Reason for Broad Banding
The unit has stated that —
They are planning to use this SEZ unit for manufacturing Lollipops, Toffees, and Candies as part of their authorized operations, in place of the earlier approved items. This change is due to:
1. Increased demand for lollipops in international markets.

The following are the reasons for the downward export projections despite the change in manufacturing items:
1. Completion of Three Years of Operation:

They have already completed 3 years of operations and are now entering the 4th year, with 1 quarter already completed. Hence, the projections are revised only for the remaining 2 years.

- First Year of Exports Limited to 5 Months: They began their operations in November 2022. Therefore, the first year of exports (April 2023 to March 2024) is limited to just 5 months of export activity.
- Initial Low Exports Due to Market Conditions:

Due to low market demand for the existing authorized operations, their export performance in the initial 3 years has been much lower than the projections previously approved by your esteemed office.

- Export Performance and Future Growth:
- In FY 2024-25, they achieved exports of approximately Rs. 267 Lakhs from existing authorized operations. However, with the change in manufacturing items, they foresee a substantial growth in exports. They already have active enquiries from clients for these new items, and they expect exports to increase to Rs. 1000 Lakhs in FY 2025-26 and Rs. 1200 Lakhs in FY 2026-27.

Five-Year Block Comparison and Justification:
- While exports may appear reduced in the 5-year block comparison, if they consider the balance of the remaining 2 years, the revised projections show an increase in exports compared to the first 3 years.
e. Recommendation:
Proposal of M/s. . Rudra Flexipack LLP located in JNPA FTWZ for approval w.r.t Change in Items of Manufacturing (Broad Banding) for including new items and removal of old items in their existing Letter of Approval for remaining 2 years is placed before the Approval Committee meeting in terms of Proviso 2 of Rule 19(2) of SEZ Rules, 2006.

Relevant provisions of SEZ Act, 2005 & Rules, 2006/Instruction/ Notification :- Attention is invited to MOC&I Instruction No. 117, vide letter No. K- 43022/24/2024-SEZ dt. 24.09.2024 has conveyed for strict compliance which stipulate that - vi. The transfer of goods from one FTWZ to another FTWZ should not be allowed except in specific and exceptional cases after consideration by the UAC.

The material is stored at M/s. Goodpack IBC Singapore Pve Ltd, a client of M/s. DHL logistics Private Limited. Located at J Matadi Free Trade Zone, Mannur (INCJJ6) which is to be transferred to M/s. Nhava Sheva Business Park Pvt. Ltd. FTWZ unit under (NSBP Co-Develooper, JNPA-SEZ and they have received BOE copy and issued invoice copy of the same is attached for reference.

Purpose of this transfer :
At present GPIBC has 800 doors at J MATA DEE FTWZ For operational efficiency they are looking to consolidate 400 doors out of these 800 doors and 16 returnable containers at their JNPA facility.
Operationally, this will reduce the administration of providing a re-export bond at two different zones. Instead, only a single re-export bond will be required at JNPA, Nhava Sheva Business Park Pvt Ltd. With this consolidation, it will help saving time, cost and manpower.
These returnable containers and doors will subsequently be delivered to a customer located in the Domestic Tariff Area. The customer will carry out the required Customs formalities under Customs Notification 104/94 dated 16th March 1994 including posting the bond and subsequently re-export these containers and deliver them to their consignees overseas. The returnable containers and doors in question are procured by SEZ unit on behalf of M/s. GOODPACK IBC SINGAPORE PTE LTD., which they want to transfer to JNPA (Nhava Sheva Business Park Pvt Ltd. Plot No 5-1, in Plot No 406 FTWZ1, SECTOR 4, JNPT SEZ, Village Sawarkhar, Taluka - Uran District Raigad 400707) for their authorized operation.
Observation:
Request letter from client M/s. GPIBC has been submitted seeking permission to transfer their goods from J MATA DEE FTWZ to JNPA SEZ
Goods are going to transfer from J MATA DEE FTWZ to JNPA SEZ. Approval letter/ NOC of such transfer of goods from J MATA DEE FTWZ has not been received.
Specified officer vide mail dated 25.07.2025 was asked to submit their comments, however reply is yet to be received.

The proposal submitted by M/s. Goodpack IBC Singapore Pte Ltd, a client of M/s. DHL Logistics Private Limited, for transfer of goods from J Matadi Free Trade Zone, Mannur (INCJJ6) to M/s. Nhava Sheva Business Park Pvt. Ltd., FTWZ unit under NSBP Co-Developer, JNPA-SEZ, is placed before the Approval Committee in accordance with the provisions of Instruction No. 117 issued by the Ministry of Commerce & Industry vide letter No. K-43022/24/2024-SEZ dated 24.09.2024 and as per this office circular 32/2024.
In view of the absence of prior approval from the Unit Approval Committee (UAC) of the transferring
FTWZ unit and pending comments from the concerned Specified Officer, it is recommended that the proposal be deferred at this stage. The matter may be reconsidered by the Approval Committee subsequent to the receipt of the requisite UAC approval and Specified Officer’s comments
