Party Name:BHARAT HEAVY ELECTRICALS LIMITED 09.10.2012 Status:Reject HQ File :01/81/050/00020/AM13/ RLA File :05/23/040/00435/AM12/ Lic.No/Date:0510317273 10.02.2012 Defer Date: Decision : NC observed that similar cases of M/s BHEL, Noida were   considered in NC­I   in its meeting No. 12/13 dated 04.09.2012 and the decision of NC­I is reproduced below:­ This case was considered in detail in the Norms Commiꃂee. The representa슠ve of DHI explained that in this case the items which are being imported are being supplied as such and there is no manufacturing ac슠vity involved. These are being imported by BHEL, Noida Office and they only are supplying these imported items directly to the project sites. The imported items are not being sent to any of their manufacturing facili슠es for carrying out any manufacturing ac슠vity. The Commiꃂee took into considera슠on the clarifica슠on already issued by PIC in its mee슠ng No.11/AM12 dated: 27‐01‐2012 in the case of M/s Instrumenta슠on Ltd and also Policy Circular No.50 dated 28.12.2011. Policy Circular 50 explicitly clarifies that if the goods are imported and supplied as such, then such supplies do not amount to deemed exports and hence deemed export benefits will not be admissible. In view of this, the Commiꃂee decided to reject this case. NC‐II in its mee슠ng  decided to take similar ac슠on and thus rejected this case. R/A may take necessary ac슠on accordingly.   17
