Policy Circular 50 explicitly clarifies that if the goods are imported and supplied as such, then such supplies do not amount to deemed exports and hence deemed export benefits will not be admissible. It is seen from the copy of the EPCG licence that against this EPCG licence they are going to discharge EPCG obliga៝�on by way of export of phosphoric acid. It was also confirmed by the

It was also confirmed by the representa៝�ve of DHI that this power plant is manufactured by BHEL, Hyderbad and that they manufacture non‐mega power project. It was decided that the case may be deferred and a reference be made to the EPCG Division of this Department giving details of the case and specifically seeking for the opinion whether an EPCG licence can be issued for import of power plant against which export obliga៝�on will be discharged by way of export of not the export of power generated by the power plant but by way of export of other products manufactured by M/s Sterlite Industries India Ltd i.e. phosphoric acid.
