MEETING NUMBER : 28/82ALC4/2011 MEETING DATE : 11.10.2011 The Meeting No.28/82 in the year 201112 to consider the cases under Duty Exemption Scheme (Chapter4) of Foreign Trade Policy, 200914 pertaining to products falling in Chapter 29 and 30 was held on 11.10.2011 under the Chairmanship of Addl DGFT, Shri V.K. General ManagerExcise of the company appeared before the Committee and explained the case. They explained that due to overfill, their consumption is on higher side. The representative of Department of Pharmaceuticals informed the Committee and the firm has already been allowed 10% wastage which covers overfill and other losses. Thereafter, the representatives of the firm informed the Committee that against advance authorization No.3110038975 dated 24.06.2009, the quantity of Fomepizole has been allowed to the extent of 1.575 mg/vial of 1.5 ml which should be revised as 1.65 gm/vial of 1.5 ml. After detailed deliberations and in consultation with technical authority present in meeting, Committee decided to enhance the quantity of Fomepizole to the extent of 1.65 gm/vial of 1.5 ml against advance authorization No.3110038975 dated 24.06.2009 without any other change in the decision taken in 42/82 meeting held on 12.01.2010. Committee further decided to maintain earlier decision of NC against advance authorization No.3110045645 dated 26.11.2010 and 3110044134 dated 25.07.2010.
Further it has come to the notice of Norms Committee of DGFT that certain API manufacturers are allowed to manufacture certain APIs only for export purpose. At times formulation manufacturers import the same APIs for conversion to Formulation for 100% export. In both cases requisite manufacturing permission are given to the API and Formulation manufacturers for 100% export only. It is, however, noted that the API manufacturers are not allowed to sell their APIs to the domestic Formulation manufacturer for export. In such cases the API manufacturer export the API and the Formulation manufacturers import the same APIs for formulation manufacture for export. A typical example which has come to the notice of Norms Committee of DGFT is that the API manufacturer M/S RA Chem Pharma Ltd, Hyderabad is manufacturing Fomepizole and they have been granted permission by DCGI to manufacture the same for export only while the other formulation manufacturer M/S Emcure Pharmaceuticals Ltd is manufacturing Fomepizole Injection and they are importing Fomepizole exported by M/S RA Chem Pharma Ltd. In both the cases, the API is being exported 100% either in the form of API or Formulation based on this API, but as per the condition of DCGI, the API manufacturer is not allowed to supply the API to domestic formulation manufacturer who is having the permission to export formulation. In view of above, NC decided to recommend the case to DCGI for granting the permission to API manufacturer to supply the API to formulation manufacturer against valid invalidation letter issued by DGFT organization. It will save the transaction cost for freight and risk of handling as well as avoid outflow of foreign exchange and also lower lead time of supply of the bulk drug as in both the cases, the API is being exported.
