evanshi Garg and Sawariya
Futureworks Limited who have diverse experience and strategic
partnership in procuring FMCG products from across the globe.
M/s Rising India post receipt of approval from Unit
Approval Committee intends to purchase, warehouse and
consolidate FMCG goods at Arshiya Ltd. Free trade and
warehousing zone (DTWZ) for the purpose of successfully fulfill
the demand of goods in various countries across the world,
irrespective of the order size and order value.
The object of the project is to be able to service these
Global Clients and fulfill their unique needs and demands by
undertaking various consolidation as well as value added
services at the proposed FTWZ unit.
The benefit of the project is that it will allow manufactures
like Unilever India Exports Ltd. to meet the global market demand
through entity in a continuous and efficient manner.

Steinweg Sharaf India Pvt. Ltd., have been operating a Warehousing unit in JNPA
SEZ since 2022, as per LOA issued vide letter No. SEEPZ/NEWSEZ/JNPT-SEZ
/SS(I)PL/30/ 2022-23 /17626 Dated 17-10-2022.
(ii)
Currently, they are in active discussions with some clients who have expressed
interest in bringing material to their premises for warehousing and onward supply to
their customer as per their requirement.
(iii)
Appropriately, they have requested the Co-Developer, M/s. Nhava Sheva Business
Park Pvt. Ltd., FTWZ, to provide an additional admeasuring space of 35000.00 Sq.Ft.
The proposed space area has been taken from the Co-Developer – Nhava Sheva
Business Park Pvt. Ltd subject to approval of the Office of the Development
Commissioner.
