MEETING NUMBER : 43/82ALC4/2011 MEETING DATE : 24.01.2012 The Meeting No.43/82 in the year 201112 to consider the cases under Duty Exemption Scheme (Chapter4) of Foreign Trade Policy, 200914 pertaining to products falling in Chapter 29 and 30 was actually held on 24.01.2012 under the Chairmanship of Addl DGFT, Shri V.K. M/s. Alkem Laboratories Limited F.No. 01/82/162/01131/AM 12/DES III Decision: The representative of the firm Shri C.J. Lohani, Sr. General Manager, Operations appeared in the PH and explained their case. They have stated that they are the only largest manufacturer and exporter of Sucralose. In the past they have taken licenses under Para 4.7 of HBP where the number of inputs and quantities of solvents were more. Now they have upgraded their technology and reduced the consumption of inputs and solvents. The firm produced the consumption and production certificate for past three years. The Committee taken note of their past production consumption data and considering that they are the only producers and exporter of this product as per our record and further considering appropriate recovery aspect of this solvent decided to ratify norms under Para 4.4.2 of HBP v 1 , or as applied by the firm, whichever is lower: Export Product Exp. They have also brought Production Consumption Data duly certified by Central Excise Authority in support of their higher norms. The Committee noted that Clopidogrel HCL is manufactured from the Cyclic Amine HCL stage via Clopidogrel base route. It was also noted that the other salts of Clopidogrel like Clopidrogel Sulphate or bisulphate are also produced from the same starting stage via Clopidogrel base. The decision earlier taken by the Committee was based on the comparative data up till base stage and thereafter the firm given the conversion yields. The firm emphasized that they are following the patented process given to Sandoz and hence their consumption is more which is also certified by Central Excise Authorities. The firm was therefore, advised to go for noninfringing process.
