At the outset the Minutes of NC Meeting Nos. 22/AMO9 dated 28.08.2008 and 23/AMO9 dated 04.09.2008 were ratified. The Agenda for individual cases for Meeting No. 24/AM09 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision: The Committee considered the case as per agenda alongwith relevant papers and observed there is no valid justification for seeking higher wastage than allowed by ALC earlier. In view of this Committee decided to maintain status quo in this case.

M/s East End Silks(P) Limited., Kolkata F.NO.1/84/50/459/AM06-DES-V No.0210082301 dt. 23.9.2005 – under Para 4.7 of HBP (Vol1) 2004-2009. the case is under examination of DC (MSME) and comments are awaited. Hence, it was decided to defer the case for re-listing on 09.10.2008.
Case No. 323
M/s Noronha Impex International., Kanpur F.NO.1/84/162/728/AM06-DES-V No.0610012215 dt. 20.08.2007 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh.Allan de Noronha, an authorized representative of the firm, who appeared for personal hearing in this case. He explained the case along with sample of export item. He explained that the import item at S.No.1 is Hair & Accessories hair/iron/beads. Hair stands for synthetic hair, Iron stands for iron shifters and Beads stands for beads itself. The Committee after detailed deliberations decided that import item at S.No.1 i.e relevant synthetic hair & hair accessories may be allowed @ 1.02 kg/kg content. The rest of items may be allowed as already allowed by NC in its meeting held on 07.02.2008.
The RLA shall be advised to take necessary action subject to compliance of other usual conditions.

M/s Fibre Links, Kanpur F.NO.1/84/50/371/AM08-DES-V No.0610012844 dt. 11.02.2008 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Shashi Kant Singh, Sr. Manager (Exports) of the firm, who appeared for personal hearing in this case. He explained the case along with sample of export item. He explained that their export product is Polyester braided Cord – 1.00MM diameter (Natural). The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case by allowing the item of import i.e Polyester high tenacity yarn with 2% wastage. Thus, firm have to account for 10,200 Kgs. of import item on the export side against the A/A in question. The description of export item No. 1 may be amended to read as “Polyester braided Cord dyed –1.00MM diameter”. The export item No. 2 may be deleted.
The RLA shall be advised to take necessary action subject to compliance of other usual conditions.
Case No. 325
M/s Apparel Merchandising Co. New Delhi F.NO.1/84/50/459/AM07-DES-V No.0510197231 dt. 03.01.2007 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh.Hemant Sangal, an authorized representative of the firm, who appeared for personal hearing in this case. He explained the case along with sample & CAD/CAM of export/import item. The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting felt that based on CAD/CAM submitted in this case, the 0.85 Sq mtrs./Pc is adequate for Lining fabric. In view of this Committee decided that import item no.2 i.e woven lining TC: 100% cotton may be allowed @ 0.85 Sq mtrs./Pc in partial

However, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case by allowing 2% wastage on item of import i.e as applied by the firm as detailed below: - Export item Export Qty. Now, firm have requested for deletion of this measurement condition in the export product. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to delete the measurement size condition from all the export products against the subject advance authorization in partial modification of ALC decision taken on 22.09.2005.

M/s Orient Fashions Exports (India) Pvt. Ltd. F.NO.1/84/162/661/AM09-DES-V No.0510173215 dt. 29.12.2005 under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Smt. Suman Jamwal, an authorized representative of the firm, who appeared for personal hearing in this case. She explained the case along with sample & CAD/CAM of export/import item. The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting felt that based on CAD/CAM submitted in this case, 5 Mtrs./Pc is adequate for import item no. 2 i.e Lace cotton. In view of this
PRO version Committee decided that import item no.2 i.e Lace cotton may be allowed @ 5 Mtrs./Pc in partial modification of earlier decision of ALC meeting held on 13.04.2006.

Case No.1 Proposal for DEPB rates for Textile & Leather products NC 11/AM09 dt. 12.06.2008 F.No. 01/84/162/259/AM-09/DES-V Proposal for revision of DEPB rates as per custom duty in budget 2008-09. Decision: - The proposal for revision of DEPB rates pertaining to Textiles and Leather products in accordance with the revised Custom Tariff 2008-09 was considered during the NC-V meeting held on 11.09.2008 alongwith relevant details and previous file on the matter. The representatives of technical members present in the meeting was also of the view that as regards Custom duty in respect of Textiles and Leather products in the budget year 2007-08, as the same has not been changed in the budget year 2008-09, hence, felt that DEPB rates for Textile & Leather products for the year 2008-09 should not be changed with reference to the existing DEPB rates for the same in the year 2007- 08. In view of this Committee after detailed deliberations in consultation with the representatives of technical authorities present in the meeting decided to refer the proposal accordingly to DEPB Committee for their final view in the matter.
