The Commiꃂee took into considera슠on the clarifica슠on already issued by PIC in its mee슠ng No.11/AM12 dated: 27‐01‐2012 in the case of M/s Instrumenta슠on Ltd and also Policy Circular No.50 dated 28.12.2011. Policy Circular 50 explicitly clarifies that if the goods are imported and supplied as such, then such supplies do not amount to deemed exports and hence deemed export benefits will not be admissible. In view of this, the Commiꃂee decided to reject this case. NC‐II in its mee슠ng decided to take similar ac슠on and thus rejected this case.
