PRO version Ratification of input output norms in respect of Advance Authorization No. 0510175256 dt. 27.01.2006 and 0510181093 dt. 20.04.2006. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that there were two advance authorizations No. (i) 0510175256 dt. 27.01.2006 and (ii) 0510181093 dt. 20.04.2006 of the firm wherein adhoc norms were already fixed by NC with condition to produce No Objection Certificate (NOC) from D/o Defence Production & Supplies, Govt. of India. Subsequently, after personal hearing of the representative of applicant firm, NC in its meeting held on 24.04.2008 waived the condition to produce NOC from D/o Defence Production & Supplies, Govt. of India because of the fact that exports have already been effected prior to the communication of said NC decision. However, representative of the firm had informed that they could arrange the certificate dated 18th March 2008 from the Deptt. of Defence, USA Joint contracting Command –Iraq/Afghanistan, Camp Eggars confirming that the supplies received under reference are for exclusive usage of Afghan National Army. Accordingly, the NC had advised R.A to verify the genuineness of the above referred certificate dated 18.03.2008 in consultation with the High Commissioner/Embassy of Afghanistan. Norms Committee in its meeting held on 29.04.2010 had decided to advise R.A to issue EODC taking into consideration the only relevant documents required for redemption as prescribed in Chapter – 4 of HBP (Vol.I) and waiving verification condition of certificate dated 18.03.2008 referred above issued by Camp Eggers in view of U.O letter dated 30th August, 2006 from Sh. Dilip Sinha, Joint Secretary (PAI), Ministry of External Affairs, Govt. of India addressed to DGFT referred above. In that case only one advance authorization No. 0510181093 dated 20.04.2006 was mentioned. The 2nd advance authorization No. 0510175256 dt. 27.01.2006 was left out. The Committee therefore decided to advise R.A to take similar necessary action in this case also. The RLA shall be advised to take necessary action subject to compliance of other usual conditions.

Suresh S.Khoday, Partner in the firm, who appeared for personal hearing alongwith two authorized representatives of the firm before the Committee. They explained the case alongwith relevant documents. It was informed that advance authorization in question was issued under SION, J-124 & J-129. But they could not make any export against this advance authorization because overseas export market was very dull and now licence has since been expired. They approached R.A for clubbing and closure alongwith other 4 advance authorizations, which has been rejected. In view of this they have requested to amend the said advance authorization and extend the E.O upto 31.12.2010 so that they can complete E.O in this case. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that as this is a case of Closure & E.O extension, NC has no role to play. Suresh S.Khoday, Partner in the firm, who appeared for personal hearing alongwith two authorized representatives of the firm before the Committee. They explained the case alongwith relevant documents. It was informed that advance authorization in question was issued under SION, J-124. Against this licence, they imported MRS 17412.730 Kgs and but exported MRS 14868.890 Kgs i.e 2341.750 Kgs. of excess exports made in this case. Further, in Dupion Silk they imported 7789.690 Kgs but exported 5053.33 Kgs in shortfall (shortfall Qty. 550-765 Kgs.) and for shortfall Qty. they have already paid customs duty. In view of this they have requested to enhance the import Qty. & export Qty. of MRS against the said advance authorization with revalidation for 3 months so that they can complete imports accordingly. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to advise firm to make their request to Policy Relaxation Committee (PRC) for pro-rata enhancement & revalidation.
