Case No.1. M/s Himadri Chemicals & Industries Ltd, Kolkata.

F.No. 01/60/162/745/AM14/EFGC (PRC) PRC Meeting No. 34/AM14 dated 07.01.2014 Subject:  ­  Request  for  EOP  extension  of  4  Advance  Authorization  Nos.  0210131344  dated  10.09.2009,  0210133427  dated  06.11.2009, 0210134782 dated 03.12.2009 & 0210137115 dated 29.01.2010.   The committee noted that the firm has made no exports within the original export obligation period, in any of the above Advance Authorizations as such  there  is  no  merit  for  consideration.  The  committee  decided  to  reject  the  request.  The  applicant  is  hereby  directed  to  get  their  case regularized in terms of Para 4.28 of HBP.   (Action: RA Kolkata­ If the party fails to get the case regularized in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT (D&R) Act. 1992 and submit an Action Taken Report).  

Case No.2. M/s Kopran Limited, Mumbai.

F.No. 01/60/162/746/AM14/EFGC (PRC) Subject:  ­  EOP  extension  of  Advance  Authorization  No.  0310653064  dated  12.9.2011,  0310698645  dated  14.06.2012,  0310698819  dated 15.06.2012 & 0310704379 dated 07.08.2012 issued under PC­9 condition.   The Committee decided as following:

I.               Export obligation period is extended from 12 months to 18 months from the date of first import consignment against each advance authorization mentioned above. Accordingly: a)    Export obligation period against AA No. 0310653064 dated 12/09/2011 is extended upto 31/07/2013 for regularization of exports already effected. b)    Export obligation period against AA No. 0310698645 dated 14/06/2012 is extended upto 31/01/2014. c)    Export obligation period against AA No. 0310698819 dated 15/06/2012 is extended upto 28/02/2014. d)    Export obligation period against AA No. 0310704379 dated 07/08/2012 is extended upto 30/04/2014.     II.        This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.    III.        The applicant is advised to submit the licence for endorsement to RA as early as possible.   IV.        They are further advised to start discharging their stipulated balance export obligation on the basis of this minutes without waiting for the endorsement done on the Authorization by RA.   (Action: RA, Mumbai)  

Case No.3. M/s Mangalam Drugs and Organics Ltd, Mumbai.

F.No. 01/60/162/229/AM14/EFGC (PRC) Subject:  ­  Request  for  EOP  extension  for  one  month  and  deletion  of  PC­18  condition  for  Advance  Authorization  No.  0310551345  dated 17.12.2009 issued under normal condition.   The committee reviewed its earlier decision dated 9.7.2013 and observed that the PRC mistakenly extended the export obligation period from 6 months to 12 months from the date of first import consignment whereas the export obligation period should have been extended from original validity of 12 months to 18 months i.e. upto 31.8.2011 from the date of first import consignment. The same is rectified.   The committee also observed that the letter no. 6­2/2010/DC (DUAL USE) dt. 08.11.2010 issued from the office of DCG (I) as referred by the applicant specifically states that ‘all the containers of the subject material should be labeled as “Not for Medicinal Use and to be used as a Raw Material only” before releasing the consignment by the concerned port officers.’ In view of these observations of DCG (I), the committee decided to consider the Advance Authorization to have been issued under PC­9 conditions because it is not possible at this juncture to establish that goods so imported were not used for medicinal use.  

Case No.4. M/s Alpha Foam Limited, Pune.

F.No. 01/60/162/743/AM14/EFGC (PRC) Subject: ­ Request for grant either EOP extension of Advance Authorization No. 3110044042 dated 21.07.2010 Or relaxation of policy condition for not endorsing Authorization No. on some of supply documents.   Taking into account all types of exports made, following decision was taken:

I.        Export obligation period is extended upto 31.7.2014     II.        This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.      III.               The  applicant  is  advised  to  submit  the  authorization  for  endorsement  to  RA  as  early  as  possible.  They  are  further  advised  to  start discharging their stipulated balance export obligation on the basis of these minutes without waiting for the endorsement is done on the Authorization. (Action: RA Pune/ applicant)  

Case No.5. M/s BDH Industries, Mumbai.

F.No. 01/60/162/213/AM12/EFGC (PRC) Subject: ­ Request  for  EOP  extension  for  12  months  for  regularization  of  exports  done  under  Advance  Authorization  No.  0310314154  dated 28.01.2005 issued under PC­9 condition. Waiver of PC­9 condition on imports from registered sources.   The  committee  reviewed  the  case  and  observed  that  the  applicant  has  imported  partly  from  unregistered  source.  The  committee  decided  to consider the Advance Authorization to have been issued under PC­9 conditions. Accordingly the committee decided to extend the EO period from 6 months to 12 months i.e. upto 28.2.2006 from the date of import of first consignment. Accordingly, exports effected till 28/02/2006 shall be taken into account towards discharge of export obligation. Exports effected thereafter shall not be accounted for and to be regularized in terms of Para 4.28 of HBP. However, PC­18 condition stands waived on these exports to the extent of requirement of re­export/destruction certificate on export made outside the extended EOP.  

Case No.6. M/s Medreich Limited, Bangalore.

Subject: ­ EOP extension of Advance Authorization No. 0710090801 dated 20.09.2012 issued under PC­9 condition.

  The Committee decided as following:         I.        Export obligation period is extended from 12 months to 18 months in continuation from the date of first import consignment i.e. upto 30.04.2014.     II.        This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.    III.        The applicant is advised to submit the licence for endorsement to RA as early as possible.   IV.        They are further advised to start discharging their stipulated balance export obligation on the basis of this minutes without waiting for the endorsement done on the Authorization by RA.

Case No.7. M/s Medreich Limited, Bangalore.

Subject: ­ EOP extension of Advance Authorization No. 0710090790 dated 18.09.2012 issued under PC­9 condition.

  The Committee decided as following:         I.        Export obligation period is extended from 12 months to 18 months in continuation from the date of first import consignment i.e. upto 30.04.2014.     II.        This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.    III.        The applicant is advised to submit the licence for endorsement to RA as early as possible.   IV.        They are further advised to start discharging their stipulated balance export obligation on the basis of this minutes without waiting for the endorsement done on the Authorization by RA.     (Action: RA, Bangalore)  

Case No.8. M/s Medreich Limited, Bangalore.

F.No. 01/60/162/742/AM14/EFGC (PRC) Subject: ­ Clubbing of two of Advance Authorization Nos. 0710094273 dated 15.03.2013 & 0710094708 dated 09.04.2013 issued under PC­9 condition.   The Committee decided the following:               I.        Allow clubbing of two above mentioned authorizations.             II.        Shortfall if any shall be regularized in terms of Para 4.28 of HBP.            III.        Value addition of 15% shall be maintained in terms of para 4.1.6 of FTP    (Action: RA, Bangalore)  

Case No.9. M/s Magsons Exports, New Delhi.

F.No. 01/60/162/738/AM14/EFGC (PRC) Subject:  ­  Clubbing  of  3  of  Advance Authorization  Nos.  0510248089  dated  24.08.2009,  0510280610  dated  29.12.2010  &  0510315075  dated 19.01.2012 for regularization purpose.   The Committee decided the following:

I.        Clubbing of the 3 advance authorizations as referred above is allowed.     II.        This is only for regularization of exports already effected and closure purpose and not for any further exports/imports.    III.        Exports made within 48 months from the date of earliest authorization i.e. upto 31.8.2013 shall only be taken into account for clubbing subject to payment of composition fee @ 0.5% on FOB value of export made beyond the stipulated EOP in the earliest authorization. RA is directed  to  examine  the  case  in  terms  of  Para  4.1.6  of  FTP  and  ensure  value  addition  of  minimum  15%. The  15%  value  addition  for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations.   IV.        Even after clubbing, shortfall if any may be regularised on payment of Customs Duty + Interest in terms of Para 4.28 of H.B.P.   (Action: RA, Cochin)  

Case No.10. M/s Dorf Ketal Chemicals (I) Pvt. Ltd, Mumbai.

Subject: ­ Clubbing of two Advance Authorization Nos. 0310381221 dated 22.05.2006 & 0310474035 dated 10.06.2008.

  The Committee decided the following:         I.        The committee considered the submission of the firm that the primary input in both the authorizations is same and therefore decided to allow clubbing of these authorizations to that extent only i.e. clubbing of only one input namely 4,4 ­ Methylenedianiline.  With regard to the other inputs the applicant has to regularize the same in terms of Para 4.28 of HBP.     II.        This is only for regularization of exports already effected and closure purpose and not for any further exports/imports.    III.        Exports made within 48 months from the date of earliest authorization only i.e. upto 31.5.2010 are allowed for clubbing subject to payment of  composition  fee  @  0.5%  on  FOB  value  of  export  made  beyond  the  stipulated  EOP  in  the  earliest  authorization.  RA  is  directed  to examine  the  case  in  terms  of  Para  4.1.6  of  FTP  and  ensure  value  addition  of  minimum  15%.  The  15%  value  addition  for  evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations.   IV.        Even after clubbing, shortfall if any may be regularised on payment of Customs Duty + Interest in terms of Para 4.28 of H.B.P.    (Action: RA, Mumbai)  

Case No.11. M/s Piramal Healthcare, Mumbai.

F.No. 01/60/162/704/AM13/EFGC (PRC) Subject: ­ Clubbing of two of Advance Authorization Nos. 0310541088 dated 09.10.2009 & 0310600129 dated 04.11.2010 issued under PC­9 condition.   The committee reviewed the case and decided to provide following two options to the applicant:

Option A: The applicant has the option of clubbing of both the authorizations. The exports, however, effected within 18 months from the date of import of first consignment i.e. upto 31.5.2011, under AA no. 0310541088 dt. 9.11.2009 shall only be taken into account for clubbing.  Shortfall if any shall be regularized in terms of Para 4.28 of HBP.  Value addition of 15% shall be maintained in terms of para 4.1.6 of FTP. PC – 18 condition stands waived on the exports effected after 31/05/2011 to the extent of requirement of destruction / re­export condition.   OR Option B: The applicant may opt for extension of export obligation period from 12 months to 18 months from the date of first import consignment in the case of each of the Advance Authorizations mentioned above. This is only for regularization of exports already effected and closure purpose.   This is subject to a payment of composition fee @ 0.5% of FOB value of export made outside the original EOP and minimum value addition of 15% as prescribed under para 4.1.6 of FTP. Shortfall if any shall be regularized in terms of Para 4.28 of HBP. PC – 18 conditions shall however stand waived to the extent of requirement of destruction certificate on exports made outside the extended EOP.   (Action: RA, Mumbai)  

Case No.12. M/s PME Power Solutions (India) Ltd, New Delhi.

F.No. 01/60/162/728/AM14/EFGC (PRC) Subject:  ­  Clubbing  of  two  of  Advance  Authorization  Nos.  0510241497  dated  15.05.2009  &  0510241502  dated  15.05.2009  for  redemption purpose.   The committee observed that in this case there is no policy relaxation involved. The concerned RA should have considered this case in terms of Para 4.20.1 of HBP, which provides clubbing, if imported inputs are properly accounted for as per norms.   (Action: RA, New Delhi)  

Case No.13. M/s PME Power Solutions (India) Ltd, New Delhi.

F.No. 01/60/162/ 992/AM13/EFGC (PRC) Subject: ­ Request for review of decision taken by PRC meeting No. 14/AM14 dted 16.07.2013 for redemption of Advance Authorization No. 0510304329 dated 30.09.2011.   As applicant has not given details, case is deferred for further examination.  

Case No.14. M/s PME Power Solutions (India) Ltd, New Delhi.

F.No. 01/60/162/  23 /AM14/EFGC (PRC) Subject: ­ Request for review of decision taken by PRC meeting No. 14/AM14 dted 16.07.2013 for redemption of Advance Authorization No. 0510272123 dated 06.09.2010.

As applicant has not given details, case is deferred for further examination.  

Case No.15. M/s Repro India Ltd, Mumbai.

F.No. 01/60/162/769/AM14/EFGC (PRC) Subject: ­ Request for accounting of S/bill No. 6602967 dated 23.08.2008 & 6613955 dated 27.08.2008 endorsed with wrong DFIA mentioned for redemption against DFIA No. 0310472046 dated 26.05.2008.   The Committee decided the following:         I.        The exports made under S/bill No. 6602967 dated 23.03.2008 & 6613955 dated 27.08.2008 shall be taken into account for discharge of export obligation against DFIA 031072046 dated 26.05.2008.     II.        The applicant shall submit declaration/undertaking that no other benefits have been availed/ will not be availed in future and the shipping bill shall not be taken into account for discharge of any other DFIA.    III.        RA shall ensure that S/B No.6602967 dated 23/03/2008 & 6613955 dated 27/08/2008 has not been taken into account towards discharge of export obligation against DFIA No.0310481023 dated 07/07/2008.   (Action: RA, Mumbai)  

Case No.16. M/s Repro India Ltd, Mumbai.

F.No. 01/60/162/768/AM14/EFGC (PRC) Subject:  ­  Request  for  accounting  of  S/bill  No.  6916299  dated  15.12.2008  with  wrong  DFIA  mentioned  for  redemption  against  DFIA  No. 0310485398 dated 05.09.2008.   The Committee decided the following:         I.        The exports made under S/bill No. 6916299 dated 15.12.2008 shall be taken into account for discharge of export obligation against DFIA no. 0310485398 dated 05.09.2008.     II.        The applicant shall submit declaration/undertaking that no other benefits have been availed/ will not be availed in future and the shipping bill shall not be taken into account for discharge of any other DFIA.    III.        RA shall ensure that S/B No. 6916299 dated 15.12.2008 was not taken into account towards discharge of export obligation against DFIA No.0310500864 dated 01/01/2009.   (Action: RA, Mumbai)  

Case No.17. M/s Repro India Ltd, Mumbai.

Subject:  ­  Request  for  accounting  of    S/bill  No.  6286409  dated  02.04.2008  with  wrong  DFIA  mentioned  for  redemption  against  DFIA  No. 0310465587 dated 18.03.2008. The Committee decided the following:         I.        The exports made under S/bill No. 6286409 dated 02.04.2008 shall be taken into account for discharge of export obligation against DFIA no. 0310465587 dated 18.03.2008.     II.        The applicant shall submit declaration/undertaking that no other benefits have been availed/ will not be availed in future and the shipping bill shall not be taken into account for discharge of any other DFIA.    III.        RA shall ensure that S/B No. 6286409 dated 02.04.2008 was not taken into account towards discharge of export obligation against DFIA No.0310467108 dated 02/04/2008.   (Action: RA, Mumbai)  

Case No.18. M/s S.M. Creative Electronics Ltd, Gurgaon.

F.No. 01/60/162/511/AM13/EFGC (PRC) Subject: ­ Request for amendment in PRC decision for certification by Chartered Engineer as advised by Central Excise on line of Board Circular No. 15/2008 dated 26.09.2008 – condonation of typing error in declaring authorization details of imported components in S/bill No. 1848415 dated 13.05.2008 against advance licence no. 0510219257 dt. 11.4.2008.   The committee examined the review application of the applicant and decided to modify the earlier decision of PRC meeting no. 28/AM13 dt. 6.11.2012  by  dispensing  with  the  condition  of  submission  of  certificate  from  the  Excise Authority  by  the  applicant  because  exports  product description in the S/B is mentioned as per the condition of the Authorization. (Action: RA, Delhi)  

Case No.19. M/s Larsen & Toubro Ltd, Mumbai.

F.No. 01/60/162/749/AM14/EFGC (PRC) Subject:  ­  Request  to  condone  the  procedural  lapse  of  not  generating  Bill  0f  Export  against  supplies  made  to  SEZ  units  against  Advance Authorization No. 0310424318 dated 26.03.2007.   The Committee observed that there is no mention of Advance Authorization No. 0310424318 dated 26.03.2007 on the copy of AREs1 submitted by the applicant, vide its letter dated 29/08/2013.  Whereas, the same copy of AREs1 submitted by the applicant vide its letter dated 28/11/2013 bears  the  details  of  Advance Authorization  No.  0310424318  dated  26.03.2007.  Thus,  it  is  evident  that  endorsement  regarding  Authorization details was made on AREs subsequently. The Committee, therefore, rejected the request.  

Case No.20. M/s Shiva Pharmachem Ltd, Vadodara.

F.No. 01/60/162/751/AM14/EFGC (PRC)

Subject: ­ Request to condone the procedural lapse of not mentioning Advance Authorization Nos. 3410020012 dated 06.11.2007, 3410020410 dated 20.12.2007, 3410021213 dated 16.04.2008 & 3410021263 dated 28.04.2008 on ARE­3.   The committee observed that this is case of wrongful representation and abuse of process on the part of the applicant hence, the committee decided to reject the request.  

Case No.21. M/s Voltamp Transformers Limited, Gujarat.

F.No. 01/60/162/759/AM14/EFGC (PRC) Subject: ­ Request to condone the procedural lapse to obtain EODC against Advance Authorization No. 3410020759 dated 01.02.2008.   The  committee  observed  that  this  is  a  case  of  3rd  party  export  without  having  details  of  the  advance  authorization  on  the  S/bills  hence,  the Committee decided to reject the request.  

Case No.22. M/s Nirmal Poly Plast Pvt. Ltd, Mumbai.

Subject: ­ Request for revalidation of Advance Authorization No. 0310512524 dated 20.03.2009.

  The  Committee  noted  that  due  to  data  transmission  error  the  firm  could  not  utilize  the  Advance  authorization  in  question.  Therefore,  it  was decided to revalidate the aforesaid authorization for 3 months from the date of transmission of the said amendment to ICEGATE Customs. The EDI Section will ensure that authorization is transmitted to Customs server at the earliest.   (Action: RA, Mumbai /EDI Section, Hq.)  

Case No.23. M/s High Technology Transmission Systems (I) Pvt. Ltd, Aurangabad.

Subject: ­ Request for revalidation of DEPB No. 0310701883 dated 16.07.2012.

  The Committee noted that due to data transmission error the firm could not utilize the DEPB in question. Therefore, it was decided to revalidate the aforesaid scrip for 3 months from the date of transmission of the said amendment to ICEGATE Customs. The EDI Section will ensure that DEPB is transmitted to Customs server at the earliest.   (Action: RA, Mumbai /EDI Section, Hq.)  

Case No.24. M/s Supreet Chemicals Pvt. Ltd, Vapi.

Subject: ­ Request for revalidation of two Advance Authorization No. 0310625975 dated 11.04.2011 and 0310631532 dated 18.05.2011.   The justification given and submissions made by applicant in support of their contention do not amount to any hardship to applicant. Hence the committee did not accede to the request.  

Case No.25. M/s Universal Bio Diesal Pvt. Ltd.

Subject: ­ Request for grant of relaxation – Exit from EOU to EPCG Authorization challenged.

  Deferred for further examination.  

Case No.26. M/s Kopran Ltd, Mumbai.

F.No. 01/60/162/521/AM14/EFGC (PRC) Subject: ­ Request for granting bond­ condition waiver in lieu of misplaced goods in Custom Custody for Advance Authorization No. 0310651512 dated 05.09.2011 issued under PC­9 condition.   The committee observed that since goods meant for export did not leave the Country and no foreign exchange have been realized hence, the same cannot be considered as exports. For the lost goods, the applicant would have made claim from Insurance Company. Hence the request is rejected.  

Case No.27. M/s G.B. Morrision Travels Pvt. Ltd, New Delhi.

F.No. 01/91/180/2406/AM09/PC­3/476 Subject:  ­  Request  for  No  Objection  Certificate  for  transferring/disposing  off  three  Cars  (Registration  Nos.  DL3CAA2353,  DL3CAA2354  and DL3CAA2355) imported against DFCE Certificate No.051009918 dated 25/08/2003.   The committee acceded to the request of the applicant for transferring/disposing off three Cars (Registration Nos. DL3CAA2353, DL3CAA2354 and DL3CAA2355) being more that 10 years old.  

Case No.28. M/s Geetee Travels Pvt. Ltd, Mumbai.

F.No. 01/89/180/21/AM14/PC­2(A)

Subject: ­ Request for relaxation in the Engine Capacity from 2500cc to 2300cc.

  The committee did not agree for relaxation in the Engine Capacity from 2500cc to 2300cc for import of 2 nos. of Vaxhall Movano 17 Seat Minibus Diesel Run Vehicles. Request is rejected.

Case No.29. M/s Torrent Pharmaceuticals Ltd.

F.No. 01/82/50/000507/AM13/DES­III Subject: ­ Request of allow duty paid quantity of imports required for use in the manufacture of exports against five Advance Authorization ratified by the Norms Committee AA nos. 0810113626 dated 23.07.2012, 0810113680 dated 25.07.2012, 0810114131 dated 09.08.2012, 0810114353 dated 17.08.2012 & 08.10114951 dated 10.09.2012.   The Committee noted that the applicant has obtained above referred five Authorizations for imports of drugs and exports of formulation under Para 4.7 of HBP. The applicant requested for 5.5% wastage whereas NC has allowed only 2% wastage. The applicant’s contentions that they have utilized full quantity as imported and nothing left for destruction as per requirement of PC­18 thus requested for waiver of the said condition. Taking into consideration the submissions made by the applicant, following decisions were taken:         I.        The applicant has to pay duty + interest on excess imported materials as per norms fixed by the Norms Committee.     II.        PC – 18 condition stands waived to the extent of requirement of destruction certificate.    III.        This is subject to the condition that the applicant shall submit certificate from the concerned Excise Authority that goods so imported from un­registered sources against above mentioned Authorizations have been consumed fully for making resultant products for exports and nothing left balance.  

Case No.30. M/s Varrsana Ispat Ltd, New Delhi.

F.No. 01/60/162/772/AM14/EFGC (PRC) Subject: ­ Request for EOP extension of Advance Authorization No. 0510263617 dated 04.05.2010 for regularization purpose. The Committee decided as following:         I.        Export obligation period is extended upto 30.11.2013.     II.        This is only for regularization of exports already effected and closure purpose.    III.        This is subject to a payment of composition fee @ 0.5% of FOB value of export made outside the original EOP and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.    (Action: RA Delhi)  

Case No.31. M/s Shreeyam Power & Steel Industries Limited, Indore.

  The Committee decided the following:

I.        Export obligation period is extended for 6 months i.e. upto 31.5.2014.     II.        This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.    III.        This is further subject to verification by RA that EO as claimed to have been fulfilled is more than 50%, in proportion to import made, within original export obligation period.    IV.               The  applicant  is  advised  to  submit  the  authorization  for  endorsement  to  RA  as  early  as  possible.  They  are  further  advised  to  start discharging their stipulated balance export obligation on the basis of these minutes without waiting for the endorsement is done on the Authorization.   (Action: CLA, Bhopal/ applicant)
