Ref. from PC4 F.No. 01/94/180/141/AM09/PC4 Clarification regarding import of Sugar Milk i.e. Lactose as per SION under DFIA Scheme. Above two cases were discussed in the NC meeting on 10.06.2010. Policy Division has referred back these cases to NC. On submission of file to DG by Policy Division, it has been stated explicitly as under: “Accountability for the alternate raw material in the export product has to be ensured. The said conditions needs to be imposed in respect of ‘Lactose’, if it is not there at present. Mannitol can be examined similarly. Second, the question to be seen for alternative input is also not whether the input can be used, but whether the inputs is actually used. For this, the Norms Committee may need to see/examine the data of representative company(ies) backed by a certificate of CA & thereby verify that the alternative material is actually used”. The matter was deliberated in the Norms Committee to find out whether technical authorities have any knowledge (off hand) on the quantum of the above alternate inputs used for manufacture of export products.. Technical members stated that they have no off hand information and will have to refer to the relevant research papers/database. Therefore, it is not possible for the technical members to determine the quantities to be allowed for each of these items i.e. Lactose, Mannitol or any other natural sugar substitute. Technical members were also of the view that if some specific dietary/inputs are required for making of export products, in such cases applicants would have the option to apply under para 4.7 of HBP, Vol. I for fixation of adhoc norms. Mannitol: In the above circumstance of the case, Committee decided that the applicant namely M/s. Nandlal Bankatlal Pvt. Ltd., may be asked to confirm (i) whether mannitol is actually used in the export product for which they have obtained DFIA. (ii) If yes, applicant may submit proof as per Appendix23 of HBP, Vol.I alongwith Central Excise data indicating the quantity of mannitol used for each specific DFIA. (iii) Data for at least three representative companies/firms may be given, duly recommended by FIEO/EPC. Lactose: The Committee was of the view that the clarification issued by Policy Division vide their letters No. 01/94/180/141/AM09/PC4 dated 31.07.2008 to Commissioner of Customs (Exports), Chennai (in respect of DFIA No. 0310434384 dated 28.06.2007 of M/s. Laxmi International & transferred in the name of M/s. Kawarlal & Co.) and also to Commissioner of Customs, Nhava Sheva, Raigad would have to modified suitably and Customs be informed that no further import of Lactose may be allowed as an alternate input to sugar under SION E1 & E5 till Norms Committee is in a position to check accountability condition of Lactose usage in export product and quantify the same. A letter may be accordingly issued to relevant Customs Authorities. Further, M/s. SBL Pvt. Ltd. may be requested to provide production consumption data of representative manufacturing companies for the export product under SION E1 & E5 for the preceding three licensing years as per ANF4B regarding fixation/modification of SION duly recommended by the concerned Export Promotion Council (if there is no specific EPC, then recommendation of FIEO).
Further, the Norms committee also decided to make a reference on the quantification issue to (i) Directorate of Sugar and (ii) Deptt. of Foods/MFPI) XXX
