Case No.1. M/s Umedica Laboratories Pvt. Limited, Mumbai.

F.No. 01/60/162/982/AM13/EFGC (PRC) PRC Meeting No. 43/AM13 dated: 19.03.2013 Subject: ­ Request for EOP extension of Advance Authorization No. 0310294308 dated 29.09.2004 issued under PC­9 condition.   After deliberating the case in length the following decisions were taken: I. Export obligation period is extended from 6 months to 12 months from the date of first import consignment. II. This is only for regularization and closure purpose. III. This is subject to a payment of composition fee @ 0.5% of FOB value  of export made outside the original EOP and minimum value addition of 15% as prescribed under para 4.1.6 of FTP.    (Action : RA, Mumbai)

Case No.2. M/s Umedica Laboratories Pvt. Limited, Mumbai.

F.No. 01/60/162/1210/AM12/EFGC (PRC) Subject: ­ Request for EOP extension of Advance Authorization No. 0310502028 dated 09.01.2009 for regularization purpose.   The Committee noted that the applicant did not come with clean hand.  The  Committee  in  its  meeting  18.12.2012  has  rejected  request  and directed them to get the case regularised in terms of Para 4.28 of HBP.  Further, export made under drawback shipping bill canot be taken into account towards discharge of EO against Advance Authorisation as the drawback is paid under auto route.  The Committee, therefore, rejected the request.    (Action: RA Mumbai, Please explain as to why decision of PRC dated 18.12.2012 has not been adhered to ?)

Case No.3. M/s Haldia Petrochemicals Limited, Kolkata.

F.No. 01/60/162/584/AM13/EFGC (PRC) Subject: ­ Request for EOP extension of 4 Advance Authorization No. 0210119944 dated 20.11.2008, (2) 0210122139 dated 13.01.2009, (3) 0211029084 dated 15.07.2009, (4) 210137022 dated 28.01.2010.     i)        Export obligation period is extended for 6 months from the date of endorsement or upto 30.09.2013 which ever is earlier.      This is subject to payment of composition fee @ 0.5% on unfulfilled FOB value of exports and minimum value addition of 15% as prescribed under para 4.1.6 of FTP. )    This is further subject to verification by RA that EO as claimed to have been fulfilled is more than 50% (value wise) and item no.2 & 4 more than 100% Qty. wise within the valid EOP. iv)   The applicant is advised to submit the licence for endorsement to RA as early as possible.  They are further advised to start discharging their stipulated balance export obligation on the basis of this minutes without waiting for the endoresement is done on the Authorisation.   (Action : RA kolkata)

Case No.4. M/s Haldia Petrochemicals Limited, Kolkata.

Subject: ­ Request for EOP extension of  Advance Authorization No. 0210130458 dated 14.08.2009 for regularization.

            i.        Export made upto 31.12.2012 is regularized.

ii.        This is only for regularization and closure purpose.    iii.        This is subject to a payment of composition fee @ 0.5% of FOB value  of export made outside the original EOP and minimum value addition of 15% as prescribed under Para 4.1.6 of FTP.    iv.        This is also subject to the condition that the case has not been adjudicated. v.  Shortfall, if any, shall be regularized in terms of Para 4.28 of HBP.   (Action : RA, Kolkata)

Case No.5. M/s Ashish Life Science Limited, Mumbai.

F.No. 01/60/162/574/AM13/EFGC (PRC) Subject: ­ Request for EOP extension of Advance Authorization no. 0310525767 dated 25.06.2009 for regularization purpose.   The case was placed before the Committee and after deliberating the case in length the following decisions were taken:         I.        No further extension of Export obligation period beyond 18  months.     II.        This is only for regularization and closure purpose.    III.        The extension already granted is subject to a payment of composition fee @ 0.5% of FOB value  of export made outside the original EOP and minimum value addition of 15% as prescribed under Para 4.1.6 of FTP.   IV.        The condition of re­export/destruction of imported raw material as stipulated in Policy Circular 18 dt. 30.10.2007 be waived as the firm has stated to have already utilized the imported raw material fully by exporting the product manufactured from these.     V.        Custom duty + interest has to be paid on inputs consumed and exported outside the EO period and on inputs consumed and exported under free shipping bills.   (Action : RA, Mumbai)

Case No.6. M/s S. Khoday Silk Twisting Fadctory, Bangalore.

Subject: ­ Request for EOP extension of Advance Authorization No. 0710065086 dated 29.05.2009.

  The committee noted that no considerable exports, which form merit, of the case have been made by the firm within the original validity,  hence the request is rejected. The applicant is directed to get their case regularised in terms of Para 4.28 of HBP.    (Action RA: Bangalore­ If the party fails to get the case regularised in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT(D&R) Act. 1992 and report)

         i.            0410089179 dt. 26.04.2007     0410089359 dt. 10.05.2007    0410089180 dt. 26.04.2007    0410089355 dt. 10.05.2007    0410089353 dt. 10.05.2007     0410089370 dt. 10.05.2007    0410098955 dt. 30.09.2008       0410089083 dt. 20.04.2007     0410089800 dt. 05.06.2007    0410089354 dt. 10.05.2007     0410088952 dt. 13.04.2007    0410089084 dt. 20.04.2007   The  justification given by the firm is not convincing to the committee as the time­schedule prescribed under Para 9.11 is applicable only where the application is complete in all respects.  Since, the firm has not submitted the application alongwith documents, as prescribed in the HBP r/w ANF­4E, the claim of the firm that schedule should be adhered to is incorrect. Thus the request is rejected.

Case No.17. M/s Haldia Petrochemicals Limited, Kolkata.

F.No. 01/60/162/964/AM13/EFGC (PRC) Subject: ­ Request for clubbing of 2 Advance Authorization Nos. 0210128833 dated 09.07.2009, (2) 0210179549 dated 09.07.2012.     i)             To allow clubbing of 2 Advance Authorizations as referred above. ii)            This is only for regularization and closure purpose and not for any further exports/imports. Excess import if any may be regularized in terms of Para 4.28 of HBP. iii)           RA may examine the case in terms of Para 4.1.6 of FTP and ensure value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations

to be clubbed. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations. iv)           RA may do clubbing subject to the condition that no adjudication order is issued against any licence to be clubbed.   (Action : RA, Kolkata)

Case No.18. M/s Haldia Petrochemicals Limited, Kolkata.

Case No.19. M/s Apollo Tyres Limited, Gurgaon.

F.No. 01/60/162/645/AM13/EFGC (PRC) Subject: ­ Request for clubbing of two Advance Authorization no. 0510104115 dated 01.10.2003, (2) 0510236790 dated 19.02.2009 for regularization purpose.   The  Committee  noted  the  request  of  the  firm  and  decided  to  reject  as  the  gap  between  the  above  two  authorizations  is  substantial  and  the Committee therefore did not agree to club these authorizations. The applicant is advised to get the cases regularized separately in terms of para 4.28 of HBP.

(Action  :  RA,  CLA,  New  Delhi;  If  the  party  fails  to  get  the  case  regularised  in  terms  of  Para  4.28  of  HBP  within  a  month  from  the  date  of communication of this decision, RA shall take action against the firm under the provision of FT(D&R) Act. 1992 and report)

Case No.20. M/s PME Power Solutions (India) Limited, New Delhi.

F.No. 01/60/162/995/AM13/EFGC (PRC) Subject: ­ Request for clubbing of 3 Advance Authorization No. 0510241498 dated 15.05.2009, (2) 0510251242 dated 22.10.2009, (3) 0510251244 dated 22.10.2009.   After deliberating the case in length the committee noted that waiver of bond is only a facility to allow import without execution of bond with customs and this is allowed where exports are made prior to import. Redemption is done where exports and  imports are completed. Therefore, it was decided to allow clubbing of authorization where EODC issued only for waiver of bond. Accordingly the following decision was taken: i)             To allow clubbing of 3 Advance Authorizations as referred above. ii)            This is only for regularization and closure purpose and not for any further exports/imports. Excess import if any may be regularized in terms of Para 4.28 of HBP. iii)           RA may examine the case in terms of Para 4.1.6 of FTP and ensure value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations. iv)           RA may do clubbing subject to the condition that no adjudication order is issued against any licence to be clubbed.   (Action : RA, CLA, New Delhi)

Case No.21.M/s Umedica Laboratories Pvt. Limited, Mumbai.

F.No. 01/60/162/998/AM13/EFGC (PRC) Subject: ­ Request for clubbing of 3 Advance Authorization Nos. 0310272652 dated 03.06.2004, 0310292692 dated 21.09.2004 & 0310293606 dated 24.09.2004 issued under PC­9 condition.     After deliberating the case in length, the following decisions were taken: i)                      To allow clubbing of 3 Advance Authorizations as referred above. ii)                    Export obligation period is extended upto 30.9.2006 against Advance Authorization Nos. 0310272652 dated 03.06.2004. iii)                   This is only for regularization and closure purpose and not for any further exports/imports.

iv)                   Only exports which is affected within the extended validity of earliest authorization i.e. 31.09..2006 shall only be taken into account for clubbing purpose. v)                    Excess import if any may be regularised in terms of Para 4.28 of HBP. vi)                   This is subject to payment of composition fee @0.5% on FOB value of export made after 31.3.2006 but before 30.9.2006.and which will be counted for clubbing and regularization. RA is also directed to examine the case in terms of Para 4.1.6 of FTP and ensure value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed. RA should ensure proper accounting of

Case No.22. M/s Umedica Laboratories Pvt. Limited, Mumbai.

F.No. 01/60/162/997/AM13/EFGC (PRC) Subject: ­ Request for clubbing of 3 Advance Authorization No. 0310250711 dated 03.02.2004, 0310294302 dated 29.09.2004, 0310294433 dt. 30.09.2004 issued with PC­9 condition  and 0310417746 dated 31.01.2007 issued with normal condition.   The Committee noted that request of the firm is for clubbing of 3 AAs which were issued under PC­9 condition with pre­import condition and to club with the Authorisations issued with normal condition.  There is substantial gap between issuance of AAs and exports were affected under last Authorisation beyond the obligation period fixed against AAs issued with PC­9 condition.  Hence the Committee rejected the request. The applicant is advised to get the cases regularized separately in terms of para 4.28 of HBP.   (Action : RA, Mumbai; If the party fails to get the case regularised in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT(D&R) Act. 1992 and report)

Case No.23. M/s National Steel & Agro Industries.

F.No. 01/60/162/486/AM13/EFGC (PRC) Subject: ­ Request for clubbing of Advance Authorization with AU condition No. 1110006466 dated 24.07.2003 with AA No. 0540837 dated 14.03.2012 in relaxation of PN No. 79 dated 13.10.2011.   After deliberating the case in length, the following decisions were taken:  i.             The request for clubbing is rejected.

ii. However the exports made under shipping bill no. 5345992 dt. 28.07.2004 under F.No. 11/22/40/10/AM05 dt. 5.7.2004  may be counted towards discharge of export obligation against Advance Authorization No. 1110006466 dated 24.07.2003. iii. This is only for regularization and closure purpose iv. The Authorisation No. 0540837 dated 14.03.2012 shall be made inoperative.    (Action : RA, Bhopal)

Case No.24. M/s Jay Chemicals Limited, Mumbai.

F.No. 01/60/162/996/AM13/EFGC (PRC) Subject: ­ Request for clubbing of 4 Advance Authorization Nos. 1) 0310481354 dated 05.08.2008, 2) 0310539254 dated 24.09.2009, 3) 0310544316 dated 06.11.2009, 4) 0310551751 dated 21.12.2009.   After  deliberating  the  case  in  length,  the  Committee  observed  that  this  request  could  have  been  considered  by  RA  itself  because  all authorisations are issued within a span of 18 months.  However, the following decisions were taken:   i)             To allow clubbing of 4 Advance Authorizations as referred above. ii)            This is only for regularization and closure purpose and not for any further exports/imports. Excess import if any may be regularized in terms of Para 4.28 of HBP. iii)           RA may examine the case in terms of Para 4.1.6 of FTP and ensure value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations. iv)           RA may do clubbing subject to the condition that no adjudication order is issued against any licence to be clubbed.   (Action : RA, Mumbai)

Case No.25. M/s Concept  Pharmaceuticals Limited, Mumbai.

F.No. 01/60/162/1004/AM13/EFGC (PRC) Subject: ­ Request for seeking regularization under PC­18 condition for Advance Authorization No. 0310526662 dated 01.07.2009.   After discussion in length, the  following decisions were taken:                     i.            Condition of PC­18 is waived to the extent of raw material consumed and exported subject to following conditions.

i)          Such waiver is subject to payment of  duty + interest on excess import made as per norm ratified by the Norms committee. ii)         Submission of certificate issued by respective Excise Authority regarding consumption of whole imported raw material in the resultant products so exported. (Action :RA Mumbai)

Case No.26. M/s Rallis India Limited, Mumbai.

F.No. 01/60/162/978/AM13/EFGC (PRC) Subject: ­ Request for clubbing of two Advance Authorizations no. 1) 0310548574 dated 01.12.2009 and  (2) 0310674996 dated 05.01.2012   After deliberating the case in length,  the following decisions were taken:   i)             To allow clubbing of 2 Advance Authorizations as referred above. ii)            This is only for regularization and closure purpose and not for any further exports/imports. Excess import if any may be regularized in terms of Para 4.28 of HBP. iii)           RA may examine the case in terms of Para 4.1.6 of FTP and ensure value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations. iv)           RA may do clubbing subject to the condition that no adjudication order is issued against any licence to be clubbed.   (Action : RA, Mumbai)

F.No. 01/60/162/968/AM13/EFGC (PRC) Subject: ­ Request for clubbing of 2 Advance Authorizations Nos. 1) 0710069665 dated 27.01.2010 and 2) 0710070571 dated 17.03.2010.   After  deliberating  the  case  in  length,  the  Committee  observed  that  this  request  could  have  been  considered  by  RA  itself  because  all authorisations are issued within a span of 18 months.  However, the following decisions were taken:   i)             To allow clubbing of 2 Advance Authorizations as referred above. ii)            This is only for regularization and closure purpose and not for any further exports/imports. Excess import if any may be regularized in terms of Para 4.28 of HBP.

iii)           RA may examine the case in terms of Para 4.1.6 of FTP and ensure value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations. iv)           RA may do clubbing subject to the condition that no adjudication order is issued against any licence to be clubbed.   (Action : RA, Mumbai)
